That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. Our design for this project is based on the following design criteria: - 1. We have provided for the drainage for the runoff for the main building as well as the garage, outdoor shower and for the pervious driveway. - 2. The drainage was designed for a ten year storm event, 2" rainfall. - 3. The drainage calculations use a Runoff Coefficient of 1.0 for the roof outdoor shower and the pervious gravel driveway. This runoff Coefficient was used in the driveway area to account for the slopes encountered in the design. - 4.The bottom of the drywells are set 2'minimum above the ground water elevation. - 5. The grading retained and regraded areas proposed are the minimum required to install the sanitary system as per the Suffolk County Health Department regulations. We have tried to minimize the amount of disturbance to install the driveway and parking area. This has resulted in a driveway with a maximum slope of 17%. We do not see a way of reducing this slope. The regrading was designed with the attempt to minimize excavation, fill, destruction of natural vegetation and to not exceed the existing grade slope. BASIS OF APPLICATION: Request for a Variance from Article XXII, Section 280-116A(1) and Building Inspector's May 6, 2022, Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling; 1) located less than the code required 100 feet from the top of the bluff; located at: 100 Salt Marsh Lane (Adj. to Long Island Sound) Peconic, NY. The existing three-bedroom dwelling with basement to remain with interior renovations. ADDITIONAL INFORMATION: During testimony by the applicant's agent, it was stated that the proposed work is to replace the existing deck in the same location as the original. There was a previous roof over the deck which was removed approximately one year ago due to storm damage. It should be noted that according to the current site plan, the dwelling, at its closest point, is setback 29 feet from the top of the bluff which had received a Pre-C/O # Z12348, dated March 13, 1984. The neighborhood has many dwellings constructed prior to the Town's adoption of bluff setbacks, although two nearby properties have benefited from bluff setback relief. In 1990, relief was granted for construction of a new dwelling and waterside deck located only 5 feet from the top of the bluff on the adjacent property to the west. (Appeal No. 3968). In Appeal No. 4099,the applicant's deck is setback 26 feet from the top of the bluff. There were other properties to the west that have been given bluff setback relief that is more than what the applicant is asking for. The applicant has proposed a 1,035 sq. ft. non-turf buffer along the top of the bluff, will be removing an existing slate patio, and proposes the installation of a new Innovative Advanced (I/A) sanitary system and stormwater runoff system. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 6, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(I). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Granting this relief would not change the character of either of the two neighborhoods surrounding the property, neither that to the west, which is represented by dwellings located on high elevations landward of the bluff, nor that to the east, which is represented by properties without a bluff, where dwellings are located much closer to sea level and Long Island Sound. Also,the proposed new deck is within the same footprint as the existing with a proposed pergola above instead of the previous existing roof. The property also conforms to all the current setbacks in the bulk schedule. Therefore, there is no change to the character of the neighborhood. 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicants are seeking to replace an aging waterside deck,without the historically existing roof that was recently removed due to severe weather damage.The deck cannot be replaced without the benefit of variance relief. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 59% relief from the code. However, it is not substantial since the proposed deck is to be constructed in the same footprint as the existing deck, with a pergola above instead of the previously existing roof. Thus, there is no change to the pre- existing bluff setback. 4. Town Law V67-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed improvements are LWRP Consistent and the applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this Board. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. However, it is reasonable to assume that an exterior deck existing in a coastal environment for more than 60 years will eventually need to be replaced. