A. This application must be filled in typewriter OR ink, and subn4itted in duplicate to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topograohic features.
2. Final approval of Health Dept. of water supply and sewerage disposa --(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildlngs, Industrial buildings, Multiple Residences and similar building~ and installa-
ti?s. a certificate of Code compliance from the Architect or Engineer responsible for the buUding.
5. Suomit' Planning Board approval of completed site plan require~nents where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings ahd "pre-existing"
land uses:
1. Accurate survey of peopert¥ showing all property lines, streets, buildings and unusual natural or
topograph ic features.
2.Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3, Date of any housing code or safety inspection of buildings or premises, or other pertinent informa-
tion required to prepare a certificate. /

A public hearing concerning this matter was held on April 14, 1982.
Upon application of Ewald Karbiner and Joseph Tomitz, 39 Edgewood Drive,
New Hyde Park, NY (by Irving L. Price, Jr.,' Esq.) for a Variance for
Approval of Access, New York Town Law Art. 16, Sec. 280A. Location of
Property: 155 Sunset Path, Southold, NY; bounded north by Sunset Knoll
Association; east by Sunset Path; south by Offenheiser; west by L.I.
Sound; County Tax Map Parcel No. 1000-54-4-33. ,
The board made the following findings and determination:
By this application, applicants seek approval of access over an
existing private road with a good base, having ~ clearance of approxi-
mately 12 feet in width, located off the northerly side of Horton's
Lane, Southold. The lot to which this access is referred has front-
age along this access road of approximately 177.50 feet and is more
particularly known as County Tax Map District 1000, Section 54, Block
4, Lot 33, with an acreage of 1.346. The right-of-way in ques-
tion is the only viable, practical route to the premises.
In considering this appeal, the board determines that the
variance request is not substantial in relation to the code
requirements; that the circumstances herein are unique; that
by allowing the variance no substantial detriment to adjoining
properties would be created; that the difficulty cannot be
obviated by a method, feasible to appellant, other than a
variance; that no adverse effects will be produced on available
govern, mental facilities of any increased population; that the
relief requested will be in harmony with and promote the general
purposes of zoning; and that the interests of justice will be
served by allowing the variance as applied for and indicated
below.
