Main Rd. &Youngs Ave.) G Q Telephone: 631765-1938 Southold, NY 11971 lroum LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Glenn Goldsmith, President Town of Southold Board of Trustees .From: Mark Terry, AICP LWRP Coordinator Date: February 16,,2022 Re: LWRP Coastal Consistency Review for KATHLEEN KNAPP SCTM#1000-145-4-4 Jeffrey Patanjo on behalf;.of KATHLEEN KNAPP requests•a Wetland Permit,to remove and replace 58 linear feet of deteriorated timber bulkhead with new.vinyl bulkhead in same location as existing and raise the height 12" above existing; re-face 113 linear feet of existing timber bulkhead in existing location with vinyl sheathing below lower wale and 2"x6" cca sheeting above lower wale; existing bulkhead to remain undisturbed; install two courses of 6"x6" cca timber directly to top whale of existing timber bulkhead to raise height a maximum of 12" above existing for a total length of 294 linear feet. Located: 2260 Great Peconic Bay Boulevard, Laurel. SCTM# 1000-145-4-4 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. The proposed action is listed within an NYSDEC Critical Environmental Area with high-quality intertidal wetlands located to the north. The use of CCA wood preservatives in construction projects is unsupported by Policies-5 and 6 of the LWRP. CCA is water-soluble and can leach arsenic, chromium, and copper into the waterbody. Another risk is that lower trophic animals that encounter the CCA-treated wood (snails, shellfish) have been shown to bioaccumulate the chemicals. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. SCTM# 1000-87-5-22 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. 1. Verify how the lot was created. 2. The lot is shown as encumbered with a 50'wide right of way on a map entitled Map of Property of Howard A. Toedter. 3. Groundwater is high EL 4.5' below grade and the basement should be reconsidered. 4. Seasonal and storm surge flooding is expected. 5. Setbacks to wetlands should be maximized to the greatest extent practicable. 6. Establish and maximize vegetated buffers landward of wetlands. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
