SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated June 16, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (L)VRP) Policy Standards.The LWRP Coordinator issued a recommendation dated September 15,2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a 110, 288 sq. ft. parcel located in an R-40 Zoning District.The property is an irregularly shaped lot located between Autumn Lake and Long Island Sound. The parcel measures 206.74 feet fronting the Long Island Sound along the northerly property line,627.27 feet along the westerly property line, 227.52 feet fronting Autumn Lake along the southerly property line and 617.24 along the westerly property line. The property is crossed by a private road know as Salt Marsh Lane. The property is improved with a I story frame dwelling located close to the edge of the bank facing Long Island Sound. BASIS OF APPLICATION: Request for a Variance from Article XXII, Section 280-116A(1) and Building Inspector's May 6, 2022, Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling; 1) located less than the code required 100 feet from the top of the bluff; located at: 100 Salt Marsh Lane (Adj. to Long Island Sound) Peconic,NY. SCTM No. 1000-68-3-11.1. Page 2,October 20,2022 #7682,Goldman-McKeand SCTM No. 1000-68-3-11.1 RELIEF REQUESTED: The applicant requests a variance for the construction of a deck approximately 41 feet from the top of the bluff where a minimum setback of 100 feet is required. The existing three-bedroom dwelling with basement to remain with interior renovations. ADDITIONAL INFORMATION: During testimony by the applicant's agent, it was stated that the proposed work is to replace the existing deck in the same location as the original. There was a previous roof over the deck which was removed approximately one year ago due to storm damage. It should be noted that according to the current site plan, the dwelling, at its closest point, is setback 29 feet from the top of the bluff which had received a Pre-C/O # Z12348, dated March 13, 1984. The neighborhood has many dwellings constructed prior to the Town's adoption of bluff setbacks, although two nearby properties have benefited from bluff setback relief. In 1990, relief was granted for construction of a new dwelling and waterside deck located only 5 feet from the top of the bluff on the adjacent property to the west. (Appeal No.3968). In Appeal No.4099,the applicant's deck is setback 26 feet from the top of the bluff. There were other properties to the west that have been given bluff setback relief that is more than what the applicant is asking for. The applicant has proposed a 1,035 sq. ft. non-turf buffer along the top of the bluff, will be removing an existing slate patio, and proposes the installation of a new Innovative Advanced (I/A) sanitary system and stormwater runoff system. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 6,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change_in the character of the neighborhood or a detriment to nearby properties. Granting this relief would not change the character of either of the two neighborhoods surrounding the property, neither that to the west,which is represented by dwellings located on high elevations landward of the bluff, nor that to the east, which is represented by properties without a bluff, where dwellings are located much closer to sea level and Long Island Sound. Also,the proposed new deck is within the same footprint as the existing with a proposed pergola above instead of the previous existing roof. The property also conforms to all the current setbacks in the bulk schedule. Therefore, there is no change to the character of the neighborhood. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. The applicants are seeking to replace an aging waterside deck,without the historically existing roof that was recently removed due to severe weather damage.The deck cannot be replaced without the benefit of variance relief. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 59% relief from the code.However, it is not substantial since the proposed deck is to be constructed in the same footprint as the existing deck, with a pergola above instead of the previously existing roof. Thus, there is no change to the pre- existing bluff setback. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed improvements are LWRP Consistent and the applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this Board. Page 3, October 20,2022 #7682, Goldman-McKeand SCTM No. 1000-68-3-11.1 5. Town Law V67-W)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. However, it is reasonable to assume that an exterior deck existing in a coastal environment for more than 60 years will eventually need to be replaced. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new exterior deck with pergola above while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Lehnert, seconded by Member Dantes, and duly carried, to GRANT the variance as applied for, and shown on the site plan prepared by Steven Maresca,LPE, last revised July 26, 2022, and Architectural Plans prepared by Meryl Kramer, Architect, last revised March 15, 2022. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The installation and maintenance of a non turf buffer as depicted on the approved site plan. 2. Installation of an Innovative Advanced sanitary system (UA OWTS) approved by the Suffolk County Department of Health Services. 3. The proposed deck shall remain unenclosed and open to the sky above other than the attached proposed pergola. