Instructions
A. This application must be filled in typewriter OR ink, and submitted in duplicate to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal--(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of peoperty showing all property lines, streets, buildings and unusual natural or
topographic featu res.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.

This is an appeal pursuant to Section 382 of the Executive
The Applicant has recently constructed a 2-story. one-
family dwelling (group A1 occupancy) of type 5 (wood frmme) con-
struction with the required opening for emergency use in the master
bedroom being deficient in area.
In a ruling dated Jut~ 16, 1980, the Building Department
of the Toga of Southold cited rio!etlon of the following sections of
the State Building Construction Code applicable to One and Two-
Family Dwellings:
9 NYCRR 615.1
9 NYCRR 615.2
(10-31-72) (Code Section A206-1)
(10-31-72) (Code Section A206-2)
A heating'was held on September 30, 1980, at the 60th
Floor Conference Room, Two World Trade Center, New York, New York.
At the hearing, the Applicant stated that if the Board of Review
granted a variance in this case he would agree to provide the
following atterngive:
In addition to the Code-required single station smoke
detector, provide a single station smoke detector in
the master bedroom.
The Board concludes that the fact that the bottom of the
window openings are only 1 foot above ~he floor level and 2'-6"
above grade, would not significantly impede emergency egress in ~
this cas?, and would prgvide safety to occupants on condition tha~
the Applzcant§ alternatzve were provided.
Therefore, the Board determines that the ruling of the
Building DepartmenU of the Town of Southold dated July 16~ 1980 be,
and the same hereby is, modified and the Appli%ant's 'regu~st for a
variance from the provisions of 9 h~CRR 615.1 (10-31-727 (Code -
Section A206-1) and 9 NYCRR 615.2 (10-31-72) (Code Section A206-2)
be, and the same hereby is, granted, on condition that the above-
described alternatives are provided.
This decision shall take effect immediately.

Dear Mr. Stahl: :
A Building Inspector inspected your dwelling being built under
~Building Permit No. 10587Z and found in the master bedroom no
opening for emergency use which shall be provided in a habitable
room in addition to the primary exit of the room. The largest
opening he found was 18,, X 22".
The opening for emergency use shall have a minimum area of 4
sq. ft., and a minimum dimension of 18" and the bottom not
over 3'6" above the floor. (Refer to the State Construction
Code A206-1 and A206-2".)
This must be corrected or an approval from the State Building
Construction Board of Review before the Certificate of Occupancy
can be issued for the use or occupancy of the dwelling.
