Present were: John Stein, Chairperson Carol Brown, Member Maggie Merrill, Member John Chandler, Member Shannon Wright, Member Inga Van Eysden, Member Brian Mealy, Town Board Liaison Liz Gillooly, Trustee Liaison Lauren Standish, Secretary Absent was: Caroline Burghardt, Member CALL TO ORDER John Stein called the meeting to order at 4:30PM. REPORTS John Stein attended the Board of Trustees meeting held on September 14th. The application made on behalf of Sunset Holdings was approved by the Board of Trustees and the application made on behalf of Paskewitz was denied. NEW BUSINESS Maggie Merrill shared an article she found in the East End Beacon about East Hampton Town adopting a coastal resiliency plan. A public hearing was held on August 4th on the plan and by adopting this the town will achieve funding for projects outlined in the plan. 2 This funding will come from a variety of sources including the NYS Clean Air, Clean Water and Green Jobs Bond Act, which will be put before the New York voters in a referendum on this November's ballot, Proposition #1. Carol Brown attended the NYS Assoc. of Conservation Council's annual conference on October 6t". It concentrated on the upcoming ballot item. Westchester put out a Resolution to support this Act. A special meeting of the Board of Trustees and the Town Board was held on September 29tH There was a discussion about raising the current fees and increasing fines for wetland code violations. Fees have not been raised since 2005. There was also a discussion regarding the ban on new docks on the bay. Exceptions would be spelled out in the code. Funding is in place to hire an Environmental Analyst but the job description is outdated. Carol researched the position on the Civil Service website and provided the information to the Town Board and the Board of Trustees. Carol Brown asked the members if they would be interested in pursuing the idea of establishing a Conservation Board. This would give the CAC the opportunity to review any proposed land use applications affecting open areas listed in the index. She'll discuss this further with Councilman Mealy before she continues to pursue. It was suggested by several members of the CAC to consider filling the student member vacancies. Carol will write up a duty statement and bring it back to the next monthly meeting for further discussion. TRUSTEE LIAISON REPORT Liz Gillooly reported that pending applications before the Board of Trustees are now available on Laserfiche. She will e-mail the CAC members the links to each of the pending applications currently before the CAC. CLIMATE SMART COMMUNITIES APPROVAL OF MINUTES Moved by John Stein, seconded by John Chandler, to Approve the Minutes of September 7, 2022. RECOMMENDATIONS -WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by John Chandler, seconded by John Stein, it was RESOLVED to SUPPORT the application of KARL ABDELNOUR & MEGAN GRACE ABDELNOUR to install rock armoring in front of existing 150 steel bulkhead using Y2 to 3 ton stone, not exceeding 2.5 ton per linear foot. Located: 21075 Soundview Ave., Southold. SCTM#51-4-17 Inspected by: John Stein, John Chandler, Maggie Merrill 3 Vote of Council: Ayes: All Motion Carried Moved by John Chandler, seconded by John Stein, it was RESOLVED to SUPPORT the application of FOUNDERS LANDING BOATYARD, LLC for a 10-year maintenance dredge permit to dredge a 2,854 sf. area to -7' below mean low water removing approx. +/-700 cy. of spoil. Dredge spoil to be trucked off site to an approved disposal site. Located: 2700 Hobart Rd., Southold. Proposed garage 24'X 24' with a connecting room approx. 11'X 13'. Total square footage of garage is 860 sf. Located: 3380 Oaklawn Ave., Southold. SCTM#70-5-49.4 Inspected by: John Chandler, Maggie Merrill Vote of Council: Ayes: All Motion Carried Moved by John Chandler, seconded by John Stein, it was RESOLVED to SUPPORT the application of SHAMGAR CAPITAL LLC/DANIEL BUTTAFUOCO to construct a 16'X 46' gunite pool with 8'X 8' hot tub inside. Install an automatic cover for pool, pool equipment with gas heater. Construct a 25'7"X 16' pergola over a 2-part outdoor kitchen and bar. Construct a 2,000 sf. deck in composite around pool. Located: 1165 Kimberly Lane, Southold. SCTM#70-13-20.7 Inspected by: John Chandler, Inga Van Eysden, Carol Brown The CAC Supports the application with a dedicated pool enclosure fence. The bulkhead should not be raised and utilized as a fence. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by Inga Van Eysden, it was 4 RESOLVED to NOT SUPPORT the application of KENNETH & ELIZABETH McCULLOCH.to demolish and reconstruct 1,868 sf. portion of existing two-story dwelling over its existing foundation, leaving intact 676 sf. potion of existing dwelling, consisting of an attached garage (with second-story above), and 583 sf. attached, uncovered waterside deck (to be resurfaced as needed); remove 291 sf. attached deck and steps, 13 sf. covered stoop, 45 sf. roofed porch, wood arbor, and 518 sf. accessory deck; construct 184 sf. masonry patio and steps in place of 128 sf. attached deck to be removed; construct 2.2'X 8.3' one-story and 2.3'X 13.9', 2'X 6.4', 1.8'X 11.2' and 4'X 10' two-story dwelling additions, 277 sf. front porch addition with steps, 310 sf. screened porch addition, 227 sf. covered outdoor kitchen with landing and steps, 35' landing with steps, and new steps to waterside deck to remain; construct 1,163 sf. masonry patio and 310 sf. masonry walkway; remove existing asphalt driveway and install pervious gravel driveway; install 4' high fencing, A/C units, and generator; remove existing conventional septic system and install new I/A sanitary system; install stormwater drainage system; maintain existing vegetated embankment as vegetated buffer, and establish an additional 5' wide non-turf buffer along landward edge of top of bank. SCTM#71-1-15 Inspected by: Carol Brown, Inga Van Eysden The CAC does Not Support the application because the new construction is within 50' of the bulkhead, the project exceeds the allowed lot coverage, and non-pervious materials are proposed on the patios and walkways. Vote of Council: Ayes: All Motion Carried Moved by Inga Van Eysden, seconded by Carol Brown, it was RESOLVED to SUPPORT the application of LAURA CHILTON for a proposed 16'X 32' gunite swimming pool with 12" coping on deck and pile, and existing deck 12' above grade. Existing handrail, deck, stairs and acrylic spa will remain. Located: 105 Waterview Dr., Southold. