SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated July 19,2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTSMESCRIPTION: The subject property is a 13,469 square foot nonconforming parcel in the R- 80 Zoning District. The northerly property line measures 85.00 feet and the easterly property line measures 172.94 feet Calc (173.00 Deed), the southerly property line measures 107.94 Calc (108.00 Deed) and is adjacent to Main Bayview Road, the westerly property line measures 129.00 feet. The parcel is improved with a two-story frame dwelling with a wood trellis over a slate patio to the east of the dwelling with a fish pond to the north of the trellis, a 16.4 ft. by 10.4 ft, wood frame storage building located at the rear of the dwelling, a 16 ft. by 32 ft. inground swimming pool to the south of the storage building with a 18.5 ft. x 18.5 ft frame pool house located west of the swimming pool. There is also a hot tub located between the pool house and the swimming pool on a slate patio 8.3 ft. by 8.7 ft frame shed located on the southeast corner of the parcel as shown on the survey map prepared by Jeffrey W. Haderer, LS, and last revised April 26, 2022. BASIS OF APPLICATION: Request for Variances from Article III, Sections 280-15; Article XXIII, Section 280- 124;and the Building Inspector's May 2,2022 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling and to legalize "as built" accessory structures (trellis and shed), at; 1) located less than the code required minimum front yard setback of 35 feet; 2)both trellis and shed located in other than the code permitted rear yard; located at 2740 Main Bayview Road, Southold,NY. SCTM#1000- 75-4-21. RELIEF REQUESTED: The applicant requests variances to construct additions and alterations to an existing single- family dwelling and to legalize "as built" accessory structures (trellis and 8.3 ft. by 8.7 ft. shed. The proposed Page 2,November 17,2022 #7696, Homer SCTM No. 1000-75-4-21 construction,is not permitted pursuant to Article XXIII Section 280-124 which states;lots measuring less than 20,000 square feet in total size require a front yard setback of 35 feet. The survey shows construction at set back 27.6 feet from the front yard property line. In addition,the"as built" accessory trellis and shed are not permitted pursuant to Article III, Section 280-15, which states accessory building and structures shall be located in in the required rear yard. The accessory structures are located in the side yard. The Site Plan drawings prepared by Brendan M.Maloney, Architect and dated June 20,2022 showing the plans to extend the existing covered porch on the eastern and southern portion of the dwelling with a small addition on that same side along with a second-story addition to the second floor which includes an addition over the first-floor mud room to add a bathroom off the existing second-floor bedroom as only a master bath currently exists. ADDITIONAL INFORMATION: The applicant's residence is cited on the subject parcel so as to not impact any neighboring properties which are primarily vacant land and farmland. The trellis and the shed existed before the applicant purchased the property.There is no garage on the property. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 3,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(Y). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties.The property is heavily screened by mature landscaping in the front yard and along the side property lines and both the shed and the trellis cannot be seen from the road or adjacent properties. Many of the homes in this community also have front porches and front yard setbacks that do not meet the code as they were built before zoning codes were in effect. The applicant does not have a garage and wishes to keep the small shed for storage. The trellis and the shed existed before the applicant purchased the home and the applicant would like to legalize and keep them in their current functional locations. s. Side yard sheds are not uncommon in the area. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing residence on the subject property is already non-conforming so any addition will need variance relief. The shed and trellis were built by a previous owner in a non-conforming side yard so legalizing them in their current as built location will require variance relief. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code for the shed and the trellis. However,the shed and the trellis are small accessory structures that have no visual or environmental impact on any adjacent property, the street or the character of the neighborhood. The proposed wrap around front porch addition to the single-family dwelling represents 21.14%relief from the code. However,the proposed front porch is an extension of a smaller existing front porch and will maintain the pre-existing non-conforming front yard setback 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and there are no wetlands or other naturally regulated features on the property. