The petition which he presents represents the. wishes of the
neighbors and friends.
The applicant's property is a corner lot. The house was constructed
prior to the enactment of the Ordinance. The front yard on Oak Street
is approximately 28 ft. 9 in. The applicant was denied permission to
reduce that front yard to 17 ft. The Ordinance requires 35 ft. front
(OVSR)

yard where no established setback exists. The lots located east of
the applicant's property are unimproved.
Ail of the roads in this area are Town roads 50 feet wide.
The applicant has not complied with the conditions and standards
set forth in the Ordinance for a special exception.
The action of the Board June 12, 1962 was taken after very
careful consideration and subjected to the highly critical examination
the Board's responsibilities imposed. The enclosed porch was erected
arbitrarily by the builder who is fully dognizant of the Ordinance
conditions and without seeking a building permit, and the plea that
it would be an added expense to place the porch elsewhere should not
affect the proper use of the land in question and the surrounding
properties and other properties in the same district.
Therefore it was RESOLVED that Mr. Raymond J. Slavin be denied
permission to reduce present setback from 26 ft. 6 in. to 15 ft.

On August 6th, I submitted to ~* Ho~.~rd Terry, Building Inspector,
an application for a buildtug permit to erect an enclcsed porch on a raised
patio, now ~isting, ~ud located fii~een (15') feet from the town line on
Oak Drive. In response ~'~. Terry issued a notice of d~sapprov~l date~ August
6th identified as File # Z 1843 with reason stated as "insufficient front y~rd
setback on corner lot, Article III Section 306
On the same day I filed an application for a h~aring. This application
set forth the following.
~ ) The existing structure, excluding the raised patio, ~s built and
completed in April 1956. This structure was b~lt by Mtdgely and Horton. It was
b~lt ~th the kitchen area located on Oak Drive. The purpose of the enclosed
porch is to provide a d~t~g area.
2) To erect a porch at the rear of the house, as permitted un,er
present zoning would require relocating water pump, ~ater tank, Hot water t~nk
and electrical equipment locate~ in the utility room as-well as Gas T~s
located on the east side of the utility room - all at considerable e~pense.
3) There currently exists on Broad~ters Drive(Belz property) am
emcloscd porch snd garage five(5)Feet (or less) from the to~n line and directly
opposite the home on the ~.~halen p~eperty, built muc$ earlier, about seventeen

sequently celled Broadwaters Cove. While this .map is
not 100% accurate, I believe it is reasonably accurate
and locations listed thereon can rea~tl~ be identified
by anyone familiar with the area. You ~ll note this
area contains only two roads running south from Bay Ave
and ~ roads running east fmom Hay~aters Drive. My
property is located on the last block running east which
in its national course would run into swamp and ~ater.
Except for B~y Ave, the entire area is surro~nded by
wat er.
The shaded area on the map indicated those owners who have
signed the petitions. Over 75% of the o%~rs have signed
the petitions also Mr Fox,to~n assessor, m~ neighbor to the
north has stated that he has no objections

on the southerly side where my b~drooms are located I could erect a porch there'.

~s built in 1956 I did not contemplate nor should X have been required to fozeeee

sides and a rear and I set up ~ home accordingly, the house itself is small
24' x 28' ~hlch lfmtts my R~t~g and kitchen area but at the time my housing

to do could be classified as a self imposed hardship but as my home was built two

As exhibit 'A' indicates Oak Drive runs easterly alongside my property to
a curve in the road which if runnLug a straight course would run into a s~mp,
the erection of an enclosed porch would not alter the character of the neighbor-
hood. Furthermore as pointed out above, the Belz property and the Whaten property
on B~oad~aters Drive have structures five feet and sevauteen feet f~om the twon
line ·

Mr k~fle Vibert is ~ediately east of Mr Czark, he has 75 ft. and Mr.C Horton

It has been stated in off the record hc~r~ugs that a variance of this ~-~d has
never ,~oen granted, in this respect I should like to ca]l the Boards attention
~o a rather large room that has been added to a corner house at 2nd Ave
Main St Ne~ Suffolk. This is within 15 ~t of the town line. Also there is
ne-~ home beLug erected on the North Rd in Cutchogue alongside another structure
that has not been set back 35 ~ although there is apparently no other houses
to establidh a.~lLue.
B~' it noted for the record, that this case arose out o~ a complaint. The com-
,kua~t in this case has never come forward to record his objections. He has not
appeared at a~ hearings nor has the Zoning Board requested him to do so.
There .are thereefore no objections nor objectors yet on 'the other side I
h~ve presented thirty five (35) owners signatures to a document which states
that ' the enclosed porch ..... is not unsightly, nor does it in our jud~7 .~nt
impair the surroundLug neighbors view nor is it a hazard ~$ health and safety~
and any number of these o~ers have offered to appear with me should the Board
feel their presence is necessary.
