FINDINGS,DELIEERATIONS AND DETERMINATION MEETING OF OCTOBER 20,2022 ZBA FILE: #7693 NAME OF APPLICANT: Cutchogue Fire District PROPERTY LOCATION: 260 New Suffolk Road, Cutchogue,NY SCTM: 1000-102-6-5 SEQRA DETERMINATION: The Southold Town Zoning Board of Appeals pursuant to the State Environmental Quality Review Act(SEQRA) declared itself Lead Agency in regards to the application of the Cutchogue Fire Department located at 260 New Suffolk Road, Cutchogue,NY, SCTM: 1000-102-6-5 and adopted its findings on August 18,2022,finding that the application of the Cutchogue Fire Department is classified as an Unlisted Action pursuant to SEQRA Rules and regulations and authorized the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. On September 1, 2022, the Southold Town Zoning Board of Appeals, by resolution, accepted the Board's State Environmental Quality Review Act determination, dated July 13, 2022 and revised August 5, 2022, that this Action will not have a significant adverse impact on the environment and Granted a Negative Declaration. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 24, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION:The relief,permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject,non-conforming, irregular-shaped, 19,697 square feet, .4522 acre parcel located in the HB (Hamlet Business) District measures 172.68 feet along New Suffolk Road(also known as C.R. 26),then runs west, along an easement on the adjacent commercial parcel, 55.26 feet,then runs north 26.67 feet,through the same easement and along two commercially developed parcels, and continues west 37.87 feet along the same neighbor,then runs south, 10.00 feet and continues southwest 65.00 feet along a third commercially developed parcel,then runs south along a slight curvature 38.00 feet, 55.64 feet, and continues 50.10 feet along two additional commercially developed parcels and returns 100.00 feet to the roadway. Gallas, Licensed Professional Land Surveyor, and dated February 9, 2022. BASIS OF APPLICATION: Request for Variances from Article X, Section 280-46 and Building Inspector's May 11, 2022 Notice of Disapproval based on an application for a permit demolish (as per Town Code Definition) and reconstruct a firehouse; 1) located less than the code required minimum front yard setback of 25 feet; 2) located less than the code required minimum rear yard setback of 25 feet; 3) ) more than the code permitted maximum lot coverage of 40%; 4) less than the code required minimum landscape area of 25%; at: 260 New Suffolk Road, Cutchogue,NY. SCTM No. 1000-102-6-5. RELIEF REQUESTED: The applicant requests six(6)variances, including: reduced front yard setback of 8.5 feet where the Code requires a minimum front-yard setback of 15 feet;reduced single-side yard setback of 8.63 feet where the Code requires a minimum single-side yard setback of 10 feet; reduced combined side-yard setback of 22.63 feet where the Code requires a minimum combined side-yard setback of 25 feet; reduced rear-yard setback of 9.6 feet where the Code requires a minimum rear-yard setback of 25 feet; excessive lot coverage of 55.3% where the Code limits lot coverage to a maximum of 40%; and reduced landscape area of 14.4% where the code requires a minimum landscape area of 25%, in order to demolish (as per Town Code definition) an existing two-story firehouse and basement with a footprint of approximately 9,903 square feet and reconstruct in its place a two-story multi-bay firehouse and no basement with a footprint of approximately 10,772 square feet including a radio-room dispatch bay window. ADDITIONAL INFORMATION: No member of the public or immediate neighbor spoke in favor of or against this application. The applicant owns the parcel immediately across New Suffolk Road from the subject parcel. The second site is known as SCTM No. 1000-102-6-11.1 and is approximately 122,240 square feet or 2.8062 acres. The parcel is presently partially paved with asphalt and used for parking and is also improved with a variety of service buildings. There is extensive lawn and landscape areas. The subject parcel is covered by the following Certificates of Occupancy: • Z-3219 dated May 21, 1968 covering a fire house(public building) • Z-5795 dated February 14, 1974 covering a municipal firehouse with addition • Z-7301 dated October 15, 1976 covering a public building firehouse with addition • Z-20405 dated December 11, 1991 covering an addition to an existing firehouse • Z-35710 dated May 24, 2012 covering upgraded fire system in firehouse kitchen The original firehouse dates from 1928 and has been in continuous use. The applicant will maintain in its current state, as part of the site's redevelopment,the 1991 two-story brick structure on the southern end of the property and incorporate it into the proposed new,multi-bay,two-story brick, steel-frame non-combustible, firehouse. The additions to the north of the 1991 structure, including all wood-frame buildings, will be demolished and the basement underneath will be filed in. The applicant does not propose a basement in the new structure. A dispatch window, on the ground floor front fagade is Page 3 October 20,2022 #7693 Cutchogue Fire District SCTM No. 1000-102-6-5 incorporated into the design to allow clear sightline for fire engine and truck access to the proposed deeper truck bays, accommodating larger and longer equipment. Pursuant to Article X, Section 280-45A(3)the Town of Southold Planning Board Site Plan approval is not required for the proposed action. The applicant provided a site plan and architectural plans, including first and second floor plan and front