APPLICATION FOR CERTIFICATE OF OCCUPANCY
Instructions
A. This application must be filled in typewriter OR ink, and submitted in duplicate to the Building Inspec.
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topograohic features.
2. Final approval of Health Dept. of water supply and sewerage disposal—(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of peoperty showing all property lines, streets, buildings and unusual natural or
topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent informa-
tion required to prepare a certificate.
C. Fees:

Dear Mr. Hinderman:
Enclosed are the drawings I sopke to you about sometime ago. They
indicate the extent of the existing cottages we own on Soundview Avenue,
and the proposed second floor additions. The two cottages exist on
one lot as is shown on the print of our survey. The new construction
will not come any closer to the property lines than the existing buildings.
As I explained during our telephone conversation, I am reluctant to
pursue this matter further without some indication that our proposed
addition will be acceptable to the Building Department. You said that
you would be able to review these sketches and send a letter to me stating
whether or not our proposal is approvable. If it is , we would develop
detailed drawings and submit them to you for formal approval and
Building Permit.
Should you find our sketches acceptable, would you please send me blanks
of all the forms I would need to obtain formal approval .

Re : 21925 & 21975 - 21995, Soundview Avenue, Southold
Dear Sirs:
We are in receipt of two applications for building permits
for the above locations.
First of all, you already have an application for a permit
to add second story and connect two buildings at 21975 - 21995
Co . Tax Map #135-01 -011 . Also this matter is now before the
Zoning Board of Appeals, who presently are in correspondence with
you. Your latest application shows connection of the two dwellings
with breezeway. Please advise if you plan to withdraw your
first application for two story addition, if so, then withdrawl of
application before the Zoning Board would be in order.
We are returning application for breezeway addition for
the following reasons. Applications are Copies, we require one
original. Also required are plans showing more details of
construction of deck connection and breezeway.
Regarding dwelling at 21925 Soundview Avenue, your application
for permit is being disapproved for the following reasons.
Proposed addition to deck reduces side yard dimension to 8 ' 0" .
Total side yard requirements are 26 , - 3" 1 it would appear from
your copy of survey, dated 8/19/71, total side yards are now less
than required. Also, construction of deck into rear yard area is
within 75 feet of tidal waters and approval from the Department of
Environmental Conservation would be needed.
The alteration of the interior of dwelling is subject to plan
review which you have not included with your application. This
should include cross sectional drawings where any changes are
being made . The floor plan does not show tub or shower in

bathrooms, this is required under Housing Code.

c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center hues thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE. AND TO HOLD the premises herein granted unto the party Of the second part, the heirs or
successors and assigns of the party of the second part forever, each having an undivided
fifty percent interest, as tenants in common.
This conveyance is subject to a mortgage held by Frederick C. `
Koke in the sum of $12,000.00 now reduced to $91705®67 (Liber 4729 mp
09) with interest from August 14, 1971, the payment of which mortgage
(and the accompanying bond) is hereby assumed by the parties of the
second part herein. The parties of the second part herein agree to
pay the unpaid balance of principal and interest on said bond and
mortgage and do further covenant and agree that they will hold the '
said Clement Biddle and Katherine N. Biddle, his wife, free and
harmless from any claim for unpaid interest or principal of said
bond and mortgage, or any part thereof. The parties of the second
part do further covenant and agree that they will indemnify the said
Clement Biddle and Katherine N. Biddle, his wife, against any claim
for such interest or principal and for any at-torney' s fees and ex-
penses lawfully incurred by them in connection therewith. The parties
of the second part do further covenant and agree that no sale or
transfer of said premises will be made by them (other than a sale or
transfer to each other_) until said bond and mortgage have been fully
satisfied or until the said Clement Biddle and Katherine No Biddle,
his wife, have been fully released from any and all liability on said
bond and mortgage. The parties of the second part have executed and
acknowledged this instrument for the purpose of evidencing their
assumption of and agreement to pay said mortgage and the agreement in
full as set ,forth herein.
AND the party of the first part cotenants that the party of the first part has not clone or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the patty of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyauce and will hold the right to receive such consid-
eration as a trust fund to he applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any pact of the total of the same for
