GENERAL MEETING
June 17, 2003
7:30 P.M.
A Regular Meeting of the Southold Town Board was held Tuesday, June 17, 2003 at the Southold
Town Hall, Southold, New York. Supervisor Horton opened the meeting at 7:30 P.M. with the Pledge
of Allegiance to the Flag.

SUPERVISOR HORTON: Welcome to the public Town Board meeting. Please commence the
meeting and rise and join with me in the Pledge of Allegiance. Thank you. As for every Town Board
meeting that we have two spots on the agenda in which we encourage or allow the public to address
the Town Board. The first portion of that meeting will be prior to that reading of the resolutions that
are on the printed agenda. We will give the floor to members of the public that would care to address
the Town Board on those specific resolutions. At the conclusion of the voting on the resolutions, we
will again offer the floor to the public to address the Town Board on specific town issues that you
would like to convey to the Board. So moving forward, we do have reports, public notices, and
various pieces of communications that we received here in the Town on file for your perusal at the
Town Clerk's Office, available to you between the hours of 8:00 and 4:00, Monday through Friday.
So, with that being said, we will move forward with the scheduled meeting.

RESOLVED that the following Town bills be and hereby are ordered paid: General Fund Whole
Town bills in the amount of $205,847.53; General Fund Part Town bills in the amount of $32,090.21;
Highway Fund Whole Town bills in the amount of $16,728.16; Highway Fund Part Town bills in the
amount of $51,333.38; Capital Projects Account bills in the amount of $2,053.12; Landfill Cap &
Closure bills in the amount of $2,277.76; Community Preservation Fund (2% tax) bills in the amount

approved.

SUPERVISOR HORTON: Moving forward tonight, we do have one public hearing, I believe at 8:00,
if I am not mistaken. So we will move forward, offering the floor to the public to address the Town
Board on the resolutions that are on the printed agenda. Would anyone care to address the Board?
Mrs. Egan.
JOAN EGAN: I have quite a few. Good Evening, my name is Joan Egan and I reside in East Marion.
How is everyone tonight? Mr. Horton, Mr. Richter, Mr. Moore, Mr. Romanelli, Mrs. Evans and Mrs.
Neville and Mr. Yakaboski, don't speak when I am speaking. Okay, where do we want to go. On the
first page, with the reports, I am sure that Mr. Richter will get me a copy of the Southold Town Justice
reports, what was done in court during the month of May. Of course. You will do that for me, Mr.
Richter, please?
COUNCILMAN RICHTER: No, ma'am.
SUPERVISOR HORTON: Mrs. Egan, those are available at the Town Clerk's office between 8:00
and 4:00.
MRS. EGAN: All righty, that is fine. Now, #355, what is this I don't quite understand what you want
to do here. An agreement with the North Fork Housing Alliance for the 2003 Community Block
Grant-Housing Counseling Program. What is that all about?
SUPERVISOR HORTON: Portions of our Community Block Grant that we receive from the Federal
Government through the County, we allocate to the North Fork Housing Alliance and they carry out
various housing programs, some of it goes toward facilitating affordable housing, creating affordable
housing, I believe that this program is specifically educating first time home buyers on what
opportunities are there for applying for a mortgage and what interest rates that you should expect to
see.
MRS. EGAN: Well, isn't that usually done by the people who give a mortgage? I mean, I don't know
that we have all this paperwork. All right, now these child day care centers, who are they available,
that is #356. Who is entitled to use those and what are the charges and of course, you have plenty of
insurance on those, I am sure.

