Dear Mr. Hindermann:
On June ll, 1984, we received the attached correspondence
from the Planning Board concerning the above matter. Informally
we were told by the Town Planner, Mr. Emileta, that we would
have to go for a variance because the lot area is 27,305 sq. ft.
(not 30,000) in this B-1 General Business Zone.
On April 6, 1982, a 25-foot strip of land was conveyed to
the County of Suffolk for access to the recharge basin which is
located north Rf this property. The dimensions of the conveyed
strip was ~-5~by 25', or an area of ~r=2-~. ft. (not 12,000
sq. ft. as assumed by the Planning Board), which left the
27,305 sq. ft. of lot area.
Although the Planning Board has recommended that same be
acted upon favorably (paragraph 2), we are sort of in a
"Catch 22" situation since we have not been given anything in
writing in order to proceed to the Zoning Board of Appeals.
It is our understanding that the Planning Board will be
referring the site plan to you for certification the last week
in June; however, if we wait until then, we would not be able
to meet the deadline of the ZBA for the July calendar.

Dear Mr. Goehringer:
The applicants for the above mentioned site plan have indicated
to the Planning Board that they are requesting a variance
on the insufficient area of the lot from the Board of Appeals.
The Planning Board recormmends that you look favorably upon
this application, since it appears that the insufficient area
is a result of the County of Suffolk acquiring the 12,000
square feet of property to construct a recharge basin.

Monday, July 30, 1984.
RESOLVED that the Southold Town Planning Board approve the
site plan of John P. Kowalski, Jr., and Chester Berry, Jr.
located at Southold, dated July 12, 1984 for the constructibn
of a fish market and future accounting and secretarial
offices, subject to a one-year review.

INSTRUCTIONS
a. This application must be completely filled in by typewriter or in ink and submitted to the Building Inspector, with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets
or areas, and giving a detailed description of layout of property must be drown on the diagram which is part of this appli-
cation.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issued a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.
