SCTM#1000-57-1-27 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-L4_thr-u_A__1425,-and the Suffolk County Department of Planning.issued its reply dated April 25, 2022stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP/Coordinator issued a recommendation dated August 2, 2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is INCONSISTENT with the LWRP standards and therefore is INCONSISTENT with the LWRP. In his comments,the Coordinator stated that the pool is located within a FEMA VE Flood Zone (Velocity Hazard) and is not support by Policy 4 of the LWRP Policy Standards. Structures within these areas are impacted by storm surges and should be minimized. PROPERTY FACTS/DESCRIPTION: The subject property is a 23,977 square foot nonconforming parcel located in the R-40 Zoning District. The northerly property line measures 100.00 feet and is adjacent to Blue Marlin Drive, the easterly property line measures 280.00 feet, the southerly property line measures 100.50 feet and is adjacent to Shelter Island Sound, and the westerly property line measures 232.00 feet. The property is improved with one story frame dwelling with attached two car garage a large attached rear wood deck with a vinyl bulkhead and wood retaining wall on the rear water side as shown on the survey prepared by Christopher Henn, LS and dated July 20, 2021. — BASIS OF APPLICATION: Request for Variances-from Article III,-Section 280-15; Article XXIII,-Section 280- 124; and the Building Inspector's March 2, 2022 Notice of Disapproval base on an application for a permit to demolish (as per Town Code definition) and reconstruct a single family dwelling and construct an accessory in- ground swimming pool; at; 1) located less than the code required minimum side yard setback of 15 feet; 2) located less than the code required minimum combin3ed side yard setback of 35 feet; 3) swimming pool is located in other 'f Page 2,October 6,2022 47668, Stratigos SCTM No. 1000-57-1-27 than the code permitted rear yard; located at: 550n Blue Marlin Drive, (Adj. to the Shelter Island Sound) Greenport, NY. RELIEF REQUESTED: For a permit to demolish (as per Town Code definition) and reconstruct a single-family dwelling and construct an accessory swimming pool The proposed dwelling on this nonconforming 23,977 square foot lot in the R-40 Zoning District, is not permitted pursuant to Article XXIII, Section 280-124, which states lots measuring 20,000-39,999 square feet in total size require a minimum side yard setback of 15 feet and a combined side yard setback of 35 feet. The proposed construction will have a minimum side yard setback of 10 feet and a combined side yard setback of 25.9 feet. In addition, the proposed accessory swimming pool is not permitted pursuant to Article III, Section 280-15,which states accessory building and structures shall be located in the required rear yard. The accessory structure is located in the side yard. ADDITIONAL INFORMATION: The applicant's representative presented a prior comparable variance granted to a neighboring property owner, ZBA#5698 which was approved in 2005 for a pool with a 52 foot bulkhead setback, where this application calls for a 49 foot setback from an existing bulkhead. Since that prior decision was rendered, severe and more frequent storms have increased in addition to more flooding and coastal erosion to waterfront properties. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 4, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances for the proposed swimming pool and rear deck addition will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed pool is located in relation to an existing deck and proposed attached deck addition on the seaward side of the dwelling which consequently places the pool in the side yard. Furthermore, the proposed pool is located in the FEMA VE flood zone. In the alternative,the Town Code does permit swimming pools to be located in a front yard on waterfront property. The proposed additions to the dwelling will not produce an undesirable change to the community character, since the existing side yard setbacks for the as built dwelling will remain the same and house sizes in this neighborhood vary from modest one story to large two-story dwellings. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant for a proposed pool can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can locate an in-ground swimming pool in a code conforming front yard. The benefit sought by the applicant for proposed additions to the existing dwelling cannot be achieved by some method, feasible for the applicant to pursue, other than area variances since the non-conforming side yard setbacks exist and the applicant propose to maintain them with the proposed one- and two-story additions. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100 % relief from the code for the proposed pool,33%relief for the single side yard setback,and 26%relief for the combined side yard setback. However, the proposal to add one- and two-story additions to an existing dwelling are common improvements to.older dwellings with non-conforming side yard setbacks and the additions will not encroach further into the non-conforming side yards. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community for the proposed additions will have an adverse impact on the physical or environmental conditions in the neighborhood. The addition of a second story will be kept within the original footprint of the dwelling and the Page 3, October 6,2022 #7668, Stratigos SCTM No. 1000-57-1-27 other proposed addition is on the landward side of the dwelling.as shown on a survey prepared by Christopher Henn, LS.dated July 20,2021.The applicant has also proposed an Innovative Advanced(UA)Septic System. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Evidence has been submitted by the LWRP Coordinator to suggest that a variance in this residential community for the proposed swimming pool will have an adverse impact on the physical or environmental conditions in the neighborhood. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions to the existing single-family dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. However, the addition of an in- ground swimming pool as proposed IS NOT the minimum action necessary to enable the applicant to enjoy the benefit of a swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora, seconded by Member Weisman(Chairperson), and duly carried, to GRANT the variances for proposed habitable additions to the dwelling as applied for and shown on the Architectural Plans prepared by Nigel Williamson, RA,dated September 28, 2022 and the survey prepared by Christopher Henn, L.S., dated September 28, 2022. And DENY the variances for the proposed attached deck addition and the proposed in-ground swimming pool on the seaward side of the dwelling, located within the FEMA VE Flood Zone. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall install an Innovative Advanced (UA) Septic System to be approved by the Suffolk County Department of Health. 2. The applicant shall submit a revised survey removing the proposed seaward deck addition and proposed 12 foot by 24 foot pool denied herein. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. --- Any deviation from the variances granted herein as shown on the architectural drawings, site plan andlor survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board of Southold Town Trustees has issued a Waiver tinder. the Wetlands Regulations of the Southold Town Code at its September. 28, 1995 meeting for a 1,000 square ft. deck. 8. It is the position of this Board in considering this }?plication: (a) the relief requested for a setback at 50, 51 or 52 feet is not the minimum necessary to afford relief, and the alternative is more reasonable under the circumstances of the area; (b) the setback granted is substantial at 22 feet less than the requirement, or 29%; however, this setback is similar to those generally existing in the neighborhood, as noted above; (c the variance requested is not self-created; (d) the relief, as alternatively granted, will not create a substantial change in the character of the neighborhood along this bulkhead and waterway, and although there will be a minor visual effect, there will not be an adverse detriment created in the neighborhood or district for the type of construction (restricted herein for an open deck); • Page 3 - Appl.
