The board mad~ the following findings and determination: By this appeal, appellants seek permission to construct a two-car garage and storage building 24' by 28' in the frontyard area set back a minimum of 10' from the northerly side property line and westerly of the existing one-family dwelling structure. The premises in question contains 2.00 acres with 170.52 feet (tie line) along Eugene's Creek and a depth of 590 feet. Access to the parcel in question is over a private, traveled right-of-way upon premises now or formerly of Klam Properties, Inc. and which right-of-way has not received approval pursuant to New York Town Law, Section 280a. It is the opinion of the board that the location chosen for the proposed garage structure is the most feasibl~ under the circumstances; however, this variance shall be subject to receiving an application for and approval of access pursuant to law. In considering this appeal, the board determines that the variance request is not substantial in relation to the requirements of the zoniDg code; that the circumstances are unique; that by allowing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a method feasible for appellant other than a variance; that the relief requested will be in harmony with and promote the general purposes of zoning; and in view of the manner in which the difficulty arose and in consideration of all the above factors, the interest of justice will be served by allowing the variance as indicated below. The traveled width of the subject right-of-way is approximately eight feet in width and extends approximately 207 feet over Parcel 1 to the parcel in question. Applicants have submitted for the record an easement dated October 4, 1983, filed with the Suffolk County Clerk October 7, 1983, granting a right to use a 15~ wide private right-of-way abutting the northerly line of Parcel 1, 207.96 feet in length~ Prior to the signing of this easement, town records show that Parcel 2 has a right-of-way in co~mon with others over an exist- ing roadway across land now or formerly M. Almeida, formerly Klam Properties, Inc. on premises identified as County Tax Map Dis- trict 1000, Section 103~ Block 2~ Lot 1 (Liber 8894 c~ 49). For tke record it is also mentioned that Parcel 2 in ques- tion fronts along Eugene's Creek and contains approximately two acres. The premises is improved with a one-story; one-family dwelling structure. Parcel 1 contains an area of approximately 34,000 sq. ft. with 165.23 frontage along Harbor Lane (inclusive of the subject right-of-way) and is vacant. On February 25, 1983, a conditional variance was granted to the applicants herein for the construction of a 24' by 28' accessory storage building (Appeal No. 3071).
