The lot in question has road frontage of 140 feet and a depth of 125 feet and was established prior to the change in rear and front yard setbacks from 35 to 50 feet. It is the feeling of the board that the relief requested is practical and reasonable under the circumstances, that same is within the character of the neighborhood and is within the spirit of the zoning ordinance. In considering this appeal, the board determines that the variance request is not substantial; that the circumstances herein are unique; that by allowing the variance no substantial detriment to adjoining properties would be created; that the difficulty cannot be obviated by a method, feasible to appellant, other than a variance; that no adverse effects will be produced on available governmental facilities of any increased population; that the relief requested will be in harmony with and promote the general purposes of zoning; and that the interests of justice will be served by allowing the variance. Existing on the premises are a one-family dwelling containing a living floor area of approximately 1839 square fe~t and porch area of approximately 406 square feet, and accessory garage with an area of approximately 504 square feet. The lot lin question has road frontage along the tie line of Clearwater ~ane of 174.34 feet, and an average depth of approximately 510 feelt. The practical difficulties in this situation are uniqueI and lends itself to the location of the dwelling approximatel:y 370 feet from the tie line at Clearwater Lane, leaving substantial front- yard area and minimal rearyard area. The Board agrees with reasoning of applicant.
