APPLICATION FOR CERTIFICATE OF OCCUPANCY
Instructions
A. This application must be filled in typewriter OR ink, and submitted in duplicate to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal-(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
For existing buddings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of peoperty showing all propertv lines, streets, buildings and unusual natural or
topographic featu res.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent informa-
tion required to prepare a certihcate.

Dear Mr. Romeo:
To the "Order To Remedy Violation", dated September 18, 1979,
a Stop Order of Building Permit No. 10374Z has been removed
as the above permit has been revoked and Building Permit No.
10423Z has been issued October 1, 1979, for the same applica-
tion with a notice "there was a settlement of the area at the
top of the bluff; advise you get professional assurance of
the proposed location of the building".
I request your sur~ey of the foundation indicate the fault -
settlement of the area. This foundation survey will be re-
quired before you can start framing.

Dear Mr. Fisher:
I spoke with you this afternoon regarding the
building permit which your office has issued to
Mr. Ales in Mattituck, New York. I represent
Warren and Mei Brady who live just west of Mr. Ales'
property. I would appreciate it if you would forward
to me a copy of the building permit which your office
issued and would keep me advised of any determinations
you make regarding the work that has been done by
Mr. Ales' contractors.
I agree with the Bradys that the work done to
date may very well lead to further destabilization
of the bluffs and that all efforts should be made
to see that no further harm is done.

Dear Mr. Fisher:
Thank you for taking the time out this morning
to give me a status report on the Ales construction
matter in building permit 10374Z. As I mentioned to
you during that conversation, I am representing the
property owners immediately to the west of that con-
struction site, Mr. and Mrs. Warren Brady. I have
reviewed the materials which you sent to me at the
end of October, and I note that you have required the
contractor to provide you with a survey of the founda-
tion location indicating the fault settlement in the
area. You further advised the contractor to obtain
professional assurances, such as those of a geologist,
regarding the location of the proposed structure.
It is my understanding that none of this
information has been provided to you at this time,
although the contractor has commenced work on the
foundation. I further believe that the location of
the structure violates the revised site plan submitted
to your office on August 20, 1979, which site plan
indicated that the structure would be 140 feet back
from the top of the bluff.
On the basis of the foregoing, I ask that your
office begin an immediate investigation to ascertain
why this construction has commenced before submission
of necessary materials to you and in violation of the
140-foot setback requirement. It would appear that

your office should immediately issue another stop
work order until the contractor has complied with your
regulations and until my clients and I have had a
chance to review the materials submitted.
We believe that this is a matter of utmost im-
portance which deserves your inmlediate attention.
As you are undoubtedly aware, bluff erosion poses a
serious threat to the existing structures in the area
and we believe that the proposed Ales construction
represents a serious and imminent threat to property
owned by the Bradys and others. Should your office
fail to enforce its own regulations and permit require-
ments to the detriment of the Bradys, I believe there
is a serious question as to the Town's liability for
damages in this matter.
I would appreciate your keeping me advised at
your earliest convenience regarding your review of
this project and your continued cooperation will be
appreciated.
