This is to notify you that there will be a public hearing before the Zoning Board of Appeals of the
Town of Southold on Thursday, December 1, 2022 at 1:40 P.M. that will be held both in person at
Southold Town Hall, 53095 Main Road, Southold, New York 11971-0959 AND via ZOOM WEBINAR
with a link to the ZOOM WEBINAR to be available at http:Hsoutholdtownny.gov/calendar.aspx. The
purpose of the hearing is to consider KCE NY 26 LLC's request for certain Area Variance relief to construct
a new Battery Energy Storage Facility and to subdivide the existing parcel, with: (1) the new lot not
providing for direct access to a public street in accordance with NYS Town Law 280-a; (2)the height of
structures at more than the code permitted maximum 35 feet in height; and(3)the structure providing less
than the code required side yard setback of 20 feet.
A copy of the Site Plan showing the proposed improvements has been enclosed herewith,together
with a copy of the Town's Laserfiche/Weblink,which allows all persons to review the pending application
at:http://24.3 8.28.228:2040/weblink/Browse.aspx?dbid=0. Further,the public may also contact the Zoning
Board of Appeals staff by telephone at 631-765-1809 or email at kimf@southoldtownny.gov or

All persons interested in the subject matter will be given an opportunity to be heard as provided in
the enclosed Legal Notice of Public Hearing. Please note that if you have questions/comments regarding
this application before the public hearing, the public may submit written comments and inquiries to the
Zoning Board of Appeals by email to kimf@southoldtommny.gov or

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Town Code
Chapter 280(Zoning),Town of Southold,the following"IN PERSON" public hearing will be
held by the SOUTHOLD TOWN ZONING BOARD OF APPEALS at the Town Hall,53095 Main
Road, Southold, New York 11971-0959, on THURSDAY. DECEMBER 1.2022:
The public may ALSO have access to view,listen and make comment during the PUBLIC
HEARING as it is happening via ZOOM WEBINAR. Details about how to tune in and make

1:40 P.M. - KCE NY 26 LLC #7685 - Request for Variances from Article XXII, Section 280-
109A(1) & (2); Article XV, Section 280-63; and the Building Inspector's April 6, 2022,
Amended April 13, 2022 Notice of Disapproval based on an application for a permit to
construct a new Battery Energy Storage Facility and to subdivide the existing parcel, at 1)
proposed created lot shall require direct access to a public street in accordance to NYS
Town Law 280-a; 2) height of structure more than the code required maximum 35 feet in
height; 3) structure less than the code required side yard setback of 20 feet; located at:
