Instructions
A. This application must be filled in typewriter OR ~nk, and submitted in DUPLICATE to the Building
Inspector with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property hnes, streets, and
unusual natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal--(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters,
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and
installations, a certificate of Code compliance from the Architect or Engineer responsible for
the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1 Accurate survey of property showing oil property lines, streets, buildings and unusual natural
or topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent in-
formation required to prepare a certificate.

ZONING BOARD OF APPEALS
After investigation and inspection, the Board! finds
that applicants are requesting permission to const, ruct
dwelling with insuff%cient sideyards, 9.95 on the east
and 15.5 on the west, totalling 25 for both sides.I Upon
inspection, the Board has found that the subject ~remises
is 75 feat wide at the north end, and 117.95 feet Mide
at the south end. The Board has been advised tha~ the
Department of Environmental Conservation is restricting
the subject dwelling to be located not closer tha~ 87
feet from the tie line. The Board has found upon,further
lnvestmgat~ n that on May 23, 1974 a variance wasigranted
approving the insufficient area and width of the Subject
lot, with the condition that the sideyards shall ~ot be
less than 25 feet, 10 on one side and 15 on the o~her.
The Board agrees with the reasoning of the applicant,
except that the sideyard restriction of 10 and 15,on
the sides will remain the same.
The Board finds that the circumstances preseht in this
oase are unique, and that strict application of the ordinance
would produce practical difficulties or unnecessary hardship.
The Board believes that the granting of a var~anc~ in this
case will not change the character of the neighborhood and
will observe the spirit of the ordinance.
On motion by Mr. Grigonis, seconded by Mr. Tuthill, it
was
RESOLVED, that FRANK and JACQUELINE WEBER, b~ GRANTED
a Variance to the Zoning Ordinance, Article iii, Section
100-31 for permission to 'construct dwelling with insuffi-
cient sideyards and setbacks, SUBJECT TO THE FOLLQWING
CONDITION: ,
That the sideyards shall not be less than 10 foot on
one side and 15 on the other; and not less than ai total of
25 feet for both.
