Following the transfer Lot 1 will be decreased from 634,565 sq. ft. to 630,325 sq. ft. and remain conforming in the Zoning District. Lot 2 will be increased from 11.717 sq. ft. to 15,957 sq. ft. and become less nonconforming in the Zoning District, and WHEREAS, on December 2, 2022, the applicant submitted a resubdivision application for review by the Southold Town Planning Board; and WHEREAS, on February 6, 2023, at their Work Session, the Planning Board reviewed the application and found it incomplete with the following items to be submitted immediately: 1. ZBA decision (creating non-conforming lot sizes); 2. Certificate of Occupancy; 3. Proof of Lot Recognition; 4. Submission of draft deeds with new legal descriptions; and WHEREAS, on March 20, 2013, the Zoning Board of Appeals (ZBA) requested comments for consideration of a lot area variance as shown in ZBA Application #7782; and Forbes & Cohen Resubdivision [2] October 17, 2023 WHEREAS, on May 31, 2023, the Planning Board responded to the ZBA's request for comments supporting a variance for a non-conforming lot in the R-80 Zoning District; and WHEREAS, on June 15, 2023, a grant of area variance was issued by the ZBA; and WHEREAS, on July 24, 2023, at their Work Session, the Planning Board found the resubdivision application complete and determined that the proposed action meets all the necessary requirements of Town Code §240-57 for a resubdivision application; and WHEREAS, pursuant to §240-56 Waivers of certain provisions, the Southold Town Planning Board shall have the authority to modify or waive, subject to appropriate conditions, any provision of these subdivision regulations, if in its judgment they are not requisite in the interest of the public health, safety and general welfare, except where such authority would be contrary to other ordinances or state law; and WHEREAS, the Southold Town Planning Board has determined that the following provisions of the Southold Town Code §240 Subdivision of Land are not requisite in the interest of the public health, safety and general welfare, and therefore, are eligible for a waiver: a. Sketch Plat Review b. Existing Resources Site Analysis Plan (ERSAP) c. Yield Plan d. Primary & Secondary Conservation Area Plan e. Preliminary Plat Review f. Preliminary and Final Public Hearings; and WHEREAS, this application is EXEMPT from review by the Local Waterfront Revitalization Program as no new development potential will come as a result of this resubdivision; and WHEREAS, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5(c)(16) the granting of individual lot line adjustments are listed as a Type II Action; and WHEREAS, the Southold Town Planning Board has determined that this proposed action is a Type II Action under SEQRA as described above; and WHEREAS, the applicant has submitted new deeds for the parcel boundaries and the metes and bounds match the January 2023 survey, and WHEREAS the Southold Town Planning Board found that this Final Plat application is ready for a determination outlined below pursuant to Town Code §240 Subdivision of land; and Forbes & Cohen Resubdivision [3] October 17, 2023 WHEREAS, pursuant to the resubdivision Policy set by the Planning Board in February 2011, this application is eligible for a decision from the Planning Board prior to receiving approval by the Suffolk County Department'of Health Services (SCDHS) as it meets the following criterion set forth in that policy: • Where no new development potential will be created in the parcel to which the land is transferred; therefore, be it RESOLVED, that the Southold Town Planning Board, pursuant to §240-56 Waivers of certain provisions, hereby waives the following provisions of subdivision: a. The following needed to be submitted: 1. A Southold town Zoning Board of Appeals decision on the proposed action is required to address the proposed non- conformities if the action is approved; Page 2 ZBA Decision: On March 20, 2013, the Zoning Board of Appeals (ZBA) requested comments for consideration of a lot area variance as shown in ZBA Application #7782, and on May 31, 2023, the Planning Board responded to the ZBA's request for comments supporting a variance for creating a non-conforming lot in the R-80 zoning district. The ZBA on June 15, 2023, granted the area variance sought requiring Planning Board approval and the filing of a new post-approval deed within 1 year of final subdivision approval. 2. Proof the parcel meets lot recognition; The applicant submitted the lot 1 deed that was recorded in 1960, 1970, and 1981. The title company found that lot 2 was created in 1917. Both parcels were created prior to 6/30/83. § 280-9 Lot recognition. [Added 11-28-1995 by L.L. No. 23-1995; amended 7-22-1997 by L.L. No. 22-1997] A. The applicant has submitted new draft deeds for the parcel boundaries and the metes and bounds match the January 2023 survey. The language is included in the draft deeds. VI. Coordination In March 2023 the ZBA submitted the action to Suffolk County Planning Commission and Pursuant to the requirements of Sections A 14-14 thru A 14- 25 of the Suffolk County Administrative Code, it was found to be a matter for local determination as there appears to be no significant county-wide or inter- community impacts. VII. Waivers Pursuant to Town Code §240-56 Waivers of Certain Provisions, the Planning Board may waive certain elements of the subdivision review §240-56 Waivers of certain provisions. "The Planning Board shall have the authority to modify or waive, subject to appropriate conditions, any provision of these subdivision regulations, if in its judgment they are not requisite in the interest of the public health, safety and general welfare, except where such authority would be contrary to other ordinances or state law." Page 4 After reviewing the information submitted for this application, it is recommended that the Planning Board waive the following requirements and steps of the subdivision review process, as they are they are not requisite in the interest of the public health, safety and general welfare: a. During the public hearing,a neighbor spoke via Zoom in opposition to the proposed future inground swimming pool identified in this application. No other immediate neighbor or member of the community spoke in favor of or against this application. Town of Southold Planning Board Approval is required. EIN-QtN-QLQF FAQ-TLR t B _ACII EASQNS FQL _QAKD _QN. The Zoning Board of Appeals held a public hearing on this application on June 1,2023 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject"receiving"property(Lot#2) along with two neighboring parcels on Narrow River Road, south of Lot #1, are all non-conforming in lot size. While Lot 41 is more in character of the surrounding area, greater in size than the minimum 80,000 square feet as required, the transfer of area between the two lots will make Lot#2 more conforming, while still remaining non-conforming. Immediate neighbors and those using the public roadway will not be able to discern the lot size nor the addition of 4,240 square feet of area. 2. Town Law 6267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance- Lot#2 as created is substandard in area relative to the Zoning requirements of the R80 Zoning District and has pre-existing, non-conforming setbacks. As a result of its small size, there is no way to make the property 'more conforming' other than by transferring land area from Lot #1 to Lot#2; in so doing,an encroachment will be corrected—placing the applicant's potable well and shed on their property. 3. Town Law L267-bQ(b)(3) 'rhe variances granted herein are mathematically substantial for the lot size representing 80% relief from the code, and the lot depth representing 50"K relief from the code. The variances granted herein are not mathematically substantial for the lot width representing 1% relief from the code, and the rear yard setback representing 4.7%relief from the code. However,as presently existing Lot#2 is non-conforming on all aspects of the code as currently written. Furthermore, by granting relief and increasing the overall lot size, the subject parcel is actually more confornling to the code and also corrects an existing encroachment(subject parcel potable well located on Lot#1)and existing stied straddling the existing property line. The distance between wells and sanitary systems are non-conforming due to the small size of the parcel and the additional land, transferred, enables the separation between the well and the sanitary system to be more conforming with Suffolk County Board of Health requirements and enhances the areas water quality. 4. Town Law $267-b(3)LbI U4 . No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. C7 5. Town Law&267-b,(3J(b)J5). The difficulty,has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