SUPERVISOR HORTON: That is 356, that would be the Robert Perry Child Day Care Center, which
is located in Greenport and that is child daycare facility serving low and middle-income families, for
anybody who would need that...
MRS. EGAN: And we provide funding for that?
SUPERVISOR HORTON: .... any people that would meet that criteria in Southold Town.
MRS. EGAN: Who reviews that? Their qualifications?
SUPERVISOR HORTON: That would be done through the Community Development Office, in
conjunction with the daycare center that runs it.
MRS. EGAN: And where is it located?
The Robert Perry Day Care Center?
SUPERVISOR HORTON:
MRS. EGAN: Yeah.
SUPERVISOR HORTON:
That is in Greenport.
MRS. EGAN: I got that the first time. Where is it located?
SUPERVISOR HORTON: That is on Third Street near the AME Zion Church. The African Methodist
Episcopal Church.
MRS. EGAN: Now, on #360 and #372, appoint Christa Grant a part-time intern to the Supervisor's
office and then we funds for that, correct? That is addressed on #372. And who is she, and how was
she appointed? And what are her qualifications?
SUPERVISOR HORTON: Her name is Christa Grant, she is a high school student from a local high
school, she worked with us last summer, she did a fantastic job and we are excited to have her back.
MRS. EGAN: Uh huh and what will she do?
SUPERVISOR HORTON: She will do a multitude of tasks, working in most departments in Town
Hall.
MRS. EGAN: In Town Hall?
SUPERVISOR HORTON: That is correct.
MRS. EGAN: And she is now a, ! guess she was a junior last year and she is a senior this year?
SUPERVISOR HORTON: ! don't know if she is going into the junior, 11th grade or 12th grad this
year. She is a high school student.

MRS. EGAN: Mmmhmm.
Yakaboski has disappeared.
COUNCILMAN ROMANELLI: That is an attorney ....
MRS. EGAN: ! am speaking to Mr. Horton.
Now, here we go again with another attorney on #364 and of course, Mr.
SUPERVISOR HORTON: ! didn't hear the question, Mrs. Egan.
MRS. EGAN: Well, ! wanted to know about another attorney being appointed here. We seem to have
these musical chairs of attorneys ....
SUPERVISOR HORTON: We actually...
MRS. EGAN: .... and as ! said, Mr. Yakaboski has disappeared.
SUPERERVISOR HORTON: Mrs. Egan, to address #364, we actually hired her at the last Town
Board meeting and what this is, is a formality that we are required to do as a Special Assistant District
Attorney, which enables her to work within our Justice Court.
MRS. EGAN: And ! think that we did review some of her qualifications, even though ! didn't think
that they were up to snuff but that is your problem. Okay, #366. Who is Joseph Gold and what is
Advisory, ! thought that we had Mr. Richter as the liaison officer to the Police Department?
SUPERVISOR HORTON: Mr. Gold was a member of the Police Advisory Committee and
Councilman Richter is the Town Board liaison to that Committee.
MRS. EGAN: So...
SUPERVISOR HORTON: And Mr. Gold is resigning.
MRS. EGAN: And who will take his place?
SUPERVISOR HORTON: If you would read on in this, we will be...
MRS. EGAN: No, ! don't think that you have a point yet. ! think that it never will be asking, running
an ad.
SUPERVISOR HORTON: Mrs. Egan. We will advertise; we will solicit resumes from the
community to fill that vacancy on that Committee.
MRS. EGAN: Yeah, so more money being spent, right?
SUPERVISOR HORTON: No, it is a volunteer committee.
MRS. EGAN: Okay, let's see..

SUPERVISOR HORTON: Mrs. Egan, let's get that straight. That is a volunteer committee ....
MRS. EGAN: Last page, we are almost there, we are almost there, isn't this marvelous, now, ! think
this is a little mistake typographical or what reprint, you have Detective Beth Dzenkowski...
SUPERVISOR HORTON: What number?
MRS. EGAN: Oh, ! am sorry, #375, you have her again, you have her at #375 and #379 and #379 is a
done deed. Somebody should have crossed that out and eliminated it. ! would like to publicly
commend Detective Beth Dzenkowski, she is one of the finest police ladies, we have a couple of there,
but in her capacity with the young people, she does a really great input, she goes out of her way to help
the children, the parents, you give her even any indication that there is even the slightest problem,
which gets somebody likes myself who checks these children out rather than having to call the Child
Protection Agency, she gets it at ground level and ! would like that written into the minutes and ! think
Mr. Horton, it would be very nice if you sent her a letter telling her that she was publicly commended
for her excellent work with the youth of all of our area.
SUPERVISOR HORTON: Mrs. Egan, what ! will do, is to encourage her tomorrow when ! see her, to
watch the Town Board meeting on Friday night. ! will certainly do that and ! will let her know that
you spoke highly of her; she will be appreciative of that.
MRS. EGAN: And ! think it would be an even nicer idea, in the fall, to have her here when you have
some Boy Scouts or young people so that she can get her picture and everybody know what a great
person she is.
SUPERVISOR HORTON: Thank you. She is a tremendous asset to the youth of this Community.
MRS. EGAN: Yes, she is.
COUNCILMAN MOORE: Should we send her out for additional training when the opportunities
arise?
MRS. EGAN: Oh, absolutely. This is the second time we have done it.
COUNCILMAN MOORE: Okay.
MRS. EGAN: You should read these things...
COUNCILMAN MOORE: Oh, ! do, Mrs. Egan. ! just thought that we would make sure...
MRS. EGAN: I know but your head is falling off again, so maybe that is the problem.
COUNCILMAN MOORE: Yes, it is. ! am so glad that ! have a hand to hold it.
MRS. EGAN: #383. Now, these waiving of the 30 days for liquor licenses, you know how ! feel
about that. Why does he need it and what are your thoughts on it, Mr. Horton?

