REASON FOR APPEAL ~r ) A Variance to Section 280A Subsection 3 (X) A Variance to the Zoning Ordinance ( ) is requested for the reason that applicant is to build a private residence at said site. House is intended to be placed parallel with width of property, the front fac lng right of way. Property is 100 x 189.56; house is 24 x 44 (including a porch of 8 feet) which makes it necessary to have a zoning variance of 5 feet either on the front or rear line. 1~orm Z]~I (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because if a variance of 5 feet is not allowed, applicant's house would have to be placed on property in such a way that the front of the house would be facing the back yard of neighbor, if and when the land in front of applicant's is improved. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because the property is located on a private right of way which has not been dedicated for a public thoroughfare and there is no likelihood that it would ever be paved and used by and for the public. To allow the house to be built parallel to the width of the property would help to keep the area uniform and allow the front of the house to face the right of way, which is the only road the property faces. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the house would conform to the general pattern of having the front of the house facing a road, especially in the case where it is not a public road, but a private road.