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the requested additions to the first-floor porch extension and second story addition along with legalizing the existing trellis and shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Weisman, and duly carried, to GRANT the variances as applied for, and shown on the survey map prepared by Jeffrey W. Haderer, LS, and last revised April 26, 2022 and the site plan and architectural drawings prepared by Brendan M Maloney,Architect, and dated June 20, 2022. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The first floor covered front porch shall remain unenclosed and non-habitable space. 2. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s)within 30 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 3. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of occupancy in the time allotted. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The proposed additions are as follows: 1. A 17 sq ft first-floor addition to the front of the house. 2. A 105 sq ft front porch extension; the porch addition dimensions are 17.11 x 4.2 ft and 10.3 x 4.6 ft, which would result in the construction of a wrap-around porch at the southeastern corner of the dwelling. 3. A 70 sq ft second-floor addition above existing first floor mud room adjacent to porch; addition will add a bathroom offon an existing second-floor bedroom as only a master bathroom exits on the second floor. In the narrative that follows, all of the proposed changes and improvements appear on the site plan prepared by Draft Design Architecture and Interiors, reissued April 15 2021. STATEMENT OF FACTS The subject non-conforming 13,469 sq. ft. lot is in the R-80 District. The owners purchased property on October 1, 2013; a copy of the deed is attached as Exhibit"A." Improvements on the subject parcel are covered by the following Certificates of Occupancy, copies of which are attached as Exhibit`B." 1. Certificate of Occupancy, dated September 11, 1957; 2. Certificate of Occupancy, dated March 24, 1994; 3. Certificate of Occupancy, dated November 17, 2009; 4. Certificate of Occupancy, dated October 18, 2013, for in-ground pool; 5. Photographs of the existing structures and areas of proposed addition are attached as Exhibit"C." RELIEF REQUESTED We request relief as follows: 1. In regards to the 35-foot front yard setback requirement,per Town Code Section 280-124, a variance of 7.4 feet is needed, as the proposed addition is 27.6 feet from the front yard. All additions are occurring to the front of the house and the southerly side of the house. The existing house is 32.7 feet from the front yard properly line. 2. Additionally,the"as built" 8.3 ft X 8.7 ft wood shed and the 9 ft x 9 ft open air wood trellis sit within the 10 foot side-yard setback requirement per Town Code Section 280-124; we request relief of 4.5 feet and 4.9 feet,respectively and legalization of these "as built" structures. The wood frame shed is currently located 5.5. ft from the side yard and the wooden trellis is located 5.1 feet from the side yard. 3. Relief is also needed as the "as built" accessory trellis and shed are located in the side yard and pursuant to Article III Section 280-15, are within the side yard. STANDARDS FOR THE GRANT OF AREA VARIANCES Pursuant to Town Law Section 267-b,the Zoning Board of Appeals is required to take into consideration the following factors when weighing the benefit to the applicant if the variance is granted against the detriment to the health, safety, and welfare of the neighborhood and community: a) Whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; b) Whether the benefits sought by the applicant can be achieved by some method feasible for the applicant to pursue other than an area variance; c) Whether the requested area variance is substantial; 0 * r d) Whether the grant of the variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; e) Whether the difficulty causing the applicant to reque[eiO@WWth*Avp.LYs:ark�ff vas self-created which consideration shall be relevant tomina ion oftheBoard but shall not necessarily preclude the grant of .28 2022The criteria for consideration of the required variances as discus to this application are addressed as follows: a) There is no undesirable change in the Character of the Neighborhood and detriment to nearby properties (Town Law 4 267-b (3)(b)(1)). The addition is needed for a bathroom on the second floor as only a master bathroom exists in this three bedroom home. A mere 71 sq. ft. first floor addition is to relocate the existing bathroom near the mudroom so that the kitchen can be enlarged for better usage and functionality. A first-floor extension of the covered porch will reach no further into the front yard setback than the existing front porch. These additions are minimal in nature and will not affect the overall character of the neighborhood. The as built accessory structures, specifically the 9 ft x 9 ft trellis, at 81 sq ft of coverage, and the 8.3 ft x 8.7 ft shed, at approximately 72 feet of coverage, will similarly not have any adverse effect. The property is heavily screened and fenced,preventing any adverse impact to neighbors. A trellis and shed are common accessory structures throughout Southold. b) The benefit cannot be achieved by some other method feasible for the applicant to pursue other than area variances (Town Law 4 267-b (3)(b)(2)). As noted,the property is non-conforming to current