THE SPECIAL EXCEPTION IS REQUESTED BECAUSE said subsection prohibits the reconstruction or alteration of a non-confOrming building to an extent exceeding in aggregate cost 50% of the fair value of the building unless same is changed to a conforming use. All of the children's camps in the Town of Southo1d are non- conforming. The owner of Camp Momoweta desires to replace two old cabins with a new larger cabin for use in connection with the operation of said camp. To do so, it is necessary that a special exception be obt.ined from the Zoning Board of Appeals of the Town of Southo1d. On two prior occasions similar relief has been sought and granted. Anril 26, 1962 Gentlemen : This letter is written to voice my opposition to the granting of a special exception for the pronerty known as Camp Momoweta, on Laurel Lake, Mattituck, N.Y. As a private citizen I object because, being an adjoining owner,I find the value of my nroperty adversely affected by the slowenly conditions surroun- ding this camp. As a member of the Town Planning Board I object because I do not consider the camp an asset from the standpoint of a desirable growth of the town. In my arguments I am guided nartly by the abstract letter of the ordinance and partly by the general recommendations for successful planning and zoning as set down in the latest editions of the"lIanual for local planning and zoning" and the "Zoning Guide" both of which\l.re official publications of the State of New York. ' We are dealing in this particular c~se with the nonconforming use of a property and the buildings thereon as a boys camp. Moreover, it is a case of absentee ownershiD, vhe owner and operator having his legal residence in the State of New Jersey. Actually the oroperty is occupied for a little more then three months only; for the remainder of the ye~r it is completely deserted. This condition invites the constant influx of strangers and the resultant commission of acts of vandalism. ,{orse, this also creates a conSiderable fire risk which not only could endanger the camp itself but also my own property, yes, even the very lives of my family. Moreover, the larglaccumulation of all sorts of trash on or about the premises constitutes a cons~er~ble health hazard. As far as I know there has never been a trash removal service engaged. Systematically trash of all descriptions, ( cans, bottles, eld bed frames, bed spr~n8s and mattresses by the dozen, toilet bowls, dismantled buildings etc etc ) have been dumped on the camp land itself but also mostly on the adjoining property. Protestations and complaints did not remedy the situation and even a personal visit by Supervisor Albertson did not lead to a correction of these abuses. Trash in large qunatities is still about, in obvious violation of the Town Urdinance against dumping, an open invitation to rats and si,milar vermin to invade the premises. All this falls into a clear and uniform pattern. The owner of this camp is only interested in one thing: To make as much money ot; the property as possible. He does not show the least concern for his neighbors. Neither has he any concern for the Town, its orderly growth or the preservation of its beauty ~nd according to his own statement he has none. He has expressed and manifested similar contempt for any regulation or ordinance that aims to govern the welfare of the Town. In supnort of this argument I submit that: 1) Up to last yearthis camp WaS operated without permit from the Town Board. 2) Several structural alterations and reconstructions, far in excess of the permitted 50% of fair value \ Article X, Sec. 1007, Subsec."e") have been made without the consent of the Board of Anneals. 3) No building permit was obtained as required by the ordinance. The N.Y.jtate Zoning Guide states: "...the courts have recognized that the chance for greater profit is no basis for a vari,nce under the hardship clause...." It states further : ..." These ( nonconforming;uaeve been given full rights in the ~ast to continue unchanged with limitations on their expansion or rebuilding...." ...The owner ;hould be given an ooportunity to recover his investment...." Since the buildings on this property with very few excentions had been acquired as second hand, most of them being former trl1\V structures and considering the length of time they have been utilized it must be assumed that the initial investment has long ago been amortized. A further. objection to the rebuilding of these structures is that it will increase the capac~ty of the camp beyond that which existed at the time the ordinance went into effect eso8cially since the total cubic anA square foctage of the reconstructed ) / 1/ J\\~t' Buildings is.~han that of the buildings that were replaced. The area under discussion is one of the most picturesque in the entire Township. Under the influence of, what looks like a private dump it is fast becoming a blighted one. I wish to voice I1\V o!,nosition to the granting of the requested special exception because : 1) As the adje,ining owner of a large tract cf land I See the value of I1\V pronerty endangered. 2 ) As a member of the Planning Board I object because it is my sincere conviction that the continuation of the nonconforming use of the property under nresent conditions is definitely not in the best interest of the fown.