elevation drawn by Raymond W.Nemschick, Registered Architect, labeled PP-1, A-1, A-2, and A-3, and dated February 9, 2022. These plans include a Site Data table illustrating Town of Southold zoning requirements; existing conditions, including six non-conforming improvements: an existing front yard setback of 11.5 feet,an existing side yard setback of 8.63 feet, an existing combined side yard setback of 22.63 feet, an existing rear yard setback of 15.6 feet, a landscape area of 8.8% and existing lot coverage of 50.9%; and proposed conditions, including no change to an existing side yard setback of 8.14 feet and no change to the combined side yard setback of 22.14 feet. Four proposed changes to existing conditions include: a front yard setback of 8.5 feet to accommodate the Radio Room/ Dispatch Bay window for increased sightlines, a reduced rear yard setback of 9.63 feet to accommodate deeper building depth for increase garage bay storage of equipment, an increase in landscape area of 14.4% from the pre-existing lower amount and an increase in overall lot coverage of 55.3%triggered by the proposed reconstruction. The purpose of the demolition and reconstruction of the firehouse is to bring it into better conformity with modern firefighting, dispatch and first-responder needs. In addition to creating better flow for quicker response times,the new floorplan will include deeper garage bays to accommodate longer fire suppression equipment and trucks and a Radio Room with a bay window allowing increased sightlines. The proposed second floor includes a variety of offices for volunteer,staff and officers,community room(s),a lounge and small dormitory. A Bond Vote, authorizing the proposed demolition and reconstruction of the firehouse, was ratified by the Cutchogue Fire District. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 6, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Adjacent properties are primarily business uses with related parking areas. The proposed fire station will replace an existing firehouse that has stood at this location since 1928. While the building was substantially increased in size over the past century, the new firehouse will be similar in footprint size, height and massing. Other than a cohesive and uniform new facade design, few members of the public or passersby will notice any change to the streetscape. 2. Town Law§267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The current firehouse, other than the addition built in 1991 (south side of subject parcel, two-story brick building) which is proposed to remain Page 4 October 20,2022 #7693 Cutchogue Fire District S CTM No. 1000-102-6-5 and be incorporated into the new structure does not meet modern and current firefighting needs. The structure is wood frame, deteriorated and in need of substantial repair. Renovating an existing and inferior structure and attempting to add a second story to it, will be costly and without the benefit of current, steel frame non-combustible construction,nor will it function in the same way as a new building. 3. Town Law&267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 56.6% relief from the code relative to a reduced front yard setback, 86.3% relief from the code relative to a reduced single side yard setback, 90.5% relief from the code relative to a combined side yard setback, 38.4%relief from the code relative to a reduced rear yard setback, 15.3%relative to excessive lot coverage and 10.6% relief from the code relative to reduced landscape area. However,the original structure's front yard setback is 11.5 feet and the applicant proposes to maintain that except for a small,bay window addition to the front fagade, accommodating a Radio Room Dispatch office that will allow clear sightlines to the various garage truck bays. The applicant also proposes to maintain the pre-existing non-conforming side yard and combined side yard setbacks as part of the redevelopment of the site. However, they propose to expand the building's depth, thereby reducing a pre-existing non-conforming rear yard setback to better accommodate the storage of firefighting equipment and trucks in deeper/longer bays. As a result of the proposed design changes to the building, the non-conforming lot coverage will be increased, but the existing non-conforming landscape area will be increased and therfore more code conforming. 4. Town Law§267-b(3)(b)(4).No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the visual impact will be largely the same as the existing firehouse. 5. Town Law $267-b(3)(b)(5). The difficulty has not been self-created. The property was originally developed nearly one-hundred years ago, long before current zoning was in place,and has consistently been used as a firehouse, a benefit to the entire community. 6.Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a reconstructed firehouse with a non-conforming front yard setback, single-side yard setback, combined side-yard setback, rear-yard setback, excessive lot coverage, and non- conforming landscape area, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairperson Weisman, seconded by Member Planamento and duly carried,to GRANT the variances as applied for, and shown on the site plan and architectural plans, including first and second floor plan and front elevation drawn by Raymond W.Nemschick,Registered Architect, labeled PP-1,A-1,A-2, and A-3, and last revised June 9, 2022. