Posselt Attn: Building Inspector Dear Sir: This is to confirm our discussion concerning the corrections to the egress objections on the above application: Mr. Posselt has decided, for reasons of cost, to eliminate the outside cellar stairs. This should eliminate the objection to the first floor bedroom egress. In the left side second floor bedroom, the window will be changed to C24W, 4'-0" wide x 4'-0" high. In the right side bedroom, the windows will be changed to C14W, 2'-0" wide x 4'-0" high.. All of the above windows are in excess of 4 square feet, have openings in excess of 1'-6": their sills will be approximately 2'-8" above the finished floor. III, Sec. 100-31 for approval of an insufficient rearyard setback for new dwelling at 3145 Ole Jule Lane, Mattituck, NY; bounded north by Allsopp; west by Ole Jule Lane; south by Ole Jule Lane; east by Battersby; County Tax Map Item No. 1000-122-5-18. CG:lk FORM ZB4 ZONING BOARD OF APPEALS After investigation and personal inspection, and determines as follows: th~ Board finds By this appeal, appellant seeks permission to cdnstruct a new dwelling at the southerly end of Ole Jule Lane, Matt~tuck, with a rearyard setback of not less than 15 feet, establlsh~d frontyard setback of approximately 40 feet, and sideyard setback of approxi- mately 50 feet. The premises in question contains ah area of 16,120 square feet and has been in single and separate ownership since 1964 according to information supplied from th~ Assessors of the Town of Southold. The Board agrees with the ~easoning of appellant. The Board finds that the relief requested is no~ substantial in relation-to the Code requirements; that the reli'ef would not change the character of the neighborhood; that no a!dverse effect will be produced on available governmental facilitie~s of any increased population; that the practical difficulti%s are unique; and that the interests of justice will be served by igranting the relief as requested. On motion by Mr. Goehringer, seconded by Mr. Sawicki, it was RESOLVED, that Richard Posselt be granted a var:iance to the zoning ordinance, Article III, Section 00~-31 'as appilied for in Appeal No. 2855, provided that the setback from the ~asterly property line (currently abutting Battersby) be not iless than 15 feet.
