The board made the following findings and determination: By this appeal, applicant seeks permission to reestablish two build- ing parcels at "Laughing Waters," to wit, Parcel 1 having an area of approximately 14,100 square feet and road frontage of 119 feet, Parcel 2 having an area of approximately 20,200 square feet and road frontage of 114 feet along Wabasso Street. Existing on Parcel 2 are a garage-type structure, and two small shed structures, and Parcel 1 is vacant. The board finds that the premises were acquired by the applicant during 1967 in deeds at Liber 6194 cp 519 (Parcel 2) and at Liber 3175 cp 213 (Parcel No. 1), prior to the change in area requirements. The board also finds that the parcels in the vicinity of this property are of similar size, shape and character to that proposed by appellant. In considering this appeal, the bokrd determines that the variance request is not substantial; that the circumstances are unique; that by allowing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a method feasible to appellants other than a variance; that the relief requested will be in harmony with and promote the general purposes of zoning; and in view of the manner in which the difficulty arose and in consideration of all the above factors, the interest of justice will be served by allowing the variance. Applicant has applied to the Building Department for permission to construct a new one-family dwelling in conformity with the rules and regulations of the zoning code; however, since this parcel is a corner lot as defined by Article I, Section 100-13, "Definitions," the area in which the subject accessory building is located has been technically interpretted to be "front yard" area. Section 100-32 requires accessory buildings to be located in the rear yard area. The premises in question i~ located at the intersection of Wabasso Stregt and Nokomis Road, near Laughing Waters, in the Ham- let of Southold, Town of Southold, and is more particularly identified on the Suffolk County Tax Map as District 1000, Section 78, Block 3, part of 039. The premises contains an area of approximately 20,123 sq. ft. The subject accessory building is and will continue to be set back from Nokomis Road property line 25 feet and from Wabasso Street property line 47 feet.