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, siteplan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. The Southold Town Zoning Board of Appeals, as lead agency, has determined that the proposed action described below will not have a significant effect on the environment and a Draft Environmental Impact Statement will not be prepared. Name of Action: Cutchogue Fire District SCTM# 1000-102-6-5 Location: Cutchogue, New York SEAR Status: Type I ( ) Unlisted (X) Conditioned Negative Declaration: Yes ( ) No (X) Description of Action: State Environmental Quality Review Determination for Funding, Partial Demolition, Renovation and Replacement of Cutchogue Fire Station, Cutchogue, New York Reasons Supporting This Determination: 1. Impact on Land A Short Environmental Assessment Form has been submitted and reviewed. The determination was based upon the following: SEQRA Ne. re Declaration - Page 12 —July 13, 2' The .452 acre parcel is located in the Cutchogue Hamlet Center and provides critical emergency community services. Residential uses occur to the south and commercial uses to the north, east, and west of the parcel. Zoning The parcel is currently improved with.a fire department building and is zoned Hamlet Business (HB). The purpose of the.HB zoning district is defined as: "The purpose of th.e Hamlet Business (HB) District is to provide for business development in the hamlet central business areas, including retail, office and service uses, public and semipublic uses, as well as hotel and motel and multifamily residential development that will support and enhance the retail development and provide a focus for the hamlet area" The building was used for fire protection since 1928. The proposed fire station will match the current side yards; the front fagade will match the current fagade line with an addition of a walk-out bay for visibility from the radio room. The rear yard will be reduced a further 6' from the existing building. A Notice of Disapproval was issued by the Building Department on May 11, 2022 for the setbacks and lot coverage. The action is before the Zoning Board of Appeals for a determination. The building and department is the only one serving the Cutchogue Fire District. The building lot coverage size will increase from 9,903 sf to 10,772 sf. The maximum lot area coverage in the HB zone is 40 percent; 55.3 percent is proposed. This is expected due to a large amount of space fire departments require to provide indoor storage of vehicles and equipment and provide sufficient support areas for personnel. The proposed lot coverage will not impact the viewshed of the streetscape and is not discordant with the surrounding community character of commercial uses. The use is permitted within the zone. The renovation of thefire station will replace a building that requires significant repairs. The proposed action and use do not conflict with the zoning district, surrounding uses, or the character of the community. No adverse impact on land is expected to occur as a result of the action. 2. Impact on Geological Features The parcel does not contain nor is it adjacent to any unique geologic features. 3. Impact on Water The subject site is located within Suffolk County Department of Health Services (SCDHS) Groundwater Management Zone IV, which according to Article 6 of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas served by public water. 1. Water Supply SEQRA Ne' `ie Declaration - Page 13 —July 13, 2( Public water serves the parcel. No change to the existing water service line is expected. 2. Sanitary Disposal The total amount of sanitary waste (expressed in gallons per day) is not expected to significantly increase as a result of the action. The applicant is proposing to upgrade the existing sanitary wastewater system with the installation of an Innovative Alternative On-site Wastewater Treatment System (I/A OWTS) to comply with Suffolk County's requirement to minimize adverse impacts to groundwater quality. The total nitrogen effluent is expected to be less than 19mg a liter with the installation of an I/A OWTS. 4. Impact from Flooding The structures will be located outside of the FEMA 0.2-percent-annual-chance (or 500-year) mapped flood zone. SLOSH modeling indicates that the parcel would also not be affected by hurricane storm surges. The SLOSH (Sea, Lake, and Overland Surges from Hurricanes) model is a numerical model used by National Weather Service to compute storm surge. Storm surge is defined as the abnormal rise of water generated by a storm, over and above the predicted astronomical tides. Flooding from storm surge depends on many factors, such as the track, intensity, size, and forward speed of the hurricane and the characteristics of the coastline where it comes ashore or passes nearby. For planning purposes, the National Hurricane Center uses a representative sample of hypothetical storms to estimate the near worst—case scenario of flooding for each hurricane category (NOAA). The adverse impact from flooding of the parcel is low. 5. Impact on Air Air pollution can harm human health, and damage elements of the ecosystem. Exposure to air pollution is associated with numerous effects on human health, including pulmonary, cardiac, vascular, and neurological impairments. No significant emissions from the use are proposed. No substantial adverse change in existing air quality is expected to occur. 6. Impact on Plants and Animals The site is currently improved;the majority of the parcel is covered in impervious materials and the addition to the structure will not impact wildlife or physically destroy existing habitat. The parcel is not located within a Significant Coastal Fish and Wildlife Habitat Area. The NYSDEC Environmental Mapper also indicates that the parcel is not located within a Significant Natural Communities or Rare Plants and Animal area. No significant removal or destruction of large quantities of vegetation will occur as a result of this action. Impact on Agricultural Land Resources The parcel is improved and not farmed. The parcel is not currently in agricultural production, therefore, no adverse impacts to agricultural lands or soils will occur. 