Dear Mro & Mrs. Lister: A review has been made of your proposal to: construct a deck onto existing house. Location: Gardiners Bay; Cleaves Point Road, East Marion, Town of Southold. New York State Department of Environmental Conservation has found the -- parcel XX~.. project to be: Greater than 300' from inventoried tidal wetlands. X~[XLandward of a substantial nmn-~mde structure .(,functional Bulkhead)_ ~ greater than 100' in length constructed prior to September 20, 19B7. Landward of 10' contour elevation above n~an sea level on a gradual, nat- ural slope. Landward of topographical crest of bluff, cliff or dune in excess of 10 -- feet in elevation above mean sea level. Therefore, no permit under Article 25 (Tidal wetlands of the Environmental Conservatisn Law) is required at this time since the current proposal is beyond State mandated Jurisdiction pursuant to this act. However, amy additional work or modifications to the project may require a permit. I found it has been completed and a certificate can be issued. This does not cover a proposed deck or the chimney masonary work that has been done. The chimney, as you told me over the phone, now has space between it and the house indicating a separation. At the top it has separated at least 1 1/2" and about 6' above the grade, it has at least a 1/4 inch separation. Also, a vertical separation of at least a 1/4 inch. This is to make you aware it appears the chimney is leaning away from the house and steps should be taken to correct it. No permit was issued for this chimney and masonary work.
