Pell III Supervisor, To~ql of Southold Town Hall Main Street Southold, ~ew York 11971 SEPg 1982 Community Number: 360813 Suffix Code: A Dear Mr. Pell: The Flood Insurance Rate Map for your community has been revised to modify the zone designation of the flood having a one.-percent chance of occurrence in any given year (base flood) for the portions above 4 feet National Geodetic Verti- cal Datum of 1929 (NGVD) of a parcel of property lying along the Great Peconic Bay in the Town of Southold, New York, recorded in Liber 3205, Pages 337 through 339 in the Suffolk County Clerk's Office from Zone V4 to Zone A4. This zone modification is being made after reviewing the data that was submitted by the property owner's architect, Garrett A. Strang, on behalf of the Town and amends the currently effective FIP~I, dated March 18, 1980. This modification has been made pursuant to Section 206 of the Flood Disaster P~otection Act of 1973 (P.L. 93-234) and is in accordance with the National Flood Insurance Act of 1968, as amended, (Title XIII of the Housing and Urban Development Act of 1968, P.L. 90-448) 42 U.S.C. 4001-4128 and 44 CFR Part 65. Public notification of the modification to the elevation will be given in the Suffolk Times on or about September 17, 1982 and September 24, 1982. In addition, notice of changes will be published in the Federal Register. As required by tile legislation, a community must adopt and enforce flood plain management measures to ensure continued eligibility to participate in the National Flood Insurance Program (NFIP). Therefore, your community must en- force these regulations using, at a minimum, the elevations and zones in the special flood hazards areas shown on your community's FIRbl, including the above-meatioeed zone modification. The community n~aber and suffix code listed above will be used for all flood insurance policies and rene;~als issued for your community. Tile revised zone designation is effective as of the date of this letter; how- ever, within 90 days of tile second publication in the Suffolk Times, a citizen may request tile Federal Emergency Management Agency to .re6onsider this de- termination. Pell III - 2- It should be noted that the revision of the zone designation from V4 to A4 does not remove the applicability of the National Flood Insurance Program's flood plain management criteria. However, the appropriate regulations for those zones are now found at 44 CFR 60.3 (c) and not at 44 CFR 60.3 (e). Although there are differences between those sections, there is still the overall requiremeet that all new construction must be elevated so that the lowest floor is elevated to or above the base flood elevatiou (bfe). A reanalysis of the coastal flood hazards in the Town of Southold, New York has been initiated by the Federal Emergeucy Management Ageecy and data will be generated in the near future which may modify this determination. This re- analysis will eventually result in the publication of a revised FIRM and the~ effective zone designations for flood hazard areas within the Town of Southold will be based upon the revised FIRM. The first 1516.21 feet of the subject right-of-way has a legal width of 50 feet and our records show that this portion of the right-of-way was approved on November 2, 1972 under Appeal No. 1679. The additional 583.25 feet has a legal width of 30 feet and is in excellent condition. For the record it is also noted that the premises in question is more particularly known as County Tax Map District 1000, Section 115, Block 17, Lot 18 and contains an area of approximately 6.5 acres, which is vacant. In considering this appeal, the board determines the variance request will not cause detriment to adjoining properties; that the circumstances herein are unique; that the difficulty cannot be obviated by a method, feasible to appellants, other than a variance; that no adverse effects will be produced on available governmental facilities of any increased population; that the relief requested will be in harmony with and promote the general purposes of zoning; and that the interests of justice will be served by allowing the variance as indicated below.
