NAPPA, COUNCILWOMAN November 15, 2022 Regular Meeting 2 PUBLIC HEARING ' S LOCAL LAW CHAPTER 189 & 260 HORTON ' S . WHEREAS , there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 15th day of November, 2022 , a Local Law entitled "A Local Law in relation to an Amendment to Chapter 260 , Vehicles and Traffic, in connection with Parking on Duck Pond Road in the hamlet of Cutchogue " Now, therefore, be it RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at Southold Town Hall , 53095 Main Road, Southold, New York, on the 29th day of November, 2022 at 7 : 00 p .m. at which time all interested persons will be given an opportunity to be heard . The proposed Local Law entitled, "A Local Law in relation to an Amendment to Chapter 260 , Vehicles and Traffic, in connection with Parking on Duck Pond Road in the hamlet November 15, 2022 Regular Meeting 3 of Cutchogue . " SUPERVISOR SCOTT RUSSELL : I would invite anybody that would like to comment on this particular Local Law to please feel free? MR . JOHN BETCH : Good evening . John Betch, Southold . First, I would like to thank you for the Transportation Committee and addressing these issues down by the beach . I would just like to suggest a minor change to the wording . And it would be easier -- I just drew a little chart . It would be easier to understand it . Enforcement is important . And to do an enforcement when -- on the -- in the wording of the Local Law, you notice down at the bottom, it talks about North Sea Drive parking . If you look at the chart, North Sea Drive -- it says North Sea Drive at the entrance of McCabe ' s parking . North Sea Drive does not start until the end of McCabe ' s Beach . It ' s all Horton ' s Lane until we get to Lot 24 and Lot 1 on the opposite side of the November 15, 2022 Regular Meeting 4 street . It would be much simpler I think for people to understand and simply no parking prohibited on Horton ' s Lane east and south of the intersection of determinus North Sea Drive . If you look up on the Town ' s website, McCabe ' s Beach address is Horton ' s Lane . Not North Sea Drive . So I am just trying to be clear when they ' re trying to enforce COUNCILWOMAN JILL DOHERTY : So just on here, it says from Southold, from the exit of McCabe ' s Beach parking lot south westerly to the determinus of Horton ' s Lane . MR . JOHN BETCH : Right . McCabe ' s Beach or the entrance is in the middle . That is still Horton ' s . JUSTICE LOUISA EVANS : So the entrance and the exit are the same . COUNCILWOMAN JILL DOHERTY : So we should just take North Sea Drive out? MR . JOHN BETCH : I suggest, simply say determinus to Horton ' s Lane at the -- I would say the westerly end of November 15, 2022 Regular Meeting 5 McCabe ' s Beach and the beginning of North Sea Drive , if you will . I would make it much clearer to reinforce . MR . JOHN BURKE : We will look at it and amend it , if we need to . SUPERVISOR SCOTT RUSSELL : I will say, I actually worked with the Town Clerk, Denis and Deputy Town Clerk, Lynda Rudder to identify because there was a little bit of confusion there . So we did look at historic records and tried to determine where North Sea -- where it stopped and where North Sea started . From the early records , we did the best we could, based on the description and based on the Assessor ' s Records . MR . JOHN BETCH : The tax map is a little confusing the way it shows a jog in the road . Physically, there is nothing in the road there . It ' s just a continuos line . As part of this , when you do it -- as part of this law, that North Sea Drive should be corrected too . There is many missing signs down there November 15, 2022 Regular Meeting 6 further . I would also maybe suggest that the No Parking sig be put at -- right at the edge of people ' s property . It would be much more aesthetic than right in the middle of someone ' s house . COUNCILWOMAN JILL DOHERTY : We can pass that on to the Highway Superintendent . MR . JOHN BETCH : That is just a suggestion . Thank you . COUNCILWOMAN JILL DOHERTY : Thank you . SUPERVISOR SCOTT RUSSELL : Aye . * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * CHAPTER 245 SENIOR CITIZENS WHEREAS , there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 4th day of October, 2022 , a Local Law entitled "A Local Law in relation to Amendments to Chapter 245 , entitled Partial Exemption for Senior Citizens . " Now, therefore, be it RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at Southold Town Hall , 53095 Main Road, Southold, New York, on the 15th day of November, 2022 at 4 : 32 p .m. , at which time all interested persons will be given an opportunity to be heard . The proposed Local Law entitled, "A Local Law in relation to Amendments to Chapter 245 , entitled Partial Exemption for Senior Citizens . " SUPERVISOR SCOTT RUSSELL : Okay . November 15, 2022 Regular Meeting 8 For a quick clarification, this law actually exemptions for seniors in Southold Town . One is called the Enhanced Star Exemption . That is a State run program. I think everybody is familiar with it . This is what they call the aged exemption, which is a real property tax exemption . Just to bring it to a sliding scale exemption . We ' re actually raising to qualify from $37 , 500 up to $58 , 400 . New York State had given us permission to do that . Sliding scale . So the less you make from that, the more you see . " Now, therefore, be it RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at Southold Town Hall , 53095 Main Road, Southold, New York, on the 15th day of November, 2022 at 4 : 32 p .m. , at which time all interested persons will be given an opportunity to be heard . The proposed Local Law entitled, "A Local Law in relation to Amendments to Chapter 245 , entitled Exemption for Disabled Persons November 15, 2022 Regular Meeting 10 with Limited Income . " SUPERVISOR SCOTT RUSSELL : The Disability exemption . Similar to the Senior Exemption . Sliding scale based on income . So it ' s based on two criteria . One is you meet criteria for you to be considered legally disabled . And secondly, it is also an income component . So you have to make a certain amount of money to qualify . We raised the limit in this proposal from $29 , 000 to $ 58 , 400 . Anybody like to address the Town Board on this particular Local Law? (No Response ) . November 15, 2022 Regular Meeting 11 SUPERVISOR SCOTT RUSSELL : Aye . * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * PUBLIC COMMENTS SUPERVISOR SCOTT RUSSELL : Would anybody like to address the Town Board on any issue? MR . STEVE BUZAK : Supervisor Russell , Members of the Town Board . My name is Steve Buzak, 30 year Mattituck resident . I submitted a question to forward to you . It was on the Senior Citizen exemption . It indicates if you ' re a disabled veteran, that it could be computed in as a write-off . And it ' s been on there, I think, 20 years . New York State came out -- I checked, it was over 20 . So it really hasn ' t been looked at in many moons . Any Senior Citizen application that goes in, it ' s right in there . I am a Vietnam Veteran, disabled . And that is why I am here . SUPERVISOR SCOTT RUSSELL : That specific component has to be voted on . It ' s a separate Local Law . We haven ' t gotten the draft on the agenda yet, but November 15, 2022 Regular Meeting 12 they wouldn ' t have been able to apply it to your December tax bill anyway . MR . STEVE BUZAK : I understand that . SUPERVISOR SCOTT RUSSELL : That would have been before March . Certainly, your request to amend the code, to allow the Assessor ' s to deduct your disability income from your overall income calculation . MR . STEVE BUZAK : You guys have to vote on it though? SUPERVISOR SCOTT RUSSELL : Yes . MR . STEVE BUZAK : So it will probably be months or -- SUPERVISOR SCOTT RUSSELL : Hopefully, at least get it cleaned up and get the hearing going by January and then voted on . MR . STEVE BUZAK : The reason I came in because I saw you were doing the Senior Exemption . Thanks for your time . SUPERVISOR SCOTT RUSSELL : Sure . No problem.
