Box 383 Fishers Island New York 06390 November 9, 1982 Re: Allerton Cushman Dear Mr. Wall: The following action was taken by the Southold Town Planning Board, Monday, November 8, 1982. RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled "Allerton Cushman" located at Fishers Island was submitted to the Planning Board on April 12, 1982 and, a filing fee in the amount of $50 was paid August 26, 1982, and WHEREAS, a ~ublic hearing was held on said subdivision application and plat at the Town Hall, Southold, New York, on September 20,1982 7:45 p.m., and at WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, NOW, therefore, be it RESOLVED that the application of "Allerton Cushman" for approval of said subdivision plat prepared by Chandler, Palmer & King dated March 11, 1982 , be approved and the chairman be authorized to endorse approval on said subdivision plat subject to the following conditions within six months from date of resolution: No lot shall be subdivided or its lot lines changed in any manner at any future date unless authorized by the Southold Town Planning Board. Mr. James Wall (2) 11/9/82 NO new residential structure of sanitary disposal facility shall be constructed or otherwise located within 100 feet of the to~ edge of the bluff along the shoreline of Block Island Sound. 3. Clearing ~nd cutting of vegetation within 50 feet of the top edge ~f the bluff shall be limited to that necessary for maintenance. 4. No grading shall be permitted within 50 feet of the top edge of the bluff except that that may be necessary to control o~ remedy erosion or to prevent stormwater from flowing over the edge of the bluff. 5. No stormwater runoff resulting from the development and improvement of the subdivision or any of its lots shall be discharged down the face of the bluff in any manner. 6. There shall not be any struoture providing access to the beach constructed on the faoe of the bluff as is shown on the subdivision map. Access to the beach shall be limited t~ the flatter areas along the shoreline of each lot. The abovel conditions shall be filed as covenants and re- strictions in the office of the County Clerk on or prior to the granting of approval to this subdivision. This subdTvision will meet the requirements and standards of the Suiffolk County Department of Health Services Prior to the Chairman endorsing his approval, please forward to this office four (4) c~pies of the final map, a copy of the filed covenants and restrictions and a copy of the Suffolk County Department of Health Services approvalI.
