Clerk.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises;TO HAVE
AND TO HOLD the premises herein granted unto the party of the second part,the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total
of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever
the sense of this indenture so requires.

DESCRIPTION OF PREMISES
ALL that certain plot, piece or parcel of land, situate, lying and being at Bay View, near Southold, in the
Town of Southold, County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the westerly line of a proposed highway to be known as "Summit Road" (also
known as Summit Drive), 150 feet northerly along said westerly line from the northerly line of a
proposed highway to be known as "Ed's Road", said northerly line of"Ed's Road" being parallel with
and 382 feet northerly from the northerly line of Main Bayview Road measured at right angles thereto,
and said westerly line of"Summit Road" being parallel with and 450 feet westerly from the westerly line
(or its extension southerly) of land of Frank Stolzer, measured at right angles thereto; said point of
beginning being the northeasterly corner of land conveyed, or about to be conveyed, by Edward Nidds
to Raymond Smith; from said point of beginning running westerly along land of Smith and along land
conveyed, or about to be conveyed, to Macoun, 125 feet;
THENCE northerly along other land of Nidds, 75 feet;
THENCE easterly along land conveyed, or about to be conveyed, to Helgeson, 125 feet to said
westerly line of"Summit Road",
THENCE southerly along said westerly line of"Summit Road", 75 feet to the point of BEGINNING.
TOGETHER with a right of way 50 feet in width over said "Summit Road" from the northeasterly corner
of the premises southerly to said "Ed's Road", and then westerly over said "Ed's Road" to a proposed
highway to be known as "Victoria Drive" to Main Bayview Road.
SUBJECT to the reservation of the right reserved by Edward Nidds to dedicate the aforesaid roads
known as "Summit Road", "Ed's Road" and "Victoria Drive"to the Town of Southold as public highways,
which reservation is more fully set forth in deed recorded in the Office of the Clerk of Suffolk County in
Liber 4621 of Deeds at page 369 on May 5, 1959.
TOGETHER with the right to the use, in common with others, of a strip of land 50 feet in width as an
easement too Corey Creek, said strip of land being bounded on the easterly by and land of Edson and
O. the westerly by land of Toedter and Dickinson.
