Instructions
This application must be filled in typewriter OR ink, and submitted in duplicate to the Building
Inspector with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and
unusual natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal--(S-9 farm or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and
installations, a certificate of Code compliance from the Architect or Engineer responsible for
the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of property showing all property lines, streets, buildings and unusual natural
or topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent in-
formation required to prepare a certificate.

A review has been made of your proposal to:
New York 8tare Department of Envtronraental Conservation has found the

Therefore, no permit under Article 25 (Tidal Wetlands of thq Environmental
Conservation Law) is required at this time since the current proposal is beyond
State mandated ~risdictton pursuant to this act. H~ever, any additionalwork
or modifications to the project may r~quire a permit. It is you~ responsibility
to notify this office, in writing, if such additional work of modifications are
contemplated.

The public hearing on this application was held on March 23, 1983.
Upon application of JAMES AND DORIS IDLER, 27 Anoatok Drive, Hunting-
ton, NY 11743 for a Variance to the Flood Plain Management Law, Chapter 46,
Section 46-7 for permission to utilize area below the eight-foot minimum
required elevation for placement of electrical utilities and equipment in
this A-7 Flood Zone. Location of Property: 1010 Maple Lane, East Marion,
NY; Cleaves Point Filed Map 4650, Subd. Lot 60; County Tax Map Parcel ID

The board made the following findings and determination:
By this application, applicants seek permission to place electrical
utilities within basement area below the eight-foot elevation above mean
sea level. The premises in question is located at the westerly side of
Maple Lane, East Marion, and is located partially in an A-7 Flood Zone
and partially in a B Flood-Zone. Applicants propose to locate the
utilities a minimum of 20" from the foundation floor, which appears to
be approximately four feet above mean sea level. The board finds upon
viewing the area there are several homes in the neighborhood of the
subject parcel. The dwellings constructed on these lots are~on lo~s
of a similar size, and the dwellings constructed thereon are constructed
below the base flood level. The board therefore finds that the lot in
question meets the standards set forth in Section 46-16A of the Code
since it contains an area of less than one-half acre and is contiguous
to and surrounded'by lots with existing structures constructed below
the base flood level.
In passing upon this application, the board has considered all
technical evaluations; all relevant factors; all standards specified
in the Code; and all of the applicable factors contained in. Section
46-15B, subdivisions (1) to (11), inclusive, of the ~Ode.
The board further finds and determines that: (1) there is a go6d
and sufficient cause for the grant of this variance; (2)_ a failure, to
grant the variance would result in exceptional h~rdship to the appli-
cant; (3) the grant of a variance will not result in increased'flood
heights, or additional threats to public safety, or extraordinary
public expense, or create nuisance~, or caus~ fraud~ or victimize th~
public, or conflict with existing local laws or rules or regulations.

Instructions: The application to the Building Inspector includes (each

posed work. The application must give complete information to show that
the proposed can comply to the Local Law No. 1-1980, Chapter 46 of the
Code of the Town of Southold known as "Flood Damage Prevention Law" of the
Town of Southold. The applicant must submit approvals that any.other
agency requires.

The applicant must submit plans and specifications as well as any other
information requested by the Building Inspector to substantiate the facts
that the structure has or will have the lowest floor, including basement/
cellar, elevated above the base flood elevation or; if permitted by the
Federal Regulation, that: 1. such structure is flood proofed in such
manner that below the base flood level the structure is water tight with
walls substantially and impermeable to the passage of water, 2. that
structural components are capable to resisting hydrostatic and hydrodynamic
loads and effects of buoyancy, 3. applicant must sub~it certification by
a registered professional engineer or architect that the standards set
forth in Section 46-18B (1) (2) (3) of the Southold Code are satisfied.

specifications including-the required certifications and such other in-
formation as the Building Inspector may require in that ~e provisions of
46-19 are complied with. Mobile homes are prohibited. The lowest portion
of the structural members of the lowest floor cannot be lower than the
base flood elevation with all space below open except breakaway walls.
