1. STRICT APPLICATION OF THE
the applicant cannot build
ORDINANCE would produce UNDUE HARDSHIP because
a home on the lot without obtaining approval
of access. A contract has been- prepared for ~~e Eomp~etion of this
road.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this propehfy and in this use district because Liberty Lane and Columbia Road
are the only highways in this development which do not have Town
approval. After the contract to complete these roads has been
finished these roads will be offered to the Town of Southold for
dedication.
3. The Variance would observe the spirit of the Ordinance. and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the applicant for a building permit,
Mr. Tjornhom, intends to build a house in keeping with the area.

d. Upon approval of this application, the Building Inspector will issue 0 Building Permit to the applicartt. Such

investigation and inspection the Board finds that inasmuch

as the present unimproved access road Liberty Lane is sufficient for
the passage of emergency vehicles and a contract has been signed for
the improvement of Liberty Lane so that it may be joined to the other
accepted roads in this open development the Board feels that a
12 months temporary access should be permitted in order that the
applicant may begin construction of a residence on the lots. Permitted
access will be from the north end of Summit to Lots 61 - 62, a distance
of approximately 150 feet.

In Consideration of the sum of Fourteen Thousand Five HundreJ
($14,500.00) Dollars to be paid by the Owner to the Builder as herein-

Owner at Bay View, in the Town of Southold, Suffolk County, New York,

Gritz) as set forth on a certain map of' Otto W. Van Tuyl, Licensed Sur-
veyor, revised May 23, 1956. a copy of Which map is attached hereto snd
made a part hereof. It is understood and agreed that the Builder will
grade, oil and surface the roads and construct the required blacktop
gutters in 8ueh manner as to be sufficiently satisfactory to tte Town
Superintendent of Higlmays of the TO.."Il of Southold anu the SO:ltholtl Town
Board to the extent that the Town Board will accept said roads as public
highways. The Builder agrees to start work not later than June 30, 1961.
The total price to be paid by t'w Owner to the Builder is to be
Fourteen Thousand Five Hundred ($14,500.00) Dollars, payable as follows:
the sum of Three Thousand ($3,000.00) Dollars shall be paiu by the Owner
to the Builder when the Builder actually starts work on the roadSj the
sum of Two Thousand ($2,000.00) Dollars shall be paid by the Owner to the
Builder on or before August 30, 1961j the sum of Nine Thousand Five Hund~ed
($9,500.00) Dollars shall be paid by the Owner to tho Builde!' out of tb'3
proceeds of the sale of parcels of real property fronting on the roads
to the extent that upon the completion of each sale a sum not exceeding
three-fourths (3/4) of the net salea price shall be paid by the Owner to
