Instructions
This application must be filled in typewriter OR ink, and submitted in duplicate to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topographic featu res.
2. Final approval of Health Dept. of water supply and sewerage di~posal--(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and instatla-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of peoperty showing all property lines, s~reets, buildings and unusual natural or
topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent informa-
tion required to prepare a certificate.

Main Road, Southold, NY for a Variance to the Zoning Ordinance, Article
III, Section 100-31 and Bulk Schedule for permission to construct new
dwelling with insufficient front and side yard setbacks and exceeding the
maximum permitted 20% lot coverage. Location of Property: North side of
North Road, Southold, NY; bounded north by L.I. Sound; west by Bloom;
south by C.R. 48; east by McMann. County Tax Map Parcel 1000-44-2-15.
By this appeal, appellant seeks permission to construct a
new one-family dwelling with an insufficient frontyard setback
off County Road 48 of 15 feet, insufficient sideyard total of
25 feet, and exceeding lot coverage by approximately 96.50 square
feet. The total square footage of the proposed dwelling with
the rear deck is approximately 1296 square feet. The lot in
question contains an area of approximately 5997.50 square feet,
with 63.40 frontage along the county road and an average depth
of approximately 94 feet. Applicant has submitted a copy of
the Tidal Wetlands Permit issued by the N.Y.S. Department of
Environmental Conservation (#TW 15277-0146) which restricts
the location in which the new dwelling may be constructed to
be 15 feet from edge of the road. Applicant also notes that
he intends to construct the first floor 11 feet above mean sea
level in this V-8 Flood Area. Public water is available, and
approval was given by the Suffolk County Department of Health
Services for construction of a septic system on the south side
of the house (between the house and the road). Several of the
homes in this area are constructed at a similar distance from
the county road, and it is the feeling of the board that the
character of the neighborhood justifies the granting of the
relief requested.
In considering this appeal, the board determines that the
variance request is not substantial; that the circumstances
herein are unique; that by allowing the variance no substantial
detriment to adjoining properties would be created; that the
difficulty cannot be obviated by a method, feasible to appellant,
other than a variance; that no adverse effects will be produced
on available governmental facilities of any increased population;
that the relief requested will be in harmony with and promote the
general purposes of zoning; and that the interests of justice
will be served by allowing the varignce~

Code of the Town of Southold known as "Flood Damage Prevention Law" of the
Town of Southold. The applicant must submit approvals that any other
agency requires.

The applicant must submit plans and specifications as well as any other
information requested by the Building Inspector to substantiate the facts
that the structure has or will have the lowest floor, including basement/
cellar, elevated above the base flood elevation or; if permitted by the
Federal Regulation, that: 1. such structure is flood proofed in such
manner that below the base flood level the structure is water tight with
walls substantially and impermeable to the passage of water, 2. that
structural components are capable to resisting hydrostatic and hydrodynamic
loads and effects of buoyancy, 3. applicsnt must submit certification by
a registered professionalengmneer' or architect that the standards set
forth in Section 46-18B (1) (2) (3) of the Southold Code are satisfied.
~oa~tal High Hazzard area (V Zone) 46-19. 'Applicant shall submit plans,
specifications including-the required certifications and such other in-
formation as the Building Inspector may require in that ~he provisions of
46-19 are complied with. Mobile homes are prohibited. The lowest portion
of the structural members of the lowest floor cannot be lower than the
base flood elevation with all space below open except breakaway walls.
.Sand..dunes. If sand dunes exist on the premises and the applicant pro-
poses to alter same, plans and specification must be shown in detailed
nature of any alteration submitted.
· Building PeEnit. A Building Permit is also required for any structure.
Both a Develbpment and a Building Permit must be issued before any work
can start in a special flood~h~zzard zone. A written disapproval o~ a
permit must be issued within ten (10) working days.
During constru6tion, the inspector shall be notified in time so he may
make the required inspections.
Upon completion, the required certification fo the final elevations an~,
work must be submitted before the approval to use or occupy can be
approved.
