August 4'th, 1964 Zoning Board Town of Southold Suffolk County, New York Re: Application for variance of Christ Varnavas, as to Lot 114, in Mattituck, Town of Southold, Suffolk County, on Map of Captain Kidd Estates, Map # 1672, filed Jan. 19, 1949 in Suffolk County Clerk's Office. Gentlemen: My clients, Theofanis P.Kyvernitis, and Anastasia Kyvernitis, his wife, are the owners of Lots 116, 117, and 118 on the above Map. Their three lots are located on the Northerly side of Central Drive. Number 116 is improved by the erection of a dwelling which faces Central Drive, and whieh conforms to existing Zoning regulations, and which lot is 300 feet westerly from Luther Road. Lots l~~d 118 are va- ~. Each lot has a frontage on Central Drive of eet, and are f!l; eet in depth. '?O ~D Applicant's lot is located on the Northwest corner of Central Drive, and Luther Road, fronting 125 feet on Central Drive, and 80 feet on Luther Road. My clients advise that applicant plans to erect a dwelling fronting on Luther Road. On behalf of my clients, objection is hereby made to the application of Varnavas. Variances are granted only on a showing of hardship to the owner. The facts herein show unequivocally that there is no hardship at all to the owner. His plot is sizable enough. All he need do is build a residence faCing Central Drive in conformity to existing set- back regulations. Should the variance be granted, the uniformity of the block would be destroyed by the odd position of the proposed house; a bad precedent would be set for corner lots similarly situated; further it is believed &hat the value of Lots 117, and 118 would be depreciated, and that the value of their residence on Lot 116 would be lessened.