SUPERVISOR HORTON: It is an existing restaurant. A restaurant that has operated for generations,
so ! don't ...
MRS. EGAN: So what is the problem?
SUPERVISOR HORTON: It is coming under new ownership and procedurally that owner is required
to switch the license into their name. And ! don't see any reason to stand in the way of that business
that has been ongoing in that community.
MRS. EGAN: Well, not so quick.
SUPERVISOR HORTON: Mrs. Egan, please.
MRS. EGAN: Have we, who has reviewed the person who is taking it over? Are they qualified, !
mean are they going to assimilate themselves well into our community or are we just taking a blanket
thing because the former owner had a liquor license and now somebody else is taking it over?
SUPERVISOR HORTON: The State Authority on the liquor license will do their review of the
issuance of that.
MRS. EGAN: And we just accept that?
SUPERVISOR HORTON: Yes.
MRS. EGAN: We don't check it out ourselves with all the crime and accidents ....
COUNCILMAN MOORE: It is not our jurisdiction.
MRS. EGAN: ... speeding. We don't check it out ourselves. Does our local Police Department check
it? Mr. Richter will find that out for me.
SUPERVISOR HORTON: Mrs. Egan, that is not within our jurisdiction.
MRS. EGAN: Then why do you have to, then why are you involved in with the waiver?
SUPERVISOR HORTON: Mrs. Egan, are you speaking against this resolution?
MRS. EGAN: Yes.
SUPERVISOR HORTON: Okay. That is noted.
MRS. EGAN: Good, ! will talk to you later.
SUPERVISOR HORTON: Thank you. Would anyone else care to address the Town Board on the
printed agenda, the resolutions?

and I wanted to speak on that. Should I wait until you open the hearing?
SUPERVISOR HORTON: Yes.
MRS. DUFFY: Okay, I didn't know ifI would have an opportunity.
SUPERVISOR HORTON: Would anyone else care to address the Board on the printed resolutions?
(No response) If there is nothing further, we will continue with the resolutions.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Joshua Y. Horton to execute an Agreement between the Town of Southold and the
North Fork Housing Alliance for the 2003 Community Development Block Grant - Housing
Counseling Program, subject to the approval of the Town Attorney.

Moved by Councilman Wickham, seconded by Justice Evans, it was
RESOLVED that the Town Board of the Town of Southold hereby grants permission to Chief
Carlisle Cochran to attend the NYS Association of Chiefs of Police 2003 Annual Training
Conference commencing on Sunday, August 24 through Thursday, August 28, 2003, at the Hilton
Lake Placid Resort, Lake Placid, New York. Registration fee for this conference will be $150.00.
Travel will be by Town vehicle. Hotel accommodations will be for five (5) nights for a total of
$695.00. Additional costs will be for meals together with tolls and miscellaneous out of pocket
expenses. All expenses will be a legal charge to the Police Department Training Budget line -
A.3120.4.600.200.

RESOLVED that the Town Board of the Town of Southold hereby appoints Christa Grant to the
position of part-time Student Intern I in the Southold Town Supervisor's Office at a salary of
$9.54 per hour, beginning June 30 working half days during the months of July and August.

