Instructions
A. This application must be filled in typewriter OR ink, and submitted in duplicate to the Building inspec-
tor with the following; for new buildings or new use:
I. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topographic features.
2.Final approval of Health Dept. of water supply and sewerage disposal--(S-9 form or equal).
3.Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5.Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of peoperty showing all property lines, streets, buildings and unusual natural or
topographic features.
2.Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.

Gentlemen:
I have enclosed herewith a copy of letter received
from William H. Price, Jr., who has represented the
above. It is my understanding that to da~e, an application
as he has suggested, has not been made to date.
At this point I am in a quandary. The Appeal #2693
was denied by the Board. The resolution set a time limit
of 60 days to remove the illegal structure. Subsequently
another appeal was made, #2725, for the same relief
sought after in Appeal #2693, however, this appeal was
denied because the total area of structure exceeded 20%
of the total lot area. This would indicate to me that
if the structure would now meet criterior for area, it
would now be approved for insufficient set back, it
appears that Mr. Frice plans to proceed this way.
Since a hardship did not exist until the deck was
constructed, requiring a building permit, in my opinion, a
variance would condone this practice. It is very difficult
now for the Building Department to keep pace with the
numerous illegal structures being erected, therefore,
approval of this illegal structure under another appeal, I am
afraid~ would set the trend for others to do the same.

Dear Mr. Hindermann:
As you are aware, I am the attorney for Mr. and Mrs.
Frank E. Brophy and have received from them a copy of your
order to remedy violation dated October 20, 1980. Mr. and
Mrs. Brophy received your order on or about October 22, 1980
and brought it to me at my office on October 25, 1980.
As you are aware, Mr. and Mrs. Brophy applied for a
variance for the deck on the subject premises to the Zoning
Board of Appeals. The application was denied for the stated
reason:
...The Board finds that the exist-
ing structure and deck would exceed
20% of the lot coverage of the total
lot area; and it is the feeling of
the Board to grant a variance herein
technically would not warrant justi-
fication ....
Mr. and Mrs. Brophy have instructed me to attempt to
renew the variance application to deal specifically with the
lot coverage issue. To renew this application will require time
for me to make further investigations and to have maps or sur-
veys prepared by a surveyor.
I am to be on vacation and will not be in this area
from November 1, 1980 through November 17, 1980. Upon my return,
~ plan to con~ence the investigation and to order the necessary
surveys and/or maps.

Department of the Town of Southold take no further action in
respect to the subject premises until the renewal of the

ZONING BOARD OF APPEAL~
After investigation and personal inspection, ~he Board finds
as follows:
Appellant has appealed to this Board seeking a variance to
approve the construction of a deck to existing dwe%ling in side and
front yard areas, leaving approximately three feet between the deck
and the front property line. '
The premises in question is a parcel of land located on the
westerly side of Second Street, New Suffolk, more ~articularly
known as County Tax Map District 1000, Section 117~ Block 10,
Lot 20.7, having an area of 7,231 square feet. There is presently
erected on the lot a private one-family dwelling with porch and
the deck under consideration. The dwelling without the deck has
a frontyard setback of approximately 14½ feet fromiSecond Street.
Appellant previously applied to this Board fo~ approval of
the subject deck in Appeal No. 2693, which was denied. The
relief requested in this application is synonymousito the previous
appeal.
Appellant in this appeal has set forth the practical diffi-
culties in removing the deck and the reasons for locating the
deck as applied for rather than in the rear yard or other side
yard areas.
Upon personal inspection of the premises, theiBoard finds
that the existing structure and deck would exceed 20% of the lot
coverage of the total lot area; and it is the feeling of the
Board to grant the variance herein technically would not warrant
justification. Accordingly, the variance is denied.
On motion by Mr. Douglass, seconded by Mr. Grigonis, it
was
RESOLVED, that Frank E. and Mary L. Brophy, be denied the
relief requested in Appeal No. 2725 as applied for~

By this appeal, applicant seeks permission to construct a
10' by 12' deck addition at the'southeasterly corner of the exist-
ing one-family dwelling.' Applicant proposes a setback of not less
than 6'6" from the front property line and approximately 10'6"
setback from the southerly side property line.
The premises in question is a parcel of land located on the
westerly side of Second Street, New Suffolk, more particularly
known as County Tax Map District 1000, Section 117, Bock 10, Lot
20.7, having an area of 7,231 square feet, road frontage of approxi-
mately 66 feet and depth of approximately 100 feet.
Applicant has previously applied to this board for approvals
of a deck addition along the frontyard of the dwelling with a
setback of three feet or less from the front property line. The
board found that the deck addition originally applied in Appeal
Nos. 2725 and 2693 exceeded 20% of the maximum-permitted lot
coverage required of the zoning code, and the variances were denied.
In considering this appeal, the board determines that the
variance request is not substantial; that the circumstances
herein are unique; that by allowing the variance no substantial
detriment to adjoining properties would be created; that the
difficulty cannot be obviated by a method, feasible to appellant,
other than a variance; that no adverse effects will be produced
on available governmental facilities of any increased population;
that the relief requested will be in harmony with and promote the
general purposes of zoning; and that the interests of justice
will be served by allowing the variance.
On motion by Mr. Grigonis, seconded by Mr. Goehringer, it was
RESOLVED, that the application of Frank E. Brophy, Appeal
No. 2922, for a deck addition to dwelling with an insufficient
front and side yard setback, be GRANTED AS APPLIED FOR.