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been Page 4,October 20,2022 #7682,Goldman-McKeand SCTM No. 1000-68-3-11.1 procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. The applicants' property is uniquely located at the divide between these two communities because it is situated at the easterly terminus of both the geologic and Town-defined bluff to the west. Due to its partial bluff and high elevation, however, the property is distinctly part of the bluff-front neighborhood to the west, which is characterized by numerous other properties which, like the applicants, are improved with dwellings situated well less than 100 feet from the top of bluff. And although most of these dwellings were, like the applicants' (see Pre-C/O No. Z-12348), constructed long prior to the Town's adoption of bluff setbacks, two nearby properties have benefited from bluff setback variance relief. Specifically, in 1990, relief was granted for the construction of a new dweling and waterside deck located 5 feet from the top of bluff on the adjacent property to the west, 160 Salt Marsh Lane (Case No. 3968); and in 1992, relief was granted for the construction of a waterside deck addition less than 26 feet from the top of bluff four properties to the west, 880 Salt Marsh Lane (Case No.4099). The applicants' deck is thus located considerably farther from the bluff, partly because it does not directly face the top of bluff but is located approximately 41 feet diagonally from the easterly terminus of the bluff to the west, about 12 feet farther from the bluff than the westerly corner of the habitable dwelling structure. And this existing bluff setback would not change because the new deck would be be constructed in the same footprint as the existing, with a pergola above it place of'the historically existing roof. Thus, with no change in the structural footprint or bluff setback, the project would not produce an undesirable change in the character of the applicants' property or the surrounding neighborhoods. There is also no change in conditions that would directly or adversely affect the neighboring properties, especially since 1) the dwelling and deck conform to all required side yard setbacks; 2) the most westerly portion of the existing dwelling separates the deck from the westerly neighbor's view; and 3) the neighboring dwellings to the east are located at much lower elevations, substantial distances away, and much farther seaward (neighbor, to northeast) or on the opposite 'de of Huntington Boulevard (neighbors to east/southeast). The required bluff setback relief of 59 feet is mathematically substantial, but it is not substantial in fact because the new deck would be constructed in the same footprint as the historically existing deck, with a pergola above it instead of the previously existing roof. Thus, there is no change or reduction proposed to the preexisting bluff setback. 4. Reconstructing the existing deck in the same footprint will not cause any adverse impacts on the physical and environmental conditions of the subject property. The toe of the bluff, which is stable and well vegetated, is located almost 300 feet from the surface waters of Long Island Sound, and the dwelling and deck are located more than 300 feet from the Sound. The dwelling and deck are also located well more than 100 feet north of Autumn Lake and the associated freshwater wetlands that bound the property to the south. To mitigate any potential impacts of the proposed construction activities, however, a stormwater drainage system is proposed to capture and recharge runoff, a 5 to 10 foot wide, approximately 1,035 sf non-turf buffer is proposed along the top of bluff and bank; and a project-limiting fence will be installed to contain site disturbance and limit runoff during construction. And though related not to the deck replacement but to interior dwelling renovations not requiring variance relief, the existing conventional septic system is proposed to be removed and replaced with a low-nitrogen, I/A sanitary system consisting of an I/A OWTS located at least 65 feet from the top of bluff. Unlike conventional systems that are not designed or equipped to treat nutrients such as nitrogen, I/A systems are designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters. And in connection with other exterior site renovations not requiring variance relief, including the construction of an accessory garage and driveway, the garage is proposed outside wetlands jurisdiction associated with Autumn Lake; the new driveway is to consist of pervious gravel; and the exisrting 2,120 sf asphalt driveway is to be removed, thus eliminating all developed and impervious surfaces from within 100 feet of Autumn Lake. 5. The difficulty in meeting the required bluff setback is not self-created, as the dwelling and deck legally pre-date the adoption of the required 100-foot bluff setback, and regardless of when the property was purchased by the applicants, it must be reasonably expected that an exterior deck existing in a coastal environment for more than 60 years will even lly need to be replaced. McKEAND & SHANNON GOLDMXN 100 SALT MARSH LANE RECEIVED PECONIC,NY SCTM#1000-68-3-11.1 JUN 01 2022 Zoning Board of Appeals Policies 4, 5, and 6 Reconstructing the existing deck will not cause any adverse impacts on the adjacent bluff, beach, and tidal surface waters on the north side of the property or to the lake and freshwater wetlands on the south side of the property. The toe of the bluff, which is stable and well vegetated, is located almost 300 feet from the surface waters of Long Island Sound, and the dwelling and deck to be reconstructed are located more than 300 feet from the Sound. The deck to be replaced is situated farther from the top of bluff than the existing habitable dwelling footprint to remain, and the deck is being replaced in the same footprint, with no expansion in size or reduction to the existing bluff setback. The dwelling and deck are also located well more than 100 feet north of Autumn Lake and the associated freshwater wetlands that bound the property to the south. To mitigate any potential impacts of the proposed construction activities, however, a stormwater drainage system is proposed to capture and recharge runoff; a 5 to 10 foot wide, approximately 1,035 sf non-turf buffer is proposed along the top of bluff and bank; and a project-limiting fence will be installed to contain site disturbance and limit runoff during construction. And though related not to the deck replacement but to interior dwelling renovations not requiring variance relief, the existing conventional septic system is proposed to be removed and replaced with a low-nitrogen, UA sanitary system consisting of an UA OWTS located at least 65 feet from the top of bluff. Unlike conventional systems that are not designed or equipped to treat nutrients such as nitrogen, I/A systems are designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters. And in connection with other exterior site renovations not requiring variance relief, including the construction of an accessory garage and driveway, the garage is proposed outside wetlands jurisdiction associated with Autumn Lake; the new driveway is to consist of pervious gravel; and the existing 2,120 sf asphalt driveway is to be removed, thus eliminating all developed and impervious surfaces from within 100 feet of Autumn Lake.