8. Impact on Aesthetic Resources The building is visible from New Suffolk Avenue. An existing parking area located in the front yard is proposed to be removed. A new parking area is proposed on the west side of the building. The view of the structure from users of New Suffolk Avenue is proposed to remain largely unchanged with an addition on the rear. No moderate to large adverse impacts on aesthetic resources are expected to occur. 9. Impact on Historical and Archeological Resources The fire station is substantially contiguous to a home listed on the National Historic Register (01NR01751) Name: Wells, Joshua, House (Fleet-Gold-Kendrick House) and four properties eligible for listing located along NYS Route 25. The action was considered to be classified as a Type I action due to the proximity to the listed and eligible properties, however, the action must also exceed 25 percent of any Type I threshold. The proposed action does not exceed any 25 percent threshold. No moderate to large adverse impacts on important historical or archaeological resources are expected. 10. Impact on Open Space and Recreation The parcel is privately owned. No significant impacts on public open space or recreational areas will occur as a result of this action. 11. Impact on Critical Areas The parcel is not located within a New York State Department of Environmental Conservation (NYSDEC) Critical Environmental Area. 12. Impact on Transportation No significant change in vehicle trip generation or traffic patterns over existing conditions is expected. Parking for the facility is located across the street and is connected by a crosswalk leading to the station. Parcel Access The parcel is accessed from New Suffolk Avenue; a collector road. SEQRA Ne. ae Declaration - Pagel 5 —July 13, 2'_ There is a limited sidewalk in front of the parcel, no sidewalks are located in front of the bay doors where fire equipment is stored for use. Sidewalks do occur to the south and north of the parcel. No alteration to existing pedestrian infrastructure is proposed or will occur. 13. Impact on Energy No adverse moderate to large impacts on the quantity or type of energy will occur. 14. Impact on Noise, Odor and Light No adverse, substantial change in noise or odor is expected will occur. Lighting on site will comply with Chapter 172. Lighting, Outdoor in the Southold Town Code and will not adversely impact adjacent properties or the night sky. The lighting details will be finalized in during the site plan review process (if required). 15. Impact on Human Health No creation of hazard to human health is expected to occur. Future site improvements and stormwater control will be required to comply with Chapter 236 Stormwater Management of the Southold Town Code. 16. Consistency with Community Plans The proposed action is not in conflict with the Southold Town Comprehensive Plan (2020) The action is consistent with community plans. The fire station provides a critical community service. 17. Consistency with Community Character The character of the community is established by a mix of commercial and residentia] uses. As discussed above the proposed action is not discordant with the existing character of the Hamlet of Cutchogue. Based upon such, no significant adverse impacts to the environment are expected to occur should the project be implemented as planned. The following represents our rationale. 1. According to the DEC,the first step is to determine if the Action requires no further review under SEAR as a Type II Action. a. The DEC instructions state to check to see if the project could be listed as a Type II Action. If the action is not on the Type II list in Section 617.5(c) (of 6 CRR-NY), it is either a Type I Action or an Unlisted Action. b. ADDITIONAL INFORMATION: No member of the public or immediate neighbor spoke in favor of or against this application. The applicant owns the parcel immediately across New Suffolk Road from the subject parcel. The second site is known as SCTM No. 1000-102-6-11.1 and is approximately 122,240 square feet or 2.8062 acres. The parcel is presently partially paved with asphalt and used for parking and is also improved with a variety of service buildings. There is extensive lawn and landscape areas. The subject parcel is covered by the following Certificates of Occupancy: • Z-3219 dated May 21, 1968 covering a fire house(public building) • Z-5795 dated February 14, 1974 covering a municipal firehouse with addition • Z-7301 dated October 15, 1976 covering a public building firehouse with addition • Z-20405 dated December 11, 1991 covering an addition to an existing firehouse • Z-35710 dated May 24, 2012 covering upgraded fire system in firehouse kitchen The original firehouse dates from 1928 and has been in continuous use. The applicant will maintain in its current state,as part of the site's redevelopment,the 1991 two-story brick structure on the southern end of the property and incorporate it into the proposed new,multi-bay,two-story brick, steel-frame non-combustible, firehouse. The additions to the north of the 1991 structure, including all wood-frame buildings, will be demolished and the basement underneath will be filed in. The applicant does not propose a basement in the new structure. Pursuant to Article X, Section 280-45A(3)the Town of Southold Planning Board Site Plan approval