SMITH requests a Wetland Permit to remove and replace in place existing 4'x13' fixed dock, and add a 4'x10' step- down platform to north side of dock; and to replace approximately 22 linear feet of 2 foot high landscape retaining wall along top of bluff with approximately 30 linear feet of 2 foot high landscape retaining wall. Located: 2555 Kirkup Lane, Mattituck. SCTM# 1000-121-3-8 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. .This determination is based upon: 1. The age of the dock and minimal design. 2. The materials proposed to be used in construction. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS 1, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of'Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action.will be evaluated as to its si nificant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The proposed in-place replacement and extension of the existing retaining wall along the top of bluff will maintain the integrity of the slope and protect the land above it from erosion,which will in turn serve to 1)prevent potential erosion-induced damage to the residential structures located landward of the retaining wall;and 2)prevent soil material from eroding and running down the slope and into the lake. The project is thus consistent with the Policy 4 goals of minimizing potential damage to/loss of structures natural resources. Attach additional sheets if necessary Policy 5. The dock replacement will be consistent with the Policy 6 goals of protecting and restoring the quality and function of the surrounding freshwater lake ecosystem,as the new dock and platform will be constructed entirely of untreated materials,including light-permeable open-grate decking,which will prevent the potential introduction of any potentially harmful wood preservatives or chemicals to the enclosed freshwater wetland ecosystem of Laurel Lake. And the proposed in-place replacement and extension of the existing retaining wall along the top of the bluff will have no impacts on the surrounding ecosystem.