RESOLVED that the Town Board of the Town of Southold hereby appoints Brendan McGinley to
the position of part-time seasonal Deckhand for the Fishers Island Ferry District effective June 5,
2003, at a rate of $8.66 per hour.

Supervisor Joshua Y. Horton to execute an Amendment for Services Contract #5968 for the
Cutchogue Downtown Revitalization Program, extending the contract until July 1, 2004, subject to

RESOLVED that the Town Board of the Town of Southold hereby requests Suffolk County District
Attorney Thomas Spota to designate Southold Assistant Town Attorney Lori Hulse Montesfusco~
as Special Assistant District Attorne¥~ for the purpose of prosecuting violators of the Codes of the
Town of Southold.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Joshua Y. Horton to execute the modification of Agreement # C006157 - Southold
Erosion Mitigation Proiect. This modification includes a request for a deadline Extension to March
31, 2004 and an amendment to the Program Work Plan outlined in Appendix "D" of the agreement.

Moved by Councilman Moore, seconded by Councilman Romanelli, it was
RESOLVED that the Town Board of the Town of Southold hereby accepts the resignation of Joseph
M Gold from his position as a member of the Southold Town Police Advisory Committee
effective immediately, be it further
RESOLVED that the Town Clerk be authorized and directed to advertise for the vacant position.
COUNCILMAN RICHTER: I would just like to say that Joe was a good member on the Police
Advisory Committee and his input and his thoughts were much appreciated over the time he spent on
there.

New York, on the 3rd day of June 2003 a Local Law entitled "Amendment to Town Code Regarding
Amendments to Zoning and Public Hearing Notice Requirements" and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid Local
Law at which time all interested persons will be given an opportunity to be heard.
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the following Local
Law:

TOWN OF SOUTHOLD
A local law entitled, "Amendment to Town Code Regarding Amendments to Zoning and Public
Hearing Notice Requirements."
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose. To clarify procedural requirements in the Zoning and Public Hearing chapters of the
Town Code.
II. The Code of the Town of Southold is hereby amended to revise the noted sections of Chapter 100
"Zoning" and Chapter 58 "Notice of Public Hearing" to read as follows:
Chapter 100 ARTICLE XXIX Amendments
[Amended 5-30-1975 by L.L. No. 3-1975; 11-15-1983 by L.L. No. 13-1983; 1-8-1985 by L.L. No. 1-
1985; 1-10-1989 by L.L. No. 1-1989]
§ 100-290. Procedures.
The Town Board, upon its own motion or by petition, may, from time to time, amend,
supplement, change, or modify ~ this chapter, including the Zoning Map, by proceeding in the
.......... ~ manner provided in this Article. For the purposes of this Article, an amendment also
includes, but is not necessarily limited to, a supplement, change, or modification.
A. The Town Board, by resolution adopted at a stated meeting, shall fix the time and
place of a public hearing on the proposed amendment and cause notice thereof to
be given pursuant to the provisions of the Town Law. At least ten (10) days
notice of the time and place of such hearing shall be published in the official
newspaper.

B. The Town Board, before ~ publishing notice for a public hearing, shall
in a written request, instruct the Town Planning Board to prepare an official report

Town Board or other Town agency, shall also be subject to the additional

§ 100-291. Fees for Petitions for Proposed Amendments. ]Amended 11-13-1990 by L.L. No. 26-

