REASON FOR APPEAL Continued 1. STR:ICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHiP' because: Premises in question were acquired by appellants on July 3, 1950. The premises is a vacant lot having a width of 60 feet and a depth of 140 feet. The lot in question is located on the easterly side of Bailey Avenue near the Village of Greenport. It is an area com- prising dwellings, a substantial portion of which are constructed on lots of a similar or small size. Appellants have contracted in writing to sell the northerly one-half bf the":lot to Roger C. Stakey, the abutting owner on the north and the southerly one-half thereof to Gerald O. Tuthill the owner abutting on the south. Such contracts are contingent upon appellants obtaining the relief sought herein. Appellants have been endeavoring to sell the lot in question for some period of time and have been unable to find a purchaser other than the abutting property owners as hereinbefore set forth. Most of the dwellings in the area do not conform to the side yard requirements of the ordinance and if the lot in question were to be used for the construction of a dwelling, it would be extremely difficult to conform to the side yard requirements of the Building Zone Ordinance. Your appellants believe that the proposed sub- division of the premises would afford the best solution to the utilization of a lot smaller than the minimum size lot permitted by the Building Zone :p'rdfn~'l,~75s"'ip created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because: Upon information and belief, the lot in question is the only vacant lot in the entire neighbo~od. All other land in the area has been built on. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because: The sale of the lot in question as proposed~ your appellants would result in the increase in width of the two abutting premises by 50% and the abutting premises would then have a width of approximately 90 feet which width upon information and belief is larger than the majority of property in the vicinity.
