Dear Sir: On January 4, 1983 Robert E. Wall applied for a building permit in my name. That permit was issued on March 30, 1983. The permit (required by George Fisher) was to rebuild and repair a one story wing ~and add a deck. The existing wing had a rotted roof and floor. It was uninhabitable and in danger of collapsing. The work was completed by Mr. Wall and inspected by George Fisher. At that time I was unaware that the original C.O. would have to be updated. Hence this application. Hilliard to make alterations and add a 8 X 8 deck to the dwelling. The delay was caused by a failure to receive the proper drawings. I have issued the permit with Mr. WalL's application and fee. Enclosed is a disapproval for the application that you filed for Rev. Hilliard to move-relocate his garage. The fee for a building permit for an accessory structure is $10.00. The fee will be due before any permit can be issued, after a variance has been granted. I am enclosing your two checks, numbers 12650 and 12651, each for $15,00, intended as payment of the building permit (paid by Mr. Wall) and payment for the moving of the garage (the correct fee is $10.00). The board made the following findings and determination: By this appeal, appellant seeks permission to remove an existing accessory garage structure from its present frontyard location and place same in an alternative frontyard location as shown on survey revised 11/24/78, prepared by Chandler, Palmer and King, submitted with this application. In relocating this accessory building, the board agrees that the appearance of this property would be enhanced and that the area chosen is the most practical under the circum- stances. The lot in question is an eight-sided parcel, and contains an area of 53,052 square feet. Inasmuch as this ~arcel fronts along Heathulie Avenue at an angle, there is minimal rearyard area in which an accessory building could be built without a variance. In considering this appeal, the board determines that the variance request is not substantial under the circumstances; that the circumstances herein are unique; that by allowing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a m~thod feasible to appel- lant other than a variance; that no adverse effects will be produced on available governmental facilities of any increased population; that the relief requested will be in harmony With and promote the general purposes of zoning; and that the interests of justice will be served by allowing the variance as indicated below.