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new exterior deck with pergola above while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Lehnert, seconded by Member Dantes, and duly carried, to GRANT the variance as applied for, and shown on the site plan prepared by Steven Maresca, LPE, last revised July 26, 2022, and Architectural Plans prepared by Meryl Kramer, Architect, last revised March 15, 2022. I i WETLANDS APPLICATION ADDENDUM STATEMENT OF EFFECT FOR DEBORAH L.McKEAND& SHANNON GOLDMAN 100 SALT MARSH LANE PECONIC,NY SCTM#1000-68-3-11.1 The proposed scope of work consists primarily of the reconstruction of an existing deck; installation of an outdoor shower; replacement of an existing driveway; construction of a 1-story accessory garage; and installation of a new 3-bedroom I/A OWTS sanitary system in conjunction with interior renovations to an existing 1-story single family dwelling. Based on their design and/or associated mitigation meaures, none of these activities would cause any adverse impacts to the adjacent bluff, beach, or tidal waters on the north side of the property or to the lake and associated freshwater wetlands on the south side of the property. Rather, for the reasons listed below, the proposed project will result in a net improvement to the site's environmental condition and will be consistent with the LWRP Policy 4, 5 and 6 goals of minimizing potential losses from flooding and erosion; protecting and improving water quality; and protecting and restoring the quality and function of Town of Southold ecosystems. 1) The toe of the bluff, which is stable and well vegetated, is located almost 300 feet from the surface waters of Long Island Sound, and the deck to be replaced is located more than 300 feet from surface waters. The deck is also situated farther from the top of bluff than the existing habitable dwelling footprint to remain and will be replaced in the same footprint, with no expansion in size or reduction to the existing bluff setback. 2) A stormwater drainage system is proposed to capture and recharge runoff from the existing dwelling, proposed garage, proposed driveway, and proposed outdoor shower, which will be installed over a pervious gravel bed and piped to the proposed drainage system. 3) The existing conventional septic system will be removed and replaced with a low-nitrogen, I/A sanitary system consisting of an I/A OWTS located at least 65 feet from the top of bluff. Unlike conventional systems that are not designed or equipped to treat nutrients such as nitrogen, I/A systems are designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters. 4) As the accessory garage is proposed more than 100 feet from both the top of bluff to the north and freshwater wetlands to the south, the only work proposed within 100 feet of wetlands is the replacement of a 2,120 sf impervious asphalt driveway, which slopes toward Autumn Lake, with a pervious gravel driveway located more than 100 feet from wetlands. Based on their design and/or associated mitigation meaures, none of these activities would cause any adverse impacts to the adjacent bluff, beach, or tidal waters on the north side of the property or to the lake and associated freshwater wetlands on the south side of the property. Rather, for the reasons listed below, the proposed project will result in a net improvement to the site's environmental condition and will be consistent with the LWRP Policy 4, 5 and 6 goals of minimizing potential losses from flooding and erosion; protecting and improving water quality; and protecting and restoring the quality and function of Town of Southold ecosystems. 1) The toe of the bluff, which is stable and well vegetated, is located almost 300 feet from the surface waters of Long Island Sound, and the deck to be replaced is located more than 300 feet from surface waters. The deck is also situated farther from the top of bluff than the existing habitable dwelling footprint to remain and will be replaced in the same footprint, with no expansion in size or reduction to the existing bluff setback. 2) A stormwater drainage system is proposed to capture and recharge runoff from the existing dwelling, proposed garage, proposed driveway, and proposed outdoor shower, which will be installed over a pervious gravel bed and piped to the proposed drainage system. 3) The existing conventional septic system will be removed and replaced with a low-nitrogen, I/A sanitary system consisting of an I/A OWTS located at least 65 feet from the top of bluff. Unlike conventional systems that are not designed or equipped to treat nutrients such as nitrogen, UA systems are designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters. 4) As the accessory garage is proposed more than 100 feet from both the top of bluff to the north and freshwater wetlands to the south, the only work proposed within 100 feet of wetlands is the replacement of a 2,120 sf impervious asphalt driveway, which slopes toward Autumn Lake, with a pervious gravel driveway located more than 100 feet from wetlands. The driveway replacement will thus eliminate all developed and impervious surfaces from within 100 feet of wetlands and create a potentially substantial decrease in stormwater runoff toward the lake. 5) The existing 210 sf grade level slate patio situated adaj cent to the top of bluff will be removed. 6) A 5 to 10 foot wide, approximately 1,035 sf non-turf buffer is proposed along the top of bluff and bank. 7) A project-limiting fence will be installed to contain site disturbance and limit runoff during construction. -SEE ATTACHED ADDENDUM- Attach additional sheets if necessary Policy 7.
