REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
. prior to the enactment of zoning this property was
is requested for the reason that improved with two dwellings-a l'~rge one near the bay
and a small one near the road. The owner, now a widow, is unable to either
use or maintain so much property. The parcel has open space area sufficient
for S separate building lots of size presently required by the Zoning Or'din-
ance. I wish to divide it into just two plots with one house on the Bay
and one near the road. Both plots will be larger in area than presently
required but the bav lotowill only have 55 feet on the road instead of 100'.
It will,however, have 16,) feet on the bay.

REASON FOR APPEAL
Continued
1. STRiCT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because applicant owns a parcel big enoua:h for five lots but
without a variance cannot divide it into even two lots because the road
frontage is only 5C; feet. The hardshi.p results from the insufficient
street frontage althou~h more than adequate area and the fact that the
two houses were buil t on the pro;'erty lO"lg before ID ning was enacted.
2. The hordship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because most of the properties in thi s
area h9.ve only one d'N'eLl'l.np".
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the two parcels created by the d'l.vision
wOl'ld even be la rp:er than a single building lot invisioned by the
ordinance and the bay house w'l.th 55 feet of road frontage upon which
there would be no building would leave the property even in the future
with the same appearance as now. The road frontage part of the bay house
,.rould not be ,,,ride enough for a "'hiI'd house to be bugd so that there
would be no change in the charECter of the improvements or ne; .o:hborhood.

Dear Mr. Terry:
I am enclosing a map of the property of' the Estate of
William H. Wasson at Laurel which is improved as the map shows
with a main house near the bay end and a cottage at the Northeast
part near the boulevard. Mrs. Wasson wishes to divide the
property, for the purpose of selling the main house, into two
plots. The division line is shown cross-hatched on the map.
This letter is a request for approval of this division
of the property. If such approval cannot be granted under the
terms of your zoning law because the bay house parcel has only
55 feet frontage on the boulevard, would you kindly write me
a letter of denial so that we may make application to the Board
of Appeals.