R-80 zoning and any improvements to the front of the existing house would likely require variance relief. The existing house is 32.7 ft from the front yard setback and the covered wood plat walk is 28.4 feet from the front yard setback. The proposed front porch extension is 27.6 feet from the front yard setback and is not substantial. Variance relief of 14.5 feet and 14.9 feet, respectively, for the existing shed and trellis are also not substantial when taking into account the existing house setbacks. Due to the lot configuration, maintaining the existing shed and trellis in their current locations are not substantial. c) The area variances requested are not substantial (Town Law 267-b (3)(b)(3)). The variance requested for the front porch extension is not substantial and is needed for the second floor addition and it squares off the front of the house to meet the existing covered porch. It encroaches into the front yard setbacks by 8 feet to align with the pre- existing front porch. Additionally,the as built accessory 8.3 ft x 8.7 ft wood shed and the 9 ft x 9 ft wood trellis within side yard setbacks and a side yard. They are shielded from both Main Bayview Road and the adjacent residences. d) There is no adverse impact on the physical and environmental conditions to the neighborhood/town ((Town Law &267-b (3)(b)(4)). The property is not in an environmentally sensitive area and the work done will not affect any natural features. The project complies with lot coverage requirements; the allowable coverage is 20% or 2,694 sq ft and the proposed coverage is 2,402 sq ft. e) This is a self-created difficulty ((Town Law �267-b (3)(b)(5)). Although the difficulty is self-created, this factor should not be determinative and preclude the granting of an area variance. In sum, under Town Law §267-b,the grant of the requested relief is the minimum necessary and adequate to enable the applicant to enjoy the benefit of the proposed additions,pergola, and shed, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. CONCLUSION As demonstrated, the benefit to the applicant outweighs any potential detriment to the general health, safety, and welfare of the neighborhood and the Town as a whole. The variance requested is the minimum necessary to alleviate the described difficulty. MEMORANDUM To: Town of Southold Zoning Board of Appeals Re: 2740 Main Bayview Road, Southold,NY 11971—Project Narrative in Support of Area Variance Application–Submitted for Glendon and Mindy Homer Date: June 10, 2022 Glendon and Mindy Homer are proposing additions to their existing two-story single- family dwelling on property situate at 2740 Main Bayview Road, Southold,NY 11971 (SCTM# 1000-75-4-21). The proposed additions are as follows: 1. A 17 sq ft first-floor addition to the front of the house. 2. A 105 sq ft front porch extension; the porch addition dimensions are 17.11 x 4.2 ft and 10.3 x 4.6 ft, which would result in the construction of a wrap-around porch at the southeastern corner of the dwelling. 3. A 70 sq ft second-floor addition above existing first floor mud room adjacent to porch; addition will add a bathroom off on an existing second-floor bedroom as only a master bathroom exits on the second floor. In the narrative that follows, all of the proposed changes and improvements appear on the site plan prepared by Draft Design Architecture and Interiors,reissued April 15 2021. STATEMENT OF FACTS The subject non-conforming 13,469 sq. ft. lot is in the R-80 District. The owners purchased property on October 1, 2013; a copy of the deed is attached as Exhibit"A." Improvements on the subject parcel are covered by the following Certificates of Occupancy, copies of which are attached as Exhibit`B." 1. Certificate of Occupancy, dated September 11, 1957; 2. Certificate of Occupancy, dated March 24, 1994; 3. Certificate of Occupancy, dated November 17, 2009; 4. Certificate of Occupancy, dated October 18, 2013, for in-ground pool; 5. Certificate of Occupancy, dated October 18, 2013, for accessory alteration to shed; 12 6. Certificate of Occupancy, dated October 18, 2013, for"as built" alteration; 7. Certificate of Occupancy, dated October 18, 2013, for accessory alteration to garage. The existing hot tub will be legalized as part of the Town application, as a variance is not required. Photographs of the existing structures and areas of proposed addition are attached as Exhibit"C." RELIEF REQUESTED We request relief as follows: 1. In regards to the 35-foot front yard setback requirement,per Town Code Section 280-124, a variance of 7.4 feet is needed, as the proposed addition is 27.6 feet from the front yard. All additions are occurring to the front of the house and the southerly side of the house. The existing house is 32.7 feet from the front yard property line. 2. Additionally,the"as built" 8.3 ft X 8.7 ft wood shed and the 9 ft x 9 ft open air wood trellis sit within the 10 foot side-yard setback requirement per Town Code Section 280-124; we request relief of 4.5 feet and 4.9 feet,respectively and legalization of these "as built" structures. The wood frame shed is currently located 5.5. ft from the side yard and the wooden trellis is located 5.1 feet from the side yard. 3. Relief is also needed as the"as