Instructions
A. This application must be filled in typewriter OR ink, and submitted in duplicate to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal-(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"_
land uses:
1. Accurate survey of peoperty showing all property lines, streets, buildings and unusual natural or
topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent informa-
tion required to prepare a certificate.

Dear Mr. and Mrs. Mott:
The following action was taken by the Southold Town Plan-
ning Board, Monday, November 30, 1982.
RESOLVED that the Southold Town Planning Board approve
the parking of the site plan of Eugene & Patricia Mott, located
at Cutchogue, subject to the issuance of a certificate of
occupancy being issued for an antique shop as stipulated by the
applicants.
The Board also discussed consideration of a common curb cut
with the adjoining property. It was the concensus of the board,
not to enforce a common curb cut between the parties of Eugene &
Patricia Mott and A.J. Bodenstein.

Upon application of ~e and Patricia Ann Mort, Box 38, RFD %1,
M~ddle Island Boulevard, Middle Island, NY 11953, for a Variance to
the Zoning Ordinance, Article VII, Section 100-71 for permission to
construct building in this B-1 Zone with insufficient side and rear
yard setbacks, at 31935 Main Road, Cutchogue, NY; bounded north by
Imbriano; east by Mostupanick; south by Main Road; west by Boyd;
County Tax Map No. 1000-97-5-9.
The board made the following findings and determination:
By this appeal, applicants seek permission to construct a
40' by 100' building for commercial use on this B-1 Zoned Parcel
located at the north side of Main Road, Cutchogue. The premises
in question is vacant, and fronts along the State Route approxi-
mately 85 feet and has a depth of 166 feet. The proposed building
h~ proposed to be setback 35 feet from the Main Road property
Line, 38 feet from the westerly parcel, 6.64 feet from the
easterly parcel, and approximately 3l feet from the rear property
line. It is the unanimous opinion of the board the setback from
the easterly property line should be a minimum of eight feet, and
this location appears to be the most feasible and useful area,
particularly due to the lot size.
In considering this appeal, the board determines that the
variance request is not substantial in relation to the code require-
ments; that the circumstances herein are unique; that by allowing
the variance no substantial detriment to adjoining properties would
be created; that the difficulty cannot be obviated by a method,
feasible to appellant(s)/ other than a variance; that no adverse
effects will be produced on available governmental facilities'of
any increased population;-that the relief requested will be in har-
mony with and promote the general purposes of zoning; and that the
interests of justice will be served by allowing the variance as
applied for and as specified below.
On motion by Mr. Douglass, seconded by Mr. Grigonis, it was

REVERSE
RESPONSIBILITIES OF PERMITTEE
PROTECTIVE LIABILITY ItlSURANC~ COVERAGE
F~ermittee must have protective liability insurance coverage in accordanc~ with Department requirements. (See Infor-
mation on Protective Liability Insurance Required for Highway Work Permits and/or Special Hauling Permits, Form
PERM-27).
ExpiraHon of, .or lock of, J/obi/Jify insurance automatically terminates the permit.
Insurance coverage may be prbvided by furnishing the Department with one of the following:
a. A Certificate of Protective Liability Insurance for permits on State Highways (Form PERM 17, NYSDoT).
b. A $2.50 remittance (check drawn on a New York State Bank or Certified) for coverage under the Departmental Blanket
Policy.
c. iAn Undertaking may be furnished by Public Service Corporations and Government Units only and must include the
wording required by the D~partment.
COMPENSATION INSURANCEi AND DISABILITY COVERAGE
The applicant is required to hbve compensation insurance end disability coverage as noted in the provlslons of the
Workmen's Compensation Lawand Acts amendatorythereof for the entire period of the permit, or the permitis invalid.
NOTIFICATIONS
Notify Commissioner, throughl Regional Office, one week prior to commencing work, except emergency work by public
service utilities which should be reported the next work day.
Work must start within 30 days from date of permit.
Notify area gas distributors 72 hours prior to any blasting.
No~ify Utility Companies with facilities in work area (permission must be obtained before doing work affecting utilities'
facilities) before starting work.
Nqtify land owners of abutting lands, before disturbing trees.
Notify Department of Transp6rtation at conclusion of work and return original copy of permit to Regional Office.
Annual Maintenance Permit Notifications:
Notify by telephone the District or Resident Office, one week in advance, each time regular maintenance work
is to be performed, in emergencies, notification by telephone should be made the next work day.
SITE CARE AND RESTORATION
Ad Undertaking, a bond or certified check in an amount designated by the DepartmentofTransportation may be required
bytheRegional Office, before 'a permit is issued, to guarantee restoration of the site to its original condition. If the
Department is obliged to restore the site of its original condition, the costs to the Department will be deducted from
the amount of the permittee's,guarantee deposit at the conclusion of the work.
The permittee is responsible ~or traffic protection and maintenance, including adequate use of signs and barriers during
work and evening hours. Anv6ne working within the R.O.W. will wear an orange vest and hard hat.
No unnecessary obstruction il to be left on the pavement or the right of way or in such a position as to block warning
signs during or between workihours.
Nq work shall be done to obsiruct drainage or divert creeks, water courses or sluices onto the right of way.
All falsework must be remov6d and all excavations must be filled in and restored to the saHsfactlon of the Regional
Traffic Engineer.
COSTS INCURRED BY ISSUANCE OF THIS PERMIT
All costs beyond the limits o~ the protective liability insurance, surety deposits, etc., are the responsibility of the
permittee.
The State shall be held free of any costs incurred by the issuance of this permit, direct or indlrect.
SUBMITTING WORK PLANS'
The applicant will submit wdrk plans and/or a map as required by the Department, This shall include such details as
mbasurements of driveways with relation to nearest corner, positions of guys supporting poles and a schedule of fha
number of poles and feet of excavation necessary for completion of the work on the State right of way. A description
of the proposed method of construction will be included.
Plan work with future adjustments in mind, as any relocation, replacement or removal of the installation authorized by
this permit and made necessary by future highway maintenonc% reconstruction or new construction, will be the respon-
sibility of the permJttee.
The permittee must coordinate his work with an}, state construction being conducted.
TRAFFIC MAINTENANCE
Traffic shall be maintained bylthe permJttee on the highwav, in a safe manner, during working and non-working hours until
struction is completed. Suitabie safeguards, to reduce conditions dangerous to life, limb and property to a minimum, must be pro-
vided by the permJttee (including flsgmen when requested by the Department).
COST OF INSPECTION AND SUPERVISION
J~ in the accounts kept by t~e Department, costs of supervision are found to be exceedingly high, the Department re-
serves the right to bill the permittee for actual expenses incurred by the supervision and inspection of the permittee's
project. '
