THURSDAY, SEPTEMBER 15, 2022
A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held
at the Southold Town Hall Annex, Second Floor Conference Room, 54375 Main Road at Youngs
Avenue, Southold on Thursday, September 15, 2022 commencing at 4:00 P.M.
The public had access to view and listen to the meeting as it was happening via Zoom. However,
this meeting was not a public hearing and no testimony was solicited or received.
Present were:

Nicholas Planamento, Vice Chair Kim E. Fuentes, Board Assistant
Eric Dantes, Member John Burke, Acting Town Attorney

4:04 P.M. Chairperson Weisman opened the meeting in order to call for Executive Session.
Vote of the Board: Ayes: Members Weisman(Chairperson), Dantes, Acampora and Lehnert.
This Resolution was duly adopted (4-0) (Member Planamento Abstained).

EXECUTIVE SESSION:
4:04 P.M. Motion was offered by Chairperson Weisman, seconded by Member Dantes to enter
into Executive Session in order to receive Attorney Advice. Vote of the Board: Ayes: Members
Weisman(Chairperson) Dantes Acampora and Lehnert. (This Resolution was duly adopted 4-
0). (Member Planamento Abstained)
5:14 P.M. Motion was offered by Chairperson Weisman, seconded by Member Acampora to exit
Executive Session. Vote of the Board: Ayes: Members Weisman(Chairperson), Dantes,
Acampora and Lehnert (This Resolution was duly adopted 4-0) (Member Planamento).

POSSIBLE RESOLUTION TO CLOSE THE FOLLOWING HEARING
5:15 P.M. - 16125 SOUNDVIEW REALTY, LLC. #7670—(Adjourned from September 1,
2022) Request for a Variance from Article XXII, Section 280-116A(1) and Building Inspector's
April 13, 2022 Notice of Disapproval based on an application for a permit to construct an
accessory in-ground swimming pool at; 1) less than the code required 100 feet from the top of
the bluff; located at 16125 Soundview Avenue, (Adj. to the Long Island Sound) Southold,NY.
SCTM No. 1000-50-2-19. RESOLUTION: A motion was offered by Chairperson Weisman,
seconded by Member Lehnert to CLOSE HEARING and RESERVE DECISION. Vote of the
Board: Ayes: All. This Resolution was duly adopted (4-0).

Member Acampora to authorize advertising of hearings for the Regular Meeting to be held on
Thursday, October 6, 2022, which will commence at 9:00 AM for Executive Session, and 10:00
AM for Regular Meeting. Vote of the Board: Ayes: Members Weisman (Chairperson), Dantes,
Acampora and Lehnert. This Resolution was duly adopted (4-0)(Member Planamento
Abstained
RESOLUTION ADOPTED: A motion was offered by Chairperson Weisman, seconded by
Member Acampora to approve Minutes from the Regular Meeting held September 1, 2022. Vote
of the Board: Ayes: Members Weisman (Chairperson), Dantes, Acampora and Lehnert. This
Resolution was duly adopted (4-0) (Member Planamento Abstained)
RESOLUTION ADOPTED: A motion was offered by Chairperson Weisman, seconded by
Member Acampora to approve De Minimus request from applicant Stephen Kiely, Special
Exception No. 7508 to convert conditioned non-habitable storage space into habitable living
space within an approved accessory apartment in an accessory garage located at 16045 Main
Road, Mattituck, SCTM No. 1000-115.-1-7. Vote of the Board: Ayes: Members Weisman
(Chairperson), Dantes, Acampora and Lehnert. This Resolution was duly adopted (4-0)
(Member Planamento Abstained)

RESOLUTION ADOPTED: A motion was offered by Chairperson Weisman, seconded by
Member Lehnert to Grant a One Year Extension from September 15, 2022 to September 15,
2023 to #6803 Lauren Zambrelli, 4910 Pequash Avenue, Cutchogue NY SCTM No. 1000-110-
3-27. with the option to renew the extension for one additional year upon written request
received by the Board of Appeals prior to the date of expiration. Vote of the Board: Ayes:
Members Weisman (Chairperson), Dantes, Acampora and Lehnert. This Resolution was duly
adopted (4-0) (Member Planamento Abstained)
RESOLUTION ADOPTED: A motion was offered by Chairperson Weisman, seconded by
Member Acampora to Grant a One Year Extension for Condition No. 6 that required a building
permit to issue within 90 days of the ZBA decision for as built improvements, from September
15, 2022 to September 15, 2023 for James and Jennifer Maye, #7626, 910 Fleetwood Road,
Cutchogue,NY. SCTM#100-137-4-22 with the option to renew the extension for one additional
year upon written request received by the Board of Appeals prior to the date of expiration. Vote
of the Board: Ayes: Members Weisman (Chairperson), Dantes Acampora and Lehnert. This
Resolution was duly adopted 4-0) (Member Planamento Abstained)
There being no other business properly coming before the Board at this time, the
Chairperson declared the meeting adjourned. The meeting was adjourned at 5:53 P.M.