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by Inga Van Eysden, it was RESOLVED to SUPPORT the application of PECONIC RIVER LLC to remove and replace (in-place) approx. 190 If. of existing timber/vinyl bulkhead with new vinyl bulkhead (raise westerly 5', ,23', 47', and 16' sections approx. 18" to match elevation of easterly 99' section); permanently remove existing +/-18' middle return, +/-71' westerly retaining wall, 5 wood steps, and approx. 23 If. of easterly retaining wall around steps; construct approx. 104 If. of wood tie retaining wall in place of existing easterly retaining wall; backfill with approx. 75 cy. of clean sand to be trucked in from an approved upland source (on west side of property, fill approx. 708 sf. area behind bulkhead to meet existing grade landward of retaining wall to be removed); construct 4.5'X 6' wood platform and 3'X 12' aluminum stair off bulkhead; and restore/revegetate disturbed portion of naturally vegetated embankment upon completion of construction. Vote of Council: Ayes: All Motion Carried Moved by Inga Van Eysden, seconded by Carol Brown, it was RESOLVED to SUPPORT the application of PHYLLIS SOUSA to install a 14'X 38' swimming pool surrounded by a 58'X 28' stone patio with an 8'X8' spa along the landward side. Remove the existing seaward deck stairs and install two 4'X'4 wood stairs along the easterly and westerly stairs of the existing deck. Located: 4145 Wells Rd., Peconic. SCTM#86-2-12.6 Inspected by: Inga Van Eysden, Carol Brown The CAC Supports the application with a pool enclosure fence, and drywells for the pool backwash depicted on the site plan. Vote of Council: Ayes: All Motion Carried Moved by Shannon Wright, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of K2J4E6 LLC PATRICK SEVERSON & DIANE SEVERSON for a new accessory structure pool house 350 sf., remove existing frame shed, and new on-grade paving area addition, 350 sf., to existing paving area surrounding existing pool. Located: 9202 Bridge Lane, Cutchogue. SCTM#73-2-3.1 Inspected by: Shannon Wright, John Stein The CAC does Not Support increasing the size of the shed, the removal of trees and the new construction, due to the close proximity to the bluff and the detrimental effect this project could have on the environment. Vote of Council: Ayes: All Motion Carried 6 r Moved by Shannon Wright, seconded by John Stein, it was RESOLVED to SUPPORT the application of CUTCHOGUE 6213, LLC C/O STEPHANIE GUILPIN to construct along eroded toe of bluff approx. 165 If. of stone revetment (to be tied into proposed revetment to the east), including a westerly 10' angled return, consisting of approx. 3 to 5 ton stone placed over 50-100 Ib. core stone and filter cloth; restore bluff face by constructing terrace retaining walls and placing approx. 209 cy. of sand for re-nourishment (including approx. 169 cy. of on-site material excavated from toe of bluff for revetment installation and approximately 40 cy. of clean sand to be trucked in from an approved upland source) to be vegetated with native plantings; and establish a 4'X 64' wood chip path to bluff crest through the 50' non-disturbance buffer, with access via LI Sound or through the end of Duck Pond Road. SCTM#82-2-3.1 Inspected by: Shannon Wright, John Stein Vote of Council: Ayes: All Motion Carried Moved by Shannon Wright, seconded by John Stein, it was RESOLVED to SUPPORT the application of CUTCHOGUE 6291, LLC C/O STEPHANIE GUILPIN to construct along eroding toe of bluff approx. 165 If. of stone revetment (to be tied into proposed revetment to west), including an easterly 10' angled return consisting of approx. 3 to 5 ton stone placed over 50-100 lb. core stone and filter cloth; restore bluff face by constructing terrace retaining walls and placing approx., 214 cy. of sand for re- nourishment (including approx. 169 cy. of on-site material excavated from toe of bluff for revetment installation and approx. 45 cy. of clean sand to be trucked in from an approved upland source) to be vegetated with native plantings, construct a 4' wide elevated timber bluff stairway with approx. overall length of 76', including 5.6'X 7' entry platform, two 4'X 4' middle landings, two 4'X 5.6' middle landings with benches and a 4'X 5.6' bottom landing with bench, leading to an approx. 4' wide stone steps through revetment to beach; and establish a 4'X 415' wood chip path through beach access easement to proposed stairway, with access via LI Sound or through the end of Duck Pond Road. SCTM#82-2-3.2 Inspected by: Shannon Wright, John Stein Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Inga Van Eysden, it was RESOLVED to SUPPORT the application of KORYN ESTRADA to construct a second- floor addition over the existing footprint, second-floor decks and master study. New I/A septic system, proposed bedrooms, and new entry deck and walks. Located: 2350 Deep Hole Dr., Mattituck. The next meeting of the Conservation Advisory Council will be held on Thurs., November 10, 2022 at 4:30PM in the Conference Room.
