Your deponents are owners of certain property on the easterly side of Wells Avenue, Peconic, New York, which they pur- chased from Herbert W. Wells, as Executor of the Estate of George H. Wells by deed dated March 9 , 1982 , recorded in the Suffolk County Clerk' s Office on March 17 , 1982 , in Liber 9155 at page 424 a copy of which deed is attached hereto as Schedule A. The description of the property is contained in the aforesaid deed attached hereto as Schedule A and is further shown on a survey of Roderick Van Tuyl dated August 30 , 1981, amended on 1982 , attached hereto as Schedule B. Wells, which was approved by the Southold Town Planning Board on October 18 , 1979. 2. It has come to the attention of your deponents a person by the name of Alfred N. DiNunzio, Jr. , the successor in title to John Krukowski, owns certain property to the north of your depon- ents and claims to own portions of your deponents' property which is depicted in an area of questionable title as shown on Schedule B. Your deponents are hereby submitting an application for a Building Permit to the Building Department of the Town of Southold to erect a one family dwelling on both parcels 3 and 4 of the mino subdivision of Herbert H. Wells as Executor of the Estate of George H. Wells. Your deponents are using as the front and rear yard measurements those portions of your deponents ' property in which title is not questioned. Your deponents represent they intend to attempt to work out some type of a boundary line agree- ment to clarify the title situation with Alfred N. DiNunzio, Jr. and subsequently amend the minor subdivision map to reflect the corrected property lines. In addition your deponents ' property will be shown as one lot on said amended subdivision map, and in no event will more than one structure be built on same. 3. The premises in question is also depicted as Lots No. 3 and 4 on Minor Subdivision Map for the "Estate of George Wells" approved October 18 , 1979. It is the opinion of the board that the new dwelling construction as exists was built within reason considering the elevations of the property and the location of the meadowland. The new dwelling is set back from Wells Road 50 feet. Applicant is required to be a minimum of 75 ' landward of the tidal wetland boundary as per plans submitted to the N.Y.S . Department of Environmental Conservation under Permit #10-82-0515 . Under the circumstances, the board finds that the appli- cation is not unreasonable.
