Instructions
A. This application must be filled in typewriter OR ink, and sgbmitted i I tO the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal--(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect Or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of p~operty showing all property lines, streets, buildings and unusual natural or
topographic featu res.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.

The open foundation structure on the above-described
premises which is owned by you is dangerous and unsafe.
Exterior portions of the foundation wall are flush with
the existing grade leaving an unprotected and exposed
hole approximately five (5) feet ~eep in some areas thereby
causing a hazard and dangerous condition.
You are hereby ordered to either: Fill in the exposed
foundation hole flush with the existing grade on your
premises; or make the foundation secure by fencing the
perimeter and completely enclosing same by placing a
floor or decking upon the foundation. If you choose
the latter course of action you wi~ll have to obtain a
Building Permit from the Southold'Town Building Department.

In the event that you fail to comply with the above, a
hearing will be held before the Southold Town Board con-
cerning same at 11:15 o'clock on February 23, 1982.
If the Southold Town Board after the aforementioned hearing
shall determine: that the open foundation structure is
unsafe or dangerous to the public, the Southold Town Board
may order the open foundation secured or removed.
In the event that the open foundation on your premises
shall be determined by the Southold Town Board to be unsafe
or dangerous and in the event of your neglect or refusal to
remove or correct same within the time provided, the Southold
Town Board may remove such foundation structure by whatever
means it deems appropriate and assess all costs and expenses
incurred by the Town of Southold in connection with the
proceedings to remove and secure same, including the cost
of actually removing said foundation structure against the
land on which the said foundation is located.

Gentlemen:
I have received your recent notice dated January 5th, concerning my
property in Mattituck. Let this confirm that I personally met with
George Fisher, today, and applied for a building permit to reconstruct
my home, which was destroyed by fire. I have received the notice of
disapproval requiring a variance, which I will process immediately
with the Southold Town Zoning Board of Appeals.
In the mean time, I hereby request an extension of time and I will
fence in the area in accordance with Mr. Fisher~s memorandum to me
dated January 29, 1982. It is my intention to comply with the notice as
above stated.

ZONING BOARD OF APPEALS
BY this appeal, applicants seek permissio! to reconstruct
and .relocate a one-family, one-and one-half s$ory frame
dwelling in the same previous location as the!prior dwelling
which.was recently destroyed by fire. ~
Upon inspection of the premises, the board finds that
to the southwest corner of the parcel is a small accessory
building which applicants state has been usedias a family
cottage. Applicants have submitted an affida%it of Alma M.
Granger that the accessory building was prior!to 1946 a
garage, which was converted some time in 19461into a cottage
containing a bath, kitchen, bedroom and livin~room. The
affidavit also affirms that at or prior to 1943 the premises
contained a one-family house in addition to the garage.
In considering this appeal, the board determines that
the variance request is not substantial; thatlthe circumstances
herein are unique and the practical difficulties have been
shown; that by allowing the variance no substantial detriment
to adjoining properties would be created; that the difficulty
cannot be obviated by a method, feasible to appellants, other
than a variance; that no adverse effects will!be produced on
available governmental facilities of any increased population;
that the relief requested will be in harmony With and p~omote
the general purposes of zoning; and that the ~nterests of
justice will be served by allowing the variance.
On motion by Mr. Goehringer, seconded by Mr. Grigonis; it