is not required for the proposed action. The applicant provided a site plan and architectural plans, including first and second floor plan and front elevation drawn by Raymond W.Nemschick,Registered Architect, labeled PP-1,A-1,A-2, and A-3, and dated February 9,2022. These plans include a Site Data table illustrating Town of Southold zoning requirements; existing conditions, including six non-conforming improvements: an existing front yard setback of 11.5 feet, an existing side yard setback of 8.63 feet, an existing combined side yard setback of 22.63 feet, an existing rear yard setback of 15.6 feet, a landscape area of 8.8% and existing lot coverage of 50.9%; and proposed conditions, including no change to an existing side yard setback of 8.14 feet and no change to the combined side yard setback of 22.14 feet. Four proposed changes to existing conditions include: a front yard setback of 8.5 feet to accommodate the Radio Room/ Dispatch Bay window for increased sightlines, a reduced rear yard setback of 9.63 feet to accommodate deeper building depth for increase garage bay storage of equipment, an increase in landscape area of 14.4%from the pre-existing lower amount and an increase in overall lot coverage of 55.3%triggered by the proposed reconstruction. The purpose of the demolition and reconstruction of the firehouse is to bring it into better conformity with modern firefighting, dispatch and first-responder needs. In addition to creating better flow for quicker response times,the new floorplan will include deeper garage bays to accommodate longer fire suppression equipment and trucks and a Radio Room with a bay window allowing increased sightlines. The proposed second floor includes a variety of offices for volunteer,staff and officers,community room(s),a lounge and small dormitory. A Bond Vote, authorizing the proposed demolition and reconstruction of the firehouse, was ratified by the Cutchogue Fire District. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 6, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)M. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Adjacent properties are primarily business uses with related parking areas. The proposed fire station will replace an existing firehouse that has stood at this location since 1928. While the building was substantially increased in size over the past century,the new firehouse will be similar in footprint size,height and massing. Other than a cohesive and uniform new fagade design, few members of the public or passersby will notice any change to the streetscape. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The current firehouse, other than the addition built in 1991 (south side of subject parcel,two-story brick building)which is proposed to remain Page 4 October 20,2022 #7693 Cutchogue Fire District SCTM No. 1000-102-6-5 and be incorporated into the new structure does not meet modern and current firefighting needs. The structure is wood frame, deteriorated and in need of substantial repair. Renovating an existing and inferior structure and attempting to add a second story to it, will be costly and without the benefit of current, steel frame non-combustible construction,nor will it function in the same way as a new building. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 56.6% relief from the code relative to a reduced front yard setback, 86.3% relief from the code relative to a reduced single side yard setback, 90.5% relief from the code relative to a combined side yard setback, 38.4%relief from the code relative to a reduced rear yard setback, 15.3%relative to excessive lot coverage and 10.6%relief from the code relative to reduced landscape area. However,the original structure's front yard setback is 11.5 feet and the applicant proposes to maintain that except for a small,bay window addition to the front facade, accommodating a Radio Room Dispatch office that will allow clear sightlines to the various garage truck bays. The applicant also proposes to maintain the pre-existing non-conforming side yard and combined side yard setbacks as part of the redevelopment of the site. However, they propose to expand the building's depth, thereby reducing a pre-existing non-conforming rear yard setback to better accommodate the storage of firefighting equipment and trucks in deeper/longer bays. As a result of the proposed design changes to the building, the non-conforming lot coverage will be increased, but the existing non-conforming landscape area will be increased and therfore more code conforming. 4. Town Law V67-b(3)(b)(4).No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the visual impact will be largely the same as the existing firehouse. 5. Town Law X267-b(3)(b)(5). The difficulty has not been self-created. The property was originally developed nearly one-hundred years ago, long before current zoning was in place,and has consistently been used as a firehouse,a benefit to the entire community. 6.Town Law&267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a reconstructed firehouse with a non-conforming front yard setback, single-side yard setback, combined side-yard setback, rear-yard setback, excessive lot coverage, and non- conforming landscape area, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairperson Weisman, seconded by Member Planamento and duly carried,to GRANT the variances as applied for, and shown on the site plan and architectural plans, including first and second floor plan and front elevation drawn by Raymond W.Nemschick,Registered Architect,labeled PP-1,A-1,A-2, and A-3, and last revised June 9, 2022. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL.
