Instructions
A. This application must be filled in typewriter OR ink, and submitte~to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topographic features.
2. Final approval of Health Dept. of water supply and sewerage disposal-(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the buikJing.
5. Submit Planning Board approval of completed site plan requirements where applicable.
For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of peoperty showing all property lines, streets, buildings and unusual natural or
topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.

Dear Mr. Luddecke:
With reference to this board's decision rendered April 10,
1980 concerning the matter of Clement W. Booth, please be
advised that the sixth sentence of the findings, located on
page two of the board's action dated 4/25/80, should be worded
as follows:
"...brick barn building on Lot No. 7 does lend itself... "
Lot No. "6" was erroneously typed and the number "7" is
the proper Lot number.
Also, an inquiry was made as to whether the board had
granted the insufficient sideyard area. The board unanimously
approved the application as applied for.

Dear Mr. Bruer:
The following action was taken by the $outhold Town Planning
Board at a regular meeting held April 6, 1981.
RESOLVED that whereas, a formal application for the approval of
a subdivision plat entitled Mount Beulah Acres was submitted to the
Planning Board on March 7, 1980, and an application fee of $70 was
paid on March 7, 1980, and
WHEREAS, a public hearing was held on the final map of said
subdivision at the Town Hall, Southold, New York, On February 26,
1981 at 7:30 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat and
application,
Now, therefore, be it RESOLVED that the application of Clement
W. Booth for approval of said subdivision plat prepared by Roderick
Van Tuyl be approved subject to the following:
i. Short radius curves should be provided at the corners of
Mount Beulah Avenue and Sound View Avenue, Mount Beulah Avenue and
Old North Road, and at the corners of the proposed road Cosden Court
and Mount Beulah Avenue.
2. Bond in the amount of $20,000 be presented to and accepted
by the Southold Town Board.

ZONING BOARD OF APPEAL~
After investigation and inspection, the Board finds that the
applicant is requesting approval of insufficient area of proposed
Lot No. 6, containing approximately 21,797 square feet, and
insufficient width of proposed 5or No. 6, having 99 feet fronting
Mount Beulah Avenue. The Board finds that the unusually large
brick barn building on Lot No. ~'~does lend itself to conversion
as a residence and to require applicant to continue its use as
a barn would cause extreme difficulties for applicant. The
Board also finds that there are similar size lots in the neigh-
borhood, and does agree with the reasoning of the applicant.
The Board finds that the circumstances present in this case
are unique, and that strict application of the ordinance would
produce practical difficulties or unnecessary hardship. The
Board believes that the granting of a variance in this case will
not change the character of the neighborhood and will observe
the spirit of the zoning ordinance.