Every petition for ~ a__n amendment to this chapter or the Zoning Map shall be filed
with the Town Clerk and shall be accompanied by a fee,~.~c~,~..,~ .~..,~ ...... ~ o,~..,~ ~..~.~ ~, ~oo ~r~,., ~ ~ ~. J~ for
administrative processing as established by a resolution of the Town Board. The fee for a petition for a
change of zone to the ~ordable Housing District is set fo~h in ~ 100-55B(5)(g). The petitioner shall
also be responsible for reasonable and customa~ professional review fees relating to environmental
review of the petition.
~ 100-292. Additional Notice Requirements Relating to Petitions for Proposed ~endments. of
A. In the case of a petition requesting an amendment~ ~ ~..~..~ ~ .... in zoning district
classification or the Zoning Map, in addition to the notice required by law, a
written notice containing the following information shall be sent by the petitioner,
or his agent, by either ce~ified or registered mail, to eve~ owner of prope~y
immediately adjacent thereto. In the event that any petitioner owns or has any
interest in any prope~y immediately adjacent to the prope~y proposed to be
changed in zoning district classification, then written notice shall also be given to
the owners of the prope~y adjacent to such other prope~y of the petitioner. For
the purpose of this section, the words "owner" or "prope~y owner" mean the
owner as shown on the current Southold Town assessment roll. The notice
required by this section shall be mailed by the petitioner, or his/her agent, within
five (5) days preceding the filing of the petition in the Town Clerk's office. Proof
of mailing of such notice in the form of a sworn statement sworn to by petitioner
or his/her agent shall be filed with the Town Clerk at the time of filing the
petition. Such notice shall contain the following information:
(1) A statement that the petitioner proposes to file a petition with the Southold
Town Clerk requesting a change of zone classification.
(2) A description of the street location and the area of the prope~y which is the
subject of such petition.
(3) The present zone district classification of the prope~y and the proposed zone
district classification.
(4) A statement that within five (5) days of the notice the petition requesting such
change in zone district classification will be filed in the Southold Town Clerk's
office, Main Road, Southold, New York, and may then be examined during
regular office hours.
(5) A statement that a public hearing with respect to such petition must be held by
the Southold Town Board before such change of zone can become effective; that
the person to whom the notice is addressed, or his representative, has the right to

appear and be heard at such hearing; and that a notice of such hearing will be
published in the official town newspaper not less than ten (10) days prior to such
public hearing.
In lieu of complying with the provisions of this section, written verified waivers
of notice executed by the persons entitled to receive such notice may be filed with
the Town Clerk at the time of filing the petition.
Failure to comply with the provisions of this section shall not affect the validity of
any action with respect to such petition.
In addition to the above notice requirement, prior to holding a public hearing on
the ~ petition, notice shall be provided pursuant to Chapter 58. [Added 12-

Whenever the Code calls for a public hearing this section shall apply. Upon determining that an
application or petition is complete, the board or commission reviewing the same shall fix a time and

by the town, which shall be prominently displayed on the premises facing each
public or private street which the property involved in the application or petition
abuts, giving notice of the application or petition, the nature of the approval
sought thereby and the time and place of the public hearing thereon. The sign
shall be set back not more than ten (10) feet from the property line. The sign
shall be displayed for a period of not less than seven (7) days immediately
preceding the date of the public hearing. The applicant, petitioner or his/her
agent shall file an affidavit that s/he has complied with this provision prior to
commencement of the public hearing.
C~. (2D gy~erui~ng4The applicant or petitioner is required to send notice to the owners
of record of every property which abuts and every property which is across from
any public or private street from the property included in the application or
petition. Such notice shall be made by certified mail, return receipt requested,
posted at least seven (7) days prior to the date of the initial public hearing on the
application or petition and addressed to the owners at the addresses listed for
them on the local assessment roll. The notice shall include description of the
street location and area of the subject property, nature of relief or approval

involved, and date, time and place of hearing. The applicant, petitioner or agent
shall file an affidavit that s/he has complied with this provision prior to
commencement of the public hearing.
III. Severability.
If any part or provision of this Local Law or the application thereof to any person or
circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be
confined in its operation to the part or provision or application directly involved in the controversy in
which such judgment shall have been rendered and shall not affect or impair the validity of the
remainder of this Local Law or the application thereof to other persons or circumstances, and the Town
of Southold hereby declares that it would have passed this Local Law or the remainder thereof had
such invalid application or invalid provision been apparent.
IV. Effective date.
This law shall take effect immediately upon filing in the Office of the Secretary of State of
New York.