built" accessory trellis and shed are located in the side yard and pursuant to Article III Section 280-15, are within the side yard. STANDARDS FOR THE GRANT OF AREA VARIANCES Pursuant to Town Law Section 267-b, the Zoning Board of Appeals is required to take into consideration the following factors when weighing the benefit to the applicant if the variance is granted against the detriment to the health, safety, and welfare of the neighborhood and community: a) Whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; b) Whether the benefits sought by the applicant can be achieved by some method feasible for the applicant to pursue other than an area variance; c) Whether the requested area variance is substantial; d) Whether the grant of the variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; e) Whether the difficulty causing the applicant to request an area variance was self-created which consideration shall be relevant to the determination of the Board but shall not necessarily preclude the grant of the variance. The criteria for consideration of the required variances as discussed above as they apply to this application are addressed as follows: a) There is no undesirable change in the Character of the Neighborhood and detriment to nearby properties (Town Law 267-b (3)(b)(1)). The addition is needed for a bathroom on the second floor as only a master bathroom exists in this three bedroom home. A mere 71 sq. ft. first floor addition is to relocate the existing bathroom near the mudroom so that the kitchen can be enlarged for better usage and functionality. A first-floor extension of the covered porch will reach no further into the front yard setback than the existing front porch. These additions are minimal in nature and will not affect the overall character of the neighborhood. The as built accessory structures, specifically the 9 ft x 9 ft trellis, at 81 sq ft of coverage, and the 8.3 ft x 8.7 ft shed, at approximately 72 feet of coverage, will similarly not have any adverse effect. The property is heavily screened and fenced, preventing any adverse impact to neighbors. A trellis and shed are common accessory structures throughout Southold. b) The benefit cannot be achieved by some other method feasible for the applicant to pursue other than area variances (Town Law § 267-b (3)(b)(2)). As noted, the property is non-conforming to current R-80 zoning and any improvements to the front of the existing house would likely require variance relief. The existing house is 32.7 ft from the front yard setback and the covered wood plat walk is 28.4 feet from the front yard setback. The proposed front porch extension is 27.6 feet from the front yard setback and is not substantial. Variance relief of 14.5 feet and 14.9 feet, respectively, for the existing shed and trellis are also not substantial when taking into account the existing house setbacks. Due to the lot configuration, maintaining the existing shed and trellis in their current locations are not substantial. c) The area variances requested are not substantial (Town Law § 267-b (3)(b)(3)). The variance requested for the front porch extension is not substantial and is needed for the second floor addition and it squares off the front of the house to meet the existing covered porch. It encroaches into the front yard setbacks by 8 feet to align with the pre- existing front porch. Additionally,the as built accessory 8.3 ft x 8.7 ft wood shed and the 9 ft x 9 ft wood trellis within side yard setbacks and a side yard. They are shielded from both Main Bayview Road and the adjacent residences. b V� d) There is no adverse impact on the physical and environmental conditions to the neighborhood/town ((Town Law & 267-b (3)(b)(4)). The property is not in an environmentally sensitive area and the work done will not affect any natural features. There will be no adverse impacts on the physical and environmental conditions of the neighborhood or district, as the proposed project is to add a 17 sq ft first floor addition and add 70 sq ft above to second floor. The second-floor addition is for a bathroom off of an existing bedroom. The front porch additions are being made in order to meet up with and square off the existing front porch. The project complies with lot coverage requirements; the allowable coverage is 20%or 2,694 sq ft and the proposed coverage is 2,402 sq ft. e) This is a self-created difficulty ((Town Law 4 267-b (3)(b)(5)). Although the difficulty is self-created,this factor should not be determinative and preclude the granting of an area variance. In sum, under Town Law §267-b, the grant of the requested relief is the minimum necessary and adequate to enable the applicant to enjoy the benefit of the proposed additions,pergola, and shed, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. CONCLUSION As demonstrated,the benefit to the applicant outweighs any potential detriment to the general health, safety, and welfare of the neighborhood and the Town as a whole. The variance requested is the minimum necessary to alleviate the described difficulty. In light of the foregoing analysis of the application as applied to the relevant provisions, it is respectfully submitted that the application in all respects be granted.
