Instructions
A. This application must be filled in typewriter OR ink, and submitted in duplicate to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal-(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of peoperty showing all property lines, streets, buildings and unusual natural or
topographic featu res.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent informa-
tion required to prepare a certificate,

Planning Board at a special meeting held April 21, 1980.
RESOLVED to approve the site plan of the~proposed
Mattituck Library expansion, said plan dated March 5,,.1980
and revised April 8, 1980, and including fence around
eliptical pond subject to a one year review.

§ 100-144. Certificates of occupancy.
~. A certificate of occupancy shall be applied for from the
Building Inspector and it shall be unlawful to do any of the
following until a certificate of occupancy is issued therefor,
to wit:
{1) Occupancy and use of a building erected, recon-
structed, restored, structurally altered or moved, or
any change in use of an existing building.
12) Occupancy, use or any change in the use of any land.
(3) Any change in use of a nonconforming use.

certificate of occupancy for which a special exception,
special permit or site plan approval has been granted, or in
cmmection with which a variance has been granted by the
Board of Appeals, shall contain a detailed statement of any

C. Application for a certificate of occupancy for a new
building or for an existing building which has been altered
shefll be made after the erection of such building or part
thereof has been completed in conformity with the
provisions of this chapter, and, in the case of a new
building, shall be accompanied by an accurate plot plan, or
if not available, by a survey prepared by a licensed land
surveyor or engineer, showing the location of the building
as built. Such certificate shall be issued within ten (10)
days after receipt of the prop~,rly completed application,

C. Should any site plan approval involve any matter requiring
referral to the Suffolk County Planmng Commission, then
the matter shall be referred, prior to final action by the
Planmng Board, to the Suffolk County Planning Com-
missmn in accordance with the applicable provisions of
law.
§ 100-13;I Procedure.
A. Presu[nmssion conference. Prior to the submission of a site

SUBJECT: Mattituck Library Addition.
Dear Mr. Hindermann:
The reason for your denial of a Temporary Certificate of Occupancy,
dated August g6, 1980, is unjustified.
Your stated reason for the denial is the lack of final approval of the
site plan, but we do have an approval site plan. A copy of this approval
is on file with your office, as well as a letter of approval from the
Planning Board, dated April 23, 1980. As a matter of fact, the building
permit would not have been issued without an approved site plan.
Please be advised that you are now causing operating hardship, as well
as a financial impact on the contractors~ not to mention the additional
effort on my part and the Library Board.
therefore, strongly suggest that you reconsider your decision. I
am sure that upon review you will see fit to issue the permit requested.

I am enclosing herewith sections of the Southold Town Zoning
ordinance that cover certi£icates o£ occupancy.

requires a site plan for a building permit. Subsection "B"
requires that land be developed in accordance with the approved
site plan before a certificate of occupancy is issued.

Dear Mr. Fisher:
The following action, was taken by the Southold Town Planning
Board at a regular meeting held November 3, 1980.
RESOLVED to approve the amended site plan of the Mattituck
Free Library indicating four parking spots in front of the
library, two spots for the handicapped alongside with the
remainder in a 70' by 70' area to the rear and west of the
library. The Planning Board requests that the building
inspector issue a temporary certificate of occupancy for one
year for the work to be completed on the parking area in the
rear.

Dear Mr. Raynor:
I am writ,ng to clarify the position of our Board of Trustees, regarding the
completion of our expansion project.
When the project was approved by the Library Board, in the fall of 1979, we had
an estimate from our Project Engineer for the building and site improvements.
This esiimate exceeded our available funds, but we choose to go ahead anyway
with the idea lhat more money would be forthcoming.
Because we felt that the parking requirements were excessive for the intended
use, we attempted, unsuccessfully, to eliminate them through the Board of Appeals.
Finally, at the Sonthold Town Planning Board Meeting of April 7, 1980, where the
site plan was discussed, we then e:ipressed our feelings about the parking lot and
the fact that we would not have sufficient funds to complete. The Planning Board
eluded to and mentioned that we would be given some relief to the extent that we
would be allowed time to complete all the site improvements. The indication was
tha~t we could use the building under a temporary Certificate of Occupancy, until
we could complete the outside work.
In August of 1980, we applied for and were denied the temporary Certificate of
Occupancy by the Building Inspector, because we could find no written record of
the statements made at the aforementioned Planning Board meeting to substantiate
our request. Mr. Fisher, the Chief Building Inspector, said that he would issue
a temporary Certificate of Occupancy with Planning Board concurrence.

In a recent informal discussion between you and Mr. Tsontakis, you ~ndicated
that ~t was the intent of the ]Planning Board to grant such relief. As such, we
need to obtain relief on the completion of the site work, vis. , the parking lot,
until we can raise more money. In the interim, that area designated for parking
in the site plan will be a grass field, and could be used for parking, with access
frown the existing driveway.
