AFFIDAVIT IN SUPPORT OF MOTION FOR PRELIMINARY INJUNCTION WITH TEMPORARY RESTRAINING ORDER STATE OF NEW YORK) COUNTY OF SUFFOLK) NICHOLAS CONSTANTINE, being duly sworn deposes and says: (I) I am the Plaintiff herein and make th~s Affidavit in support of en application for a prelimtu.ary injunction, and pending hearing, for a temporary restraining order pursuant to Article 63 of ~he C~vil Practlve Law and Rules. (2) My wife, Plaint{fl CHRISTINE CONSTANTINE, a~d I are owners of a house and property known as Lot 32, Captain Kidd Estates, Miriam Road, Mattituck, Southold Town, Suffolk County, New York. (3) The Defendautm, PETER and ANDREA PAPPAS, are owners of an adjacent parcel of land, known am Lots 30~.and 3], Captain Kidd Estates, Miriam Road, Mattituck. (4) This i~ an application for an injunction restraining the Defendants~ from proceeding with construetxon' of ~ residence on their 19t by reason of their continuing ~,respaas upon our property by changing the contour of their I:'~operty and by bringinl in large amounts of fill materials which have spilled onto my property causing damage to my retaining wall, mg hollse, and various items of personal property as outlined further below. (5) More than fifty truckloads of fi!! materlal, mostly saog, havelbeen brouRht onto Defendants~ properCy. : A great deal of this safid and dirt' has spilled onto my Property, covering my patio, flowerbeds, steps, picnic table, car, and falllng onto my boar and its outboard motor which are parked in my driveway, iBesides this~ llterally tons of sand and dirt have been loaded up against my small decorative brick retaining wall, causing itlto crack in many places. ~y steps have become impasaableland no part of my patio is free of ~he sand and fill dirt whichlhas fallen into my yard due to Defendants importing of so much:of it. Besides this, large amounts of De£endants* constructiqn garbage, including many broken pieces of styrofoam insulattonlboard, pieces of wood, and paper garbage, has fallen onto my patio from Defendants~ yard. (6) .Upon informatlon and bellef~ it appears Defendants [have 5uilt height their home in vlolation requirements and are now attempting to that of Southold Town raise the ground level three or four feet by bringing in tons and tons of fill dlr[. (7) This ehanging of the contour of their property by Defendants constitutes a trespass and has caused and is causing immediate and irreparable harm to me in that I cannot enjoy my own yard and patio. My boat) car and picnic table remain covered with dirt and garbage due to Defendants' construction~ and my retaining wall is being destroyed. Defendants still continue to bring in additional truckloads of fill and change the contour of their property all of which adversely effects me~ since the force of gravity is causing the fill to continue to fall onto my property, and to damage my lawn and topsoil. (8) I have spoken with the Defendants to ask them to correct this situation, to no avail. My attorney has surveyed the ongoing damage and has spoken and written letters to Defendants and there has been no response from them. (9) Continued construction by Defendants prior to the hearing date will result in irreparable damage and harm to Plaintiffs in the destruction of not only our own property value. but of our actual personal and real property as shown in (5) above. and (7) above. A temporary delay in'construction would not materially harm defendants and would actually be to their benefit prevail since if Plaintiffs stop bringing in extra fill away once brought there.
