SCTM No. 1000-58-2-7. The proposed construction LOCATED WITHIN A FEMA VE FOOD ZONE El 13' is INCONSISTENT with LWRP Policies 4.1 (below) and therefore, INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The structures and entire property are located within the FEMA VE flood zone (Velocity Hazard El 13), and loss of property is highly probable due to storm event wave action. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. a. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The proposal to construct a single-family residence in a structural hazard area is inconsistent. Structures within these areas should be avoided or minimized. The proposal to breach the maximum 20 percent lot coverage is also unsupported by this policy. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Zoning Board of Appeals Consistency Review of the Town of Southold Code—a-ndL-o-cal---._.—_+..-_ Waterfront Revitalization Program (LWRP),standards dated October 2, 2008. The applicant obtained ,a Wetland Permit. (## 6450 dated Septe.liber 1202 2006) -from the Board 'of Southold Town Trustees to raise his existing dwelling on piles to conform to FEMA standards in the ,same location and remove the existing, decking, which was old and in,disrepair, and replace it in ,place and in .kind after the, house ,was raised, with the, condition that dry.wells and gutters be installed to contain roof run-off. The renovated house and deck-are landward of the coastal erosion hazard line, according to a survey by i9lin C. Ehlers; I:LS dated' 06-242005. The Board of Appeals believes ,that 'these measures mitigate the inconsistencies with the. LWRP standards: RELIEF REQUESTED: The applicant 'proposes to legalize an attached as built reconstructed elevated, deck measuring approximately 5.9.9' x 16.3' with steps and 'an elevated' walkway on the easterly.side of the house at a 35' setbackfor:ni the ordinary'high water mark of Long.Island;Sound. ADDITIONAL INFORMATION: The applicant stated .at the public hearing on December 4, 2005 'that ;he 'had ,not.included the deck ,on the plans he submitted to the Building 'Department to obtain a building permit 'and therefore had not received a Notice -of Disapproval for the, proposed new replacement deck. Moreover, he, diel not know that he ,needed .a setback ,variance from the 'Board of Appeals for the replacement since the Trustees had granted him permission.to rebuild it at the elevatedheight required by FEMA. IItEASONS FOR BOARD ACTION: On .the, basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: I. Town Law, X267-b(3)(1)(3)(I'). Grant of the, variance 'will rich. produce an undesirable change in the character of the.neighborhood or,a detriment to nearby properties. The •curr.ent elevated as-built deck, replaces a deck that had been existing .on the subject piroperty in the same location'for about 40 years< 2. Town -Law §267-b(3)(b)(2). 'The benefit sought .by .the applicant, cannot b& achieved by some method, feasible for the applicant to .pursue, other than an area variance because the existing house is set 'back approximately 46 feet at the closest, point frolh the .ordinary' T'ags'3--'December*04$ _ Charles, GRECETVYD2,B4#G218 ' CT1v16$-2=b SEP 16 2022 high water mark,. Therefore, any deck on tlaie. seaward ,sidoucl3ord or Appeals `require,a variance. 3. ;Town Law §267-b(3)Cki)(3). REASONS'FOR BOARD ACTION .On the basis of testimony presented; materials submitted and personal inspections, the Board makes the following findings: 1. Town Law§267•bGrant-of'the variances wilUnof produce an undesirable change in the character of the neighborhood ora, datriment:to nearby properties. 'The properties on Leeton Drive.along Long Island Sound are typically similar io,the applicant's in that'many are small,'non-conforming parcels improved with dwellings originally built as summer cottages. Many have excessive.lot coverage and wood.decking right up to the wood bulkhead(there is.no bluff in this section of the Sound). The.applicant.is not proposing to enlarge the existing dwelling, but rather to. make 'in kind and in,place-structural repairs that will maintain the .pre-existing non=conforming setbacks,,:The alteration to the existing root is proposed-to remedy persistent leaking and improve the appearance of tfie dwelling. The as built hot tub is a smal(temporary..accessory structure that provides an amenity for the.homeowners., 2 Town Law§267-bQ(b)(2)..me benefit sought by the applicant cannot be achieved by some melhod, feasible for the,,applicant to pursue;:other than an area variance because the pre-existing setbacks'were.established, prior to zoning and any additions or,alterations wiil increase the degree.of nonconformance, triggering the Walz decision and requiring a variance. 3. Town Law§267-b(Ub)(3). The setback variances granted herein are not substantial in so far,as they are not changing any existing :setbacks. While'the proposed lot coverage is a substantial;variance, 'it is typical in;the appl'icant's neighborhood,; 4, Town Law §267-b(3)(b}(5}: The difficulty has not, beets self-created, but 'is the'resuit Of pre-existing non- conformities 5. Town Law §267-ti3 b 4 ;No evidencie has been submitted to suggest that a variance in this residential community, will have an adverse impact on the physical ,or environmental conditions in,the neighborhood. The property is protected bg a bulkhead that is In excellent condition, there is no.bluff, and the wood decks and walkways, are pervious structures on sand with no drainage problems: RECEIVED - PB $:-may 2812oas, SEP . 2022 ZBA#6242—,R.and R M !Io CTM 58.2-13 Zoning Soo rd of appeals 6:!, own Law 257-b. brant of the:requested'retial AS AMENDED is the tmnirriurh action necessary and adequate to enable the, applicants".to enjoy the benefit.of structural repairs to their.kisting dwelling, stairs, and deems, while preserving and protectirtg.ihe character of.the nel4;hborhood'and the.health,safety.and wrelfare.ot the community.
