Dear Mr. Terry:
I did not receive your letter regarding the hearing
on the piece of property which I am selling to Wills and
Vreeland until after the date of the hearing, and I was,
accordingly, unable 5o reply earlier.
I am selling to Messrs. Wills and Vreeland between
6 and 7 acres of my land on the sound west of the Capt.
Kidd Subdivision in Mattituck. I believe that Messrs.
Wills and Vreeland intend to erect two houses on this
property in the future. As to the balance of my
property, I have no plans to either sell it or to build
homes on it, although, of course, I may do one or the
other at a future date.
The property being sold to Wills and Vreeland has
50 ft. of frontage on the southerly terminus of Linda
Road, which I believe is a public highway of the Town
of Southold. It also has a right-of-way over a proposed
continuation of Central Drive, which I believe is also
a public road of the Town of Southold.
I have reserved the fee title to this proposed
continuation of Central Drive and have reserved the
right to improve it and dedicate it to the Town of
Southold. I have also, however, given them the right
to improve it and dedicate it to the Town of Southold.
In all honesty, it is quite possible that this will
never be done, as where Central Drive terminates at my
property line it runs directly into some elevations and
ravines which would make it almost impossible to build
a road without some very acute angles therein.

For the long haul, I expect that access to all of
this property will someday be most practical over the
right-of-way to the south of it, which is a continuation
of Ruth Road, another public road.of the Town of Southold.
The entire piece of property has been connected
since its creation by a 25 ft. strip (fee title) running
to Luther's Lane. This has been contained in the deeds
for many decades. I worked out a swap with Moisa and
Sledzieski whereby I proposed to abandon this 25 ft.
fee title strip in exchange for a 50 ft. right-of-way.
This matter is fairly complicated, and I would be
quite happy to show you all of the maps which I have in
my possession; but in summary, I can say that I believe
that the property which I now own has access by virtue
of having 50 ft. 0'n the southerly terminus on Linda Road,
plus 50 ft. on the westerly terminus of Central Drive,
plus the right-of-way across the southerly end of the
property.
As you are aware, this property has some very violent
grades, which would make the building of public roads
along the sound portion of the property economically, if
not physically~ impossible for the erection of two houses.
I trust that in view of the size of the acreage involved
and the number of houses involved, some arrangement can
be made whereby Messrs. Wills and Vreeland will be able
to build two homes on their acreage.

We have just purchased a building lot on the sound~ west of
the Captain Kidd Subdivision one lot removed from the end of Central
Brive~ Mattituck.
We plan on building in the near future~ the road to the lot
needs some improving. What steps are necessary to secure a building
permit ?
The lot has 100 ft frontage on the right of way and over
12~500 sq. ft area.

Dear ~. Terry,
We are enclosing a copy of a surve~ of two tracts of
land in the Mattituck Hills area on the Sound, adjoining
the Caotain Kidd Estates. We expect to take title to these
two pieces of land on March 16. The sale is contingent upon
our ability to construct two houses, one on each plot, in
conformity with the b ulldin~ and zoning ordinances.
The ~ooosed building areas for the two houses are
shaded in red. We have a copy of the building and zoning
code and will be able to comoly with total area ( over 12,500
square feet each) and with side and rear yard requirements.
Will you kindly advise ua if these properties, fronting
on the designated proposed right-of-way, extension of Central
~lve, will comply with the frontage requirements.
You will also note that the plots in the planned area
of construction are ao~oximately 80 feet in width, although
the plots are wider at other ~inta. We found no specifications
of plot width in the zoning code, am~ are presuming that
this is all right.
Your letter, indicating that dwellings can be built on
these two plots, is necessary for the execution of the sale
of them to us. Your prompt reply will be appreciated.

Your letler of March 6th & accompanying map received, I
have looked i+ over and as best I can make out the figures on the map
the two lots will run from the sound to the proposed road in a very
irregular shape and having a minimum of 100 ft frontage on said proposed
road and a minimum width of about 80 ft at the narrowest point9 and over
12,500 sq ~t of area.
TheSe lots as such would be usable for a one family dwelling on
each under our ordinance providing the side yards and setbacks comply.
However this proposed road as shown on the map has not been approved
by any act!on of the Planning Board or the Board of Appe~s for access to
these lots. This must be done before a building permit can be issued.
Where these lots are being taken from a large parcel of land it
is possible that the present owner should "file a map" for a subdivision
which would take care of the access, size of lots etc at one time.
In any event access will have to be approved before a building
permit can be issued, otherwise the lots are OK.