MRS. EGAN: Yes, the President of the United States of America had a press conference this morning
and before the conference; it was noted that even though election time is coming up, he still is doing
business, he is not politicking. And ! think that people sitting on the Board up there know what !
mean. Too much politicking going on and no results. Mr. Romanelli, how are you doing with the
Department of Transportation in regard violations of dirt and filth on the road, causing accidents?
Have you had any success whatsoever? Have you been able to contact Mr. Harris and see that he gets
his secretary to help him?
COUNCILMAN ROMANELLI: Mr. Harris is under control, he is running his office as his expertise,
that is what he was elected to do. ! think that the Highway Department is doing a fine job.
MRS. EGAN: But nothing is happening. I didn't say that he wasn't, did I? I said the roads, where the
runoff of dirt, when it is dry; it is dry and it is skidding and when it is wet it is even worse. Mr. Harris
informed me that he did not have enough time, with the clean up of the spring thing, which was
messed up because it wasn't done properly, which was not his fault, it emulated from up here. So, has
Mr. Harris received any assistance from Town Hall to see that the roads are being better taken care of
and Mr. Yakaboski ....
COUNCILMAN ROMANELLI: Mr. Harris has asked for no additional help to handle his work load.

MRS. EGAN: ! am not speaking to you; ! am speaking to Mr. Romanelli. Mr. Romanelli, you said
that you would address the noise control. Have you had even a tiny, little, little, tiny meeting in that
regard? And the answer...
COUNCILMAN ROMANELLI: No.
MRS. EGAN: No. Great. So you are all up there campaigning, you will be in office what? Almost
two years and there has been no integrity, nothing accomplished and you are all sitting there thinking
that this is amusing. You are all doing something, your own agendas, it is an absolute disgrace.
SUPERVISOR HORTON: Mrs. Egan.
MRS. EGAN: I am not finished.
SUPERVISOR HORTON: Do you have town business you would like to address?
MRS. EGAN: Of course, this is all town business.
SUPERVISOR HORTON: Please continue.
MRS. EGAN: I don't do anything other than town business. Now, I am sure that at least once a
month, you have the opportunity to read in our local newspapers, the police reports. And they are
getting longer and they are getting more serious and more serious. ! was very pleased to note that, !
am sure that it was from you Mr. Horton, that we have more of the summer brown police, you know
the Auxiliary Police, if you will. You need more, you need more. By the grace of god, because we
had such terrible weather during the carnivals there weren't as many indecent exposures, horrible
things done to young girls and young boys. Had the weather been better and more young people had
been there, there would have been more. But we are going to have a lot of visitors here, so ! would
request that instead of some of this money being spent, what ! consider myself consider, foolishly, that
money be spent to get even more of these Auxiliary policemen to protect our people. And Mr. Horton?
SUPERVISOR HORTON: Yes, Mrs. Egan.
MRS. EGAN: You, yourself. I was very pleased to see that you did send somebody to court, not last
Friday but the Friday before, you yourself have to sit on your you-know-what and review it yourself.

