The purpose of the hearing is to consider KCE NY 26 LLC's request for certain Area Variance relief to construct a new Battery Energy Storage Facility and to subdivide the existing parcel, with: (1) the new lot not providing for direct access to a public street in accordance with NYS Town Law 280-a; (2)the height of structures at more than the code permitted maximum 35 feet in height; and(3)the structure providing less than the code required side yard setback of 20 feet.
