En-Consultants on behalf of AMNON & KATHL-EEN BAR=TUR requests a Wetland Permit to
relocate (approximately 6.3' to the south) and raise approximately 3' existing two-story, single-
family dwelling with reconstructed 141sq.ft. front porch and +4'x6' steps; construct 544sq.ft. one-
story addition with 29sq.ft. stoop and +4'x7' steps, partially in place of existing accessory garage
that is to be demolished and removed; install new previous gravel driveway; install new drinking
water well; remove existing conventional septic system and install new I/A sanitary system; and to
install a stormwater drainage system. Located: 170 Bay Lane, Orient. SCTM# 1000-24-2-26.4
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed.'action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with
the LWRP.
The recommendation is made with the following considerations:
1. There is no ability to relocate the structure outside of the FEMA flood zone AE EI 7 due
to lot size and configuration.
2. The proposal will upgrade the dwelling to FEMA construction standards. The first-floor
elevation is.proposed at 9'.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

The proposed project seeks to renovate and add a master bedroom addition to an existing dwelling, whose
construction pre-dates the adoption of Town zoning code in 1957 and is in need of structural repairs,
upgrade of mechanical systems, and replacement of deteriorating siding, roofing, windows, and
insulation. And as a result of its design and additionally incorporated environmental mitigation measures
described below, the project will further the goals of LWRP Policies 4, 5, and 6 by increasing the
dwelling's protection from potential flood and erosion damage; and by protecting and improving water
quality and the quality and function of the surrounding Orient Harbor tidal wetland ecosystem.
h. All proposed construction will remain located outside the Coastal Erosion Hazard Area;
i. Lot coverage will remain below the code-compliant 20 percent.
j. The relocated dwelling will be elevated to a FEMA-compliant base flood elevation, thus
substantially increasing the dwelling's protection from potential flood and erosion
damage and providing a benefit to adjacent properties through reduction of potential
damage that could be caused to nearby structures as a result of damage that might
otherwise be caused to the subject dwelling during a significant storm event;
k. The existing wetland setback to the bulkhead adjacent to Orient Harbor will be
maintained and in fact increased by one foot as a result of the relocation of the existing
dwelling structure, and the proposed addition will be located on the landward side of the
relocated dwelling;
1. To ensure that the project does not increase the potential for stormwater runoff and would
instead result in a potential reduction in runoff reaching Orient Harbor through improved
site drainage, a stormwater drainage system is designed to capture and recharge roof
runoff from the finished dwelling structure;
m. As a means of providing a potentially substantial increase in the protection and
improvement of water quality, the existing conventional septic system will be removed
and replaced with a low-nitrogen, UA sanitary system designed to significantly reduce
nitrogen loading into the groundwater and thus ultimately the surface waters of Orient
Harbor; and
n. A project limiting fence would be installed to contain site disturbance and potential
surface runoff during construction.