DON WAGNER: Good evening, I am Don Wagner, Route 48 in Southold. Sunday, I tried to make a
left turn out of my condo onto Route 48 and I guess, the ferry traffic was coming east and there was an
awful lot of traffic coming west, too. So it was bumper to bumper, if you will, and it took me five
minutes before I could safely make a turn out of the driveway. You have heard me mention before,
one particular item, which would help all of us on Route 48 and Route 25 all the way from Orient
Point to Mattituck in the west...
SUPERVISOR HORTON: Can I just, something that you and I discussed some time ago, I don't know
if I am cutting you off at the pass but I did want to bring this to your attention.
MR. WAGNER: No.
SUPERVISOR HORTON: I have actually, recently, again discussed with our Assemblywoman
Acampora, about having the Department of Transportation and I followed this up with a letter again,
for the Department of Transportation to install a light just as you would exit the ferry onto Route 48 to
put significant or substantial, meaningful breaks in the traffic that is westbound. That is something that
we had discussed and I wanted to give you a quick update on it.
MR. WAGNER: That would help, true, but I think what would help even more and it wouldn't cost us
anything here is Southold or Riverhead, is if we got together with the Town of Riverhead and jointly
went to the Town of Brookhaven and got them to agree to allow the ferry going to New London for all
the gamblers from west Suffolk and east Nassau, they would no longer have to drive all the way to
Orient Point, they could stop at William Floyd Parkway there in the Town of Brookhaven and it would
eliminate half of our problem which we are into now in the season here. Not only in the whole Town
of Southold but the whole Town of Riverhead, as well. And I think that this should be pursued to the
utmost. The SEEDS group, which is studying the entire East End of Long Island, if they are lucky,
they might have some proposals ready by the end of the year, if they are lucky. But then it is going to
be up to the Towns and or the County where as the chips may fall as to when something is going to be
accomplished. Whereas, if we could get the green light to move the ferry, not all the ferries
necessarily, but some of them, this would alleviate the condition at no expense to us. So I would like
to see the entire Board pursue this and I think that anyone that lives on either Route 48 or Route 25 in
the Town of Southold should be in favor of this.
SUPERVISOR HORTON: We have reached out to Supervisor Kozakiewicz as well as Supervisor
Heaney from Southampton, who I think has a vested interest in relieving the ferry traffic that is bound
from the North Fork to the South Fork and a couple of different tacks that we have taken, is we really
need the support on this issue from our State Representatives. I know that Assemblywoman Acampora
is 100% behind us on this and we also have to work to get Senator Ken La Valle, who is very open-
minded to progress, on board with this issue and these have been ongoing discussions and as well, not
only for a boat from perhaps the Shoreham site but into the Promised Land, East Hampton. On the
same note, I know that Supervisor Kozakiewicz and myself have had discussions about lobbying the
State or the County for a piece of property just off of the, just off the end of the eastern portion of the
Long Island Expressway to provide a parking facility for those who are bound for the Fast Ray, at least
so there could be a shuttle arrangement made at that point, at least in the near future as part of the long
term solution, where at the end of the day we do need the support of the State, that is the foundation,

that is the bottom line for what we need. And I know that members of the Board also support that and
the proper officials have been contacted on numerous occasions.
MR. WAGNER: But that is not easy to get and I doubt if you will get anything this year.
COUNCILMAN MOORE: I am going to add two cents in there and that is, at least four years ago, I
sat with the then Town Supervisor of Brookhaven and our Town Supervisor and they were all on
board, Long Island Association was on board of putting a ferry at, as you describe it, the Shoreham
facility and you are going to have to turn the heads of our two State Representatives, both Pat and Ken
vehemently opposed locating one there. So you will have to turn their heads on that one.
MR. WAGNER: Oh, boy. Now you got me scratching my head. Okay, well thanks very much.
SUPERVISOR HORTON: At the Strawberry Festival this Saturday, that conversation came up again
with Assemblywoman Acampora.
COUNCILMAN MOORE: Well, maybe she had a change of heart. That would be nice. This
correspondence said that she didn't want to do that.
SUPERVISOR HORTON: It is constant persistence on our State officials because our hands are tied
without there support. Would anyone else care to address the Town Board on town related issues?

COUNCILMAN WICKHAM: I would like to make a very brief comment, if I could.
SUPERVISOR HORTON: Certainly, Councilman Wickham.
COUNCILMAN WICKHAM: The Supervisor asked me to be the liaison to the Land Preservation
Committee some time ago and I sit in on those meetings, they are very lengthy and do a lot of business
and today our Land Preservation Coordinator appeared before the Board ....
COUNCILMAN MOORE: In Executive session.
COUNCILMAN WICKHAM: ...and outlined a number of acquisitions which she thinks are on the
books, which will total and I think that it is perfectly appropriate to bring to the public a summary of
what happened and what has happened on this Committee. I am not going to divulge any technical...
COUNCILMAN MOORE: Tom, you have chosen to talk about matters discussed in Executive
Session today, I don't think that is appropriate. I think you wait two weeks or four weeks and we will
all talk about it.
COUNCILMAN WICKHAM: I am going to inform the public that there is a great deal of activity out
there in the Land Preservation field, that there are contracts virtually signed, that there is a great deal of

activity; over 100 acres of land that is virtually preserved indefinitely with a great deal of interest and
acceleration of the program and I think that the public has every right to know about that.
SUPERVISOR HORTON: Thank you, Councilman Wickham. With that being said, that does
conclude our meeting. Thank you for attending this meeting. We appreciate your input and we
appreciate you attending these meetings.
