POLICY: At the beginning of scheduled Town Board meetings, the attending public is encouraged to
briefly address the Town Board relating to agenda resolutions prior to their enactment; the public will also be
given time at the conclusion of the regularly scheduled business agenda to address the Board on any given
topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting. The video of
the meeting is usually available to watch live during the meeting. Minutes with adopted resolutions are
available 1-2 days after the meeting. A full copy of the minutes, agenda and meeting video can be viewed by
going to the official Town of Southold website:
www.southoldtownny.gov <http://www.southoldtownny.gov> and following either of the following:
(1) Move pointer over “Government” on the Town website home page. You will find the title “Town
Supervisor/Town Board”. Under this title you will see “Southold Town Board Meetings and Agendas”. or
(2) Go to “How Do I”, in the right upper corner of the Town website home page, Choose “Access”, then
“Southold Town Board Meetings and Agendas.
Go to the date of the meeting and click on "Minutes Packet" this is the full copy of the resolutions. (Scroll to
bottom of page for KEY to symbols). You can view the live video of the meeting by clicking on the camera
symbol. All of this information is available 24/7.

Due to the expiration of the New York State Governor’s Executive Orders regarding the COVID-19 pandemic
in-person access to the Public will now be permitted. The meeting will still be accessible via Zoom and
streamed live on the Town’s website. The meeting can be viewed live by going to the Town’s website at
www.southoldtownny.gov <http://www.southtownny.gov> home page. Click on the “Government” tab, once
the drop down menu appears, under “Town Supervisor/Town Board”, click on “Southold Town Board Minutes
and Agendas” which takes the user to the Town of Southold Meeting Portal page. Once on the Meeting Portal
page, click on the date of the meeting you wish to view and then click on “Video”. A recording of the meeting
will also air on Channel 22 and will be posted on the Town’s website
Instructions and link to attend the meeting will be available on the Town’s website or by calling the Town
Clerk’s office at (631)765-1800. A telephone number will also be provided to allow members of the public to
attend via telephone.

Pursuant to the requirements of the Executive Order of the Governor of the State of New York, a transcript will
be prepared of the public hearing, and a copy shall be filed with the Town Clerk and placed upon the Town's
website.

Retirement Resolution for Elected/Appointed Officials
WHEREAS, the State of New York has set additional reporting requirements in Section 315.4 of the New York Codes,
Rules and Regulations which requires all elected and appointed officials whose terms start on or after August 12, 2009,
who are members of the New York State and Local Retirement System and who do not participate in their employer’s
time keeping system to prepare a log of their work-related activities for three consecutive months and submit their logs to
the clerk or secretary of the governing body within 150 days of the start of their term;
NOW THEREFORE, BE IT
RESOLVED that the Town Board of the Town of Southold hereby establishes the following as standard workdays for
elected and appointed officials and will report the following days worked to the New York State and the Local
Employees’ Retirement System based on the record of activities maintained and submitted by these officials to the clerk
of this body:

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose
The Purpose of the amendment is to improve safety for emergency vehicles, pedestrian and passenger vehicles,
as well as dealing with impacts to the public’s health, safety and welfare resulting from vehicles parking and
standing on a portion of Duck Pond Road in the hamlet of Cutchogue.
II. Amendment.
The Southold Town Code is hereby amended by removing the struck through words and adding the underlined
words as follows:
§ 260-8 Parking prohibited at all times.
Duck Pond Road Both Sides In Cutchogue, from a distance 400 feet from the northerly
terminus of Duck Pond Rd southerly to a point 150 feet south of the
intersection with Birch Lane.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part
thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.

Staff to prepare a report and recommendations on the proposed local Law, including a SEQRA and LWRP

