THE CHAIRMAN: Is there ,~nyone. present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that applicant requests permission to divide lot With. ~nsu~f~cient ~width~ and for approval of access on R.O.W. north side Manhanset Avenue, Greenport, New York. The findings of the Board are that a right of way is approved up to applicant's property and the Board is now approving access across one · lot. The Board finds that these lots will be larger than many in the area. The Board agrees with the reasoning of the applicant. Burrell came ?ut from N~w York for theihearilng. The Board of Appeals first came ~nto this in May-'~gf 19~2 when you granted an access to ~aynor through'?a'-privat~Irtght ofway off Manhanset Avenue. This is the sketch whz~h was presented at that time. Mr. Raynor had the property ~urveyed and had it set out in a subdivision for three pl~ts w~th access going through the property he was retaining, through M. Tuthill. We entered i~to negotiations with Mr. Raynor in the' latter part Of 19~3 w~th.the idea that these two lots were adaptab;~le fo~ bulld~ng separately. Mr. Burrell, as stated in thee petition, we~t for.approval to the Department' of Environmelntal ~onservatlon; t~tle was taken in December of 1973. The Bur~ell's negotiated to sell the lot next to Mr. Raynor and completed that t~tle. Mr. Terry, when he found the Deed, sgld zt was an zllegal transaction and we had to have iacces~ and ~pproV~l of..frontage so w? made application !on that basis. The survey does provide for access. Yo~ granted access up to here (indicating survey)... Mr. and Mrs.i Burr~ll secured access through this lot and are willing ito ha~e a wider access along this lot here. As you can see,! the ~ots are fully adequate as far as acreage is concerned. They have fine frontage on Gull Pond. That if the display of lights and signals on any work hereby authorized is not otherwise provided for by law, such lights and signals as may be pre- scribed by the United States Co~st Guard shah be installed and maintained by and at the expense of the owner. 10. All work carried out under this permit shall be performed in accor- dance with estabHshed engineering practice and in a workmanlike manner. 11. If granted under Articles 24'or 25; the Department reserves the right to reconsider this approval at any time and after due notice and hearing to continue, rescind or modify this permit in such a manner as may be found to be just and ecluitabie, if upon the expiration or revocation of this permit, the modification of the wetland hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of EnvironmeotalConservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 12. This permit shah not be construed as conveyin$ to the applicant any right to trespass upon the lands or interfere with the riparian rights of others to perform the permitted work or as authorizing the impairment of any rights, title or interest in real or personal property held. or vested in a person not a party to the permit. 13. Within one week of completion of the permitted work the bottom portion of that form shall also be completed and returned. For projects involving activities to be accomplished over a period of more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours to the commencement of'. resumption of work each year. If project design modifications take place after permit issuance, the permit- tee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permit- tee is advised that substantial modification may require submission of a new application for permit. G. Ail necessary precautions shall be taken to preclude contamination of any wet- lands or waterway by suspended solids, sediment, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project work. H. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. I. The permittee is advised to obtain any permits or approvals that may be re- quired from the U.S. Department of Army Corps of Engineers, New York District, 26 Federal Plaza, New York, NY 10007, (Attention Regulatory Functions Branch), prior to commencing work authorized herein.
