APPLICATION FOR CERTIFICATE OF OCCUPANCY
Instructions
A. This application must be filled in typewriter OR ink, and submitted in duplicate to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal—(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of property showing all property lines, streets, buildings and unusual natural or
topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent informa-
tion required to prepare a certificate.

RESERVED DECISION: Appeal #2687 . Application of MARINO
FARAGUNA, 175 Park Avenue, Berkeley Heights, New Jersey 07922 ,
for a Variance to the Zoning Ordinance, Article III , Section
100-31 for permission to construct dwelling with insufficient
sideyards at property known as 5675 Skunk Lane, Cutchogue, New
York; Lot 113 of "Nassau Farms" filed Map #1179; County Tax
Map Item No. 1000-138-2-10 .
After investigation and inspection, the Board finds that
applicant is requesting permission to construct proposed dwell-
ing with insufficient sideyards, 8 ' 9" on the south and 10 ' on
the north. The Board finds that the subject property is very
narrow in width 75 ' along the road and 60 ' at the rear line
however, there appears to be adequate practical area in which
to build the proposed 50-foot wide house with sideyards of 9
f foot and 12 foot. The Board also finds that the property is
located in an A-4 Flood Zone restricting new construction to
an 8-foot elevation from mean sea level, for which applicant
has not requested relief and therefore the Board assumes he
intends to comply with the restrictions of the Flood Damage
Prevention Law. The Board agrees with the reasoning of the
applicant.
The Board finds that the circumstances present in this
case are unique, and that strict application of the ordinance
would produce practical difficulties or unnecessary hardship.
The Board believes that the granting of a variance in this case
will not change the character of the neighborhood and will
observe the spirit of the ordinance.
On motion by Mr. Douglass, seconded by Mr. Goehringer,
it was
RESOLVED, that MARINO FARAGUNA, in Appeal No. 2687, be
GRANTED a Variance to the Zoning Ordinance, Article III,
Section 100-31, SUBJECT TO THE FOLLOWING CONDITIONS :
(1) That the sideyards may not be less than 12 ' on
one side and 9 ' on the other side;
(2) That the existing dwelling to be used as an acces-
sory building for storage and not to be permitted to be
rehabilitated to a living dwelling once a Certificate of Occu-
pancy has been issued for new dwelling proposed herein;
(3) Compliance with the restrictions of the Flood Damage
Prevention Law of the Town of Southold.

According to the Zoning Board of Appeals ruling
I12687 dated 5/22/80 special condition ( 2) states that
"The existing dwelling to be used as an accessory build-
ing for storage and not to be permitted to be rehabili-
tated to a living dwelling once a Certificate of Oc-
cupancy has been issued for the new dwelling proposed
herein" .
During a recent inspection of the above building
it is apparent that the building is being used for a
dwelling .
In order to avoid any legal action this violation
must be corrected immediately .

Dear Mr. & Mrs . Faraguna:
If you will recall, before the issuance of the build-
ing permit to construct your new home at 5675 Skunk Lane,
Cutchogue, N.Y. you made an appeal to the Zoning Board of
Appeals for reduction of the side yards. Under appeal
#2687 dated May 22 ,1980 you were granted the reduction
you requested under condition #1. Condition #2 stated
that the existing dwelling be used as an accessory stor-
age building and not to be used for living purpose once
the Certificate of Occupancy has been issued. A copy of
this appeal is herewith.
A Certificate of Occupancy was issued on May 14 , 1985
for the new dwelling. it has come to our attention that
the old building is still being used for living purposes ,
this is a violation under appeal #2687 and must be correct-
ed.
Enclosed find application for a building permit to
convert this building for accessory use as a storage build-
ing. If you have any questions regarding this matter con-

Inspector, with 3 sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets
or areas, and giving a detailed description of layout of property must be drawn on the diagram which is part of this appli-
cation.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.

ZONING BOARD OF APPEALS
FORM ZB4
After investigation and inspection, the Board finds that
applicant is requesting permission to construct proposed dwell-
ing with insufficient sideyards, 8 ' 9" on the south and 10 ' on
the north. The Board finds that the subject property is very
narrow in width, 75 ' along the road and 60 ' at the rear line
however, there appears to be adequate practical area in which
to build the proposed 50-foot wide house with sideyards of 9
foot and 12 foot. The Board also finds that the property is
located in an A-4 Flood Zone restricting new construction to
an 8-foot elevation from mean sea level, for which applicant
has not requested relief and therefore the Board assumes he
intends to comply with the restrictions of the Flood Damage
Prevention Law. The Board agrees with the reasoning of the
applicant.
The Board finds that the circumstances present in this
case are unique, and that strict application of the ordinance
would produce practical difficulties or unnecessary hardship.
The Board believes that the granting of a variance in this case
will not change the character of the neighborhood and will
observe the spirit of the ordinance.
On motion by Mr. Douglass, seconded by ,Mr. Goehringer,
it was
RESOLVED, that MARINO FARAGUNA, in Appeal No. 2687, be
GRANTED a Variance to the Zoning Ordinance, Article III,
Section 100-31, SUBJECT TO THE FOLLOWING CONDITIONS:
(1) That the sideyards may not be less than 12 ' on
one side and 9 ' on the other side;
(2) That the existing dwelling to be used as an acces-
sory building for storage and not to . be permitted to be
rehabilitated to a living dwelling once a Certificate of occu-
pancy has been issued for the new dwelling proposed herein;
(3) Compliance with the restrictions of the Flood Damage
Prevention Law of the Town of Southold.