The proposed Local Law entitled, “A Local Law in relation to Amendments to Chapter 280” reads as
follows:
LOCAL LAW NO. -2022
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of this local law is to address issues concerning the maximum size of one and two family
dwellings in certain zoning districts consistent with the Southold Town Comprehensive Plan adopted September
8, 2020, the Vision Statement of which calls for future planning within the Town to be consistent with existing
community character and a periodic review and amendment of the Town Code to that end.
The Town Board because of objectives outlined in the plan, especially Chapter 3 Land Use and Zoning,
finds it necessary to draft and adopt new code that establishes standards for the construction and reconstruction
of residential dwellings in certain zoning districts. Such standards will establish maximum limits on house size
based on lot size and are necessary to maintain the community character of the residential communities as
called for in the Comprehensive Plan.
II. Chapter 280 of the Code of the Town of Southold is hereby amended to include the underlined words
and remove the struck through words as follows:
280-4 Definitions.
FLAT, LOW SLOPE OR MANSARD ROOF - Any roof that has a pitch of 3:12 or less.
FLOOR AREA, GROSS (GFA) - The cumulative area, in square feet, of all floor levels of every story of all
dwellings on a lot, including attached garages, having a clear height of not less than six feet measured from the
exterior faces of exterior walls or from the center line of party walls separating two buildings. Interior spaces
with a floor-to-ceiling height in excess of fifteen (15) feet shall be counted twice for gross floor area.
The cumulative area shall not include roof overhangs less than three (3) feet, unenclosed porches, patios, decks,
open terraces; balconies; basements and attics. Accessory buildings or structures shall also be excluded, except
any portion thereof which may be converted to habitable space. Such habitable portion shall be included in the
Gross Floor Area.
GROSS FLOOR AREA - See FLOOR AREA, GROSS
HEIGHT OF BUILDING - The vertical distance measured from the average elevation of the existing natural
grade adjacent to the building, before any grade alteration or fill, to the highest point of the roof, parapet or
railing.
SKY PLANE OF LOT - The Sky Plane is formed by imaginary lines starting at all property lines parallel or
adjacent to the building or structure at ten (10) feet above the average elevation of the natural grade (prior to
any grade alteration or fill) and extending inward toward the center of the lot at a 45 degree angle.
Article XXXVI Residential Dwelling Size Limits
§. 280-207 Maximum gross floor area for residential dwellings in A-C, R-40, R-80, R-120, R-200, and R-400
Districts.
A. Maximum gross floor area (GFA):
1. The gross floor area shall not exceed the permitted square footage calculated as follows:
a. Lots containing up to 10,000 square feet of lot area: 2,100 square feet maximum.
b. Lots containing up to 20,000 square feet of lot area: 2,100 square feet plus 12.5% of the
lot area in excess of 10,000 square feet up to a total of 3,350 square feet maximum.
c. Lots containing up to 30,000 square feet of lot area: 3,350 square feet plus 10 % of the lot
area in excess of 20,000 square feet up to a total of 4,350 square feet maximum.
d. Lots containing up to 40,000 square feet of lot area: 4,350 square feet plus 7.5 % of the
lot area in excess of 30,000 square feet up to a total of 5,100 square feet maximum.
e. Lots up to 80,000 square feet of lot area: 5,100 square feet plus 5% of the lot area in
excess of 40,000 square feet up to a total of 7,100 square feet maximum.
f. Lots up to 200,000 square feet of lot area: 7,100 square feet plus 2.5% of the lot area in
excess of 80,000 square feet up to a total of 10,100 square feet maximum.
g. All Lots in excess of 200,000 square feet of lot area: 10,100 square feet plus 1% of any
additional lot area.
2. In determining the maximum permitted gross floor area, the following provisions shall apply:
a. “Lot area” shall have the same meaning as the area of a lot or parcel defined as
“buildable land” in this Chapter.
b. In determining the maximum lot coverage, whether under the gross floor area
requirement or the percentage restriction in this Section, the more restrictive requirement
or standard shall apply.
c. The new construction, re-construction or improvement of any dwelling shall be limited
by the standards established by this code, or by variance not to exceed the average GFA
of dwellings in the immediate area as determined by the Zoning Board of Appeals.
d. Any existing dwelling as of the effective date of this section that exceeds the maximum
GFA defined herein shall be deemed non-conforming for the purpose of this chapter.
e. The gross floor area restrictions set forth in this section shall not apply to farm labor
housing.
3. The maximum gross floor area restrictions imposed by §280-207 shall not be applicable to any
project otherwise subject to the restrictions, for which a complete construction application has
been submitted for approval to Town of Southold Building department or any discretionary
board, prior to the enactment date of this section. Following the issuance of a Certificate of
Occupancy, the structure shall be deemed preexisting non-conforming.
§. 280-208 Pyramid Law
A. Any building or structure on any lot in the A-C, R-40, R-80, R-120, R-200, and R-400 Zoning Districts
must be within the sky plane.
B. If, in the determination of the Building Inspector, conformance with subsection (A) is not possible, a
building or structure may be permitted so long as the overall height is not in excess of the average height
of the adjacent within 500 feet to each side of the subject parcel, on the same side of the street and in the
same zoning district.
C. The sky plane restrictions imposed by §280-208 shall not be applicable to any project otherwise subject
to the restrictions, for which a complete construction application has been submitted for approval to
Town of Southold Building Department or any discretionary board, prior to the enactment date of this
section. Following the issuance of a Certificate of Occupancy, the structure shall be deemed preexisting
non-conforming.

WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid Local Law at
which time all interested persons were given an opportunity to be heard, NOW THEREFOR BE IT
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local Law entitled,
“A Local Law in relation to Amendments to Chapter 189, Parking, and Chapter 260, Vehicles and
Traffic in connection with Parking on North Sea Drive and Hortons Lane in the hamlet of Southold”
which reads as follows:
LOCAL LAW NO. 2022
A Local Law entitled, “A Local Law in relation to Amendments to Chapter 189, Parking, and Chapter
260, Vehicles and Traffic in connection with Parking on North Sea Drive and Hortons Lane in the hamlet
of Southold.”
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose
The Purpose of the amendment is to improve safety for emergency vehicles, pedestrian and passenger vehicles,
as well as dealing with impacts to the public’s health, safety and welfare resulting from vehicles parking and
standing on a portion of North Sea Drive in the hamlet of Southold.
II. Amendment.
The Southold Town Code is hereby amended by removing the struck through words as follows:
CHAPTER 189 - Parking
§189-2 Designation of areas requiring parking permits.
B. The following road end areas are hereby designated as Town of Southold "Parking by Southold Town
Permit Only" area:
(22) North Sea Drive, Long Island Sound, Southold, along both sides the south side from the intersection with
Horton's Lane west for a distance of 820 feet.
CHAPTER 260 - Vehicles and Traffic
§260-8 Parking prohibited at all times.
Hortons Lane East In Southold, from the intersection with Soundview Avenue northwesterly
to the terminus of Hortons Lane
North Sea Drive North In Southold, from the exit of the McCabe’s Beach Parking Lot
southwesterly to the terminus of Hortons Lane
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part
thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.

Exemption for Senior Citizens”.
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose. It has been determined by the Town Board that there is a continuing need to increase the
income limits for senior citizen exemptions considering the current pace of inflation. This Amendment adjusts
the tax exemption to meet the full extent of the amended New York State Law.
II. § 245-1 Partial exemption for senior citizens.
A. Amount of exemption.
(1) Real property owned by one or more persons, each of whom is 65 years of age or over, or real property
owned by husband and wife, one of whom is 65 years of age or over, shall be exempt from Town taxes to
the extent provided, subject to the following income limitations:

(2) Such exemption shall be computed after all other partial exemptions allowed by law have been subtracted
from the total amount assessed.
Chapter 245- 2 Conditions
No exemption shall be granted:
A. If the income of the owner or the combined income of the owners of the property for the income tax year
immediately preceding the date of making application for exemption exceeds the sum of $58,400 as provided
by local law pursuant to this section. $34,399 effective July 1, 2006, $35,399 effective July 1, 2007, $36,399
effective July 1, 2008 and $37,399 effective July 1, 2009. "Income tax year" shall mean the twelve-month
period for which the owner or owners filed a personal income tax return or, if no return is filed, the calendar
year. Where the taxable status date is on or before April fourteenth, income tax year shall mean the twelve-
month period for which the owner or owners filed a federal personal income tax return for the year before the
income tax year immediately preceding the date of application and where the taxable status date is on or after
April fifteenth, income tax year shall mean the twelve month period for which the owner or owners filed a
federal personal income tax return for the income year immediately preceding the date of the application.
Where title is vested in either the husband or the wife, their combined income may not exceed such sum. Such
income shall include social security and retirement benefits; interest; dividends; total gain from the sale or
exchange of a capital asset, which may be offset by a loss from the sale or exchange of a capital asset in the
same income tax year; net rental income; salary or earnings; and the net income from self-employment, but not
including a return of capital, gifts or inheritances. In computing net rental income and net income from self-
employment, no depreciation deduction shall be allowed for the exhaustion, wear and tear of real or personal
property held for the production of income.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part
thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall apply to the assessment rolls prepared on the basic of taxable status dates occurring on or
after January 1, 2023. This Local Law shall take effect immediately upon filing with the Secretary of State as
provided by law.

Persons with Disability exemptions considering the current pace of inflation. This Amendment adjusts the tax
exemption to meet the full extent of the amended New York State Law.
II. § 245-10 Exemption for Disabled Persons with Limited Income
A. Real property owned by a person with disabilities whose income is limited by such disabilities, and used as
the legal residence of such person, shall be entitled to a partial exemption from taxation to the extent of 50% of
assessed valuation.
B. To be eligible for the exemption authorized by such § 459-c and implemented by this article, the maximum
income of such person shall not exceed $26,000 effective July 1, 2006, $27,000 effective July 1, 2007, $28,000
effective July 1, 2008, and $29,000 effective July 1, 2009 $58,400 effective on assessment rolls after January 1,
2023. Any such person having a higher lower income shall be eligible for exemption in accordance with the
following schedule:
